This chapter may be cited as the "Park Ordinance of 2011."
As used in this chapter, the following terms shall have the meanings indicated:
AUTHORIZED REPRESENTATIVE
The Township Manager or other employees or officials authorized by the Board of Supervisors of the Township to administer and enforce provisions of this chapter.
PARK
Includes all community parks in East Cocalico Township.
TOWNSHIP
The Township of East Cocalico.
A. 
All structures, equipment and facilities owned by the Township located in any park are to be used in an appropriate fashion for the activities for which they are designed and intended.
B. 
It shall be unlawful for any person to do any acts herein described within the limits of any park:
(1) 
To engage in any conduct which interferes with the peaceable use of the park by other people, including but not limited to the throwing of stones, sticks, or hard objects in the vicinity of other people and the use of lewd, vulgar or sexually suggestive language or behavior in the presence of other people.
(2) 
To permit any owner's dog, livestock or other pet or animal under the owner's control to run at large. An owner is responsible for cleaning up any waste from his or her animal and properly disposing of it in containers provided for the same or in the owner's trash collection receptacles.
(3) 
To hunt for, shoot at, harass, catch, or intentionally injure or kill or attempt to shoot at, harass, catch, or intentionally injure or kill, or without dogs, any bird or animal.
(4) 
To commit any public nuisance.
(5) 
To possess, drink, or be under the influence of malt or brewed beverages, spirituous liquors, wine or controlled substances.
(6) 
To post or erect any bills, notices or advertising matter of any kind without authorization, provided that this shall not apply to notices placed by employees of the Township engaged in the performance of their duties.
(7) 
To sell or barter or offer for sale or barter any merchandise, article or thing whatsoever without authorization provided this shall not apply to authorized concessionaires.
(8) 
To have any musical, theatrical, or other entertainment therein without authorization.
(9) 
To discharge firearms, bows and arrows, air or spring rifles or slings.
(10) 
To swim, wade or bathe in any place except in a public swimming or wading pool.
(11) 
To injure, deface or destroy any posted or permanently fixed signs or notices.
(12) 
To break, cut, deface, disturb, injure or take any flower, fruit, plant, tree, shrub, bench, building, fence, monument, or other structure, apparatus or property.
(13) 
To violate any posted rules for or misuse any picnic area, camp area, play field, swimming pool or other recreational area.
(14) 
To gather or remove any wood, turf, grass, soil, rock, sand or gravel.
(15) 
To make or kindle fire except in picnic stoves or fireplaces provided for that purpose.
(16) 
To engage in camping, archery, and hitting of golf balls, except on such grounds or places specifically designated for such purpose.
(17) 
To smoke in areas where prohibited by sign.
(18) 
To discard tobacco or any tobacco byproducts in any park area.
(19) 
To throw or deposit cans, bottles, broken glass, paper or rubbish of any description except in containers provided for the same.
(20) 
To discard any dead animal or offensive matter or substance of any kind.
(21) 
To stand or park any vehicle except in those areas designated therefore.
(22) 
To congregate in any area which will hamper the free movement of pedestrians.
(23) 
To operate unlicensed motor vehicles.
(24) 
To operate any vehicle or bicycle or at any place other than roadways or special areas designed for operation of such vehicles.
(25) 
To use or operate skateboards or inline skates on any structures not designed for the same or for general pedestrian and vehicular travel. Without limitation, the structures upon which skateboarding or inline skating is prohibited include those designed or used for basketball, tennis, and children's playground facilities, such as swings, climbing apparatus, seesaws, merry-go-rounds and similar items.
(26) 
To operate snowmobiles, minibikes, go-carts or any device which utilizes burning fuel, explosive gas or compressed gas as a propellant at any place except in authorized areas.
(27) 
To abandon any vehicles within the limits of any park or roads abutting said park.
(28) 
To exceed a speed limit of 15 miles per hour, unless otherwise posted, on all roadways, driveways, parking lots and other areas intended for motorized vehicular traffic.
All parks shall be closed from 1/2 hour after sundown (except for lighted courts controlled by coin meters, which times of operation are set by the Board of Supervisors, in which case users have 1/2 hour after lighted courts are closed to leave the park) until 6:00 a.m. Any person present in a park, at any location, other than during the aforesaid hours, shall be prosecuted as a trespasser. Notwithstanding the foregoing, the Supervisors may extend the hours of permissible park use for scheduled programs and events.
A. 
Whenever authorization is required by this chapter, such shall be sought from the Township Manager or other employee or employees authorized by the Board of Supervisors from time to time and shall be subject to rules and regulations adopted from time to time. Any such authorization shall be subject to such rules and regulations as fully as though the same were inserted in the specific authorization granted to permit the proposed use.
B. 
Any person or persons who have received such authorization, by reservation or otherwise, shall be liable for any loss, damage or injury sustained by any person or to any Township property by reason of the negligence or intentional conduct of the person or persons to whom the authorization was granted or by such person's agents, employees or invitees.
C. 
It shall be unlawful for any person receiving authorization to the park to make an alteration to such authorization.
D. 
Specific portions of this chapter or of any rules or regulations adopted under it may be waived only upon written approval of the Board of Supervisors.
E. 
The Board of Supervisors may from time to time, by separate resolution, establish reasonable fees and deposit arrangements for the use of the park therein and may adopt reasonable rules and regulations consistent with the provisions of this chapter.
Any person who shall violate or fail to comply with the provisions of this chapter or any regulations adopted by the Board of Supervisors thereunder is guilty of a summary offense and upon conviction thereof shall before a District Justice be sentenced to pay a fine of not less than $25 nor more than $300, together with costs of prosecution and in default of payment thereof shall be imprisoned for not more than 30 days.
This chapter shall become effective five days after adoption.
All ordinances inconsistent with the provisions of this chapter are hereby repealed, including but not limited to Ordinance No. 73.
