[1997 Code § 373-28]
As used in this Article, the following terms shall have the meanings indicated:
ASHES
The residue left from fires in heaters, ranges and stoves.
GARBAGE
Animal and vegetable matter that has been used as food and the waste therefrom and dead animals and parts of the same.
SHELLS
The shells from oysters and clams that have been used as food.
TRASH or RUBBISH
Household waste such as paper, rags, cardboard boxes, old bottles, broken crockery, tin cans, worn-out furniture, tree and hedge trimmings, lawn clippings and all waste that accumulates around dwellings, except refuse from building operations and repairs, such as lime, brick, cement and lumber.

Every householder or proprietor of a hotel, restaurant, boardinghouse, market house, store or theater shall provide suitable receptacles for garbage, rubbish and ashes to be placed at the point most convenient for collections, said point or location to be fixed by the Department of Public Works.

A. 
The receptacle for garbage shall be a galvanized iron or other metal receptacle approved by the Board of Health, shall be watertight, provided with suitable handles and a tight-fitting cover that will prevent access of flies to the contents, and shall be kept covered at all times Their capacity shall be not less than four gallons nor more than 20 gallons.
B. 
The receptacles for trash shall be either barrels or boxes of no greater capacity than a sugar barrel.
C. 
The receptacle for ashes shall be either boxes or cans or small barrels that can be handled by one man. The receptacle for shells shall be the receptacle for ashes.

Owners of apartment houses shall at all times when such apartments are occupied furnish community receptacles for garbage, trash and ashes in which the tenant may empty the receptacles used for each apartment, except stores and restaurants, the proprietors of which shall furnish their own receptacles.

The placing of garbage in the receptacles for trash or ashes, or the placing of either trash or ashes in receptacles for garbage, or the sprinkling of disinfectants or poisonous chemicals on the contents of the garbage receptacle is prohibited.

A. 
The contents of the receptacles enumerated in this article shall only be emptied by the authorized contractors or their employees, by depositing in vehicles authorized by the Board of Health. The tenants of all premises shall cause receptacles to be kept clean, and no rainwater or other liquid shall be allowed to enter the garbage receptacle.
B. 
Every receptacle from which the garbage has been removed by any licensed collector shall be entirely emptied of its contents and not any of the contents shall be allowed to fall upon the ground. The covers of receptacles shall be placed upon the receptacle after the contents have been removed.
C. 
The receptacle for trash shall be carefully returned to the place from which it was taken. The practice of throwing the receptacle to the ground from the top of the vehicle is hereby prohibited. Any receptacle broken with deliberate intent or in violation of this section shall be replaced at the expense of the contractor. In addition to the penalty hereinafter provided, any person violating any of the provisions of this Article or any other section thereof shall, for each and every offense be liable for the penalty of not less than $5 and not more than $500, to be recovered before any person and in such court having jurisdiction.
