Section 100.010 Community Building Facility.

A. 
Housing Authority. The Board of Aldermen of the City of Smithville does hereby designate the Housing Authority of the City of Smithville as the operating agency on behalf of the City of Smithville for the administration, operation and regulation of the Community Building referred to herein; said Housing Authority of the City of Smithville is hereby granted the authority to administer and operate said facility on behalf of the City of Smithville and to establish proper regulations for the use and operation thereof, all in accordance with the ordinances of this City.

Section 100.020 Reimbursement of Expenses to Mayor and Aldermen.

A. 
Mayor. Due to the necessary and recurring expenses incurred while performing the duties of Mayor, the person holding this office shall receive a three hundred dollar ($300.00) per month reimbursement for these normal expenses.
B. 
Aldermen. Due to the necessary and recurring expenses incurred while performing the duties of Aldermen, the person holding the office shall receive a one hundred fifty dollar ($150.00) per month reimbursement for these normal expenses.

Section 100.030 General Penalty.

A. 
General Penalty. Except as hereinafter provided, whenever in this Code or in any other ordinance of this City or in any rule, regulation, notice or order promulgated pursuant to such Code or other such ordinance of the City any act is prohibited or is made or declared to be unlawful or any offense or a misdemeanor, or whenever in such code or in such other City ordinance, rule, regulation, notice or order the doing of any act is required or the failure to do any act is declared to be unlawful, where no specific penalty is provided therefore the violation of any such provision of this Code or of any other ordinance of the City or of any rule, regulation, notice or order promulgated pursuant to such Code or other City ordinance shall be punished by a fine not exceeding five hundred dollars ($500.00) or by imprisonment for a period not exceeding ninety (90) days or by both such fine and imprisonment; provided, that in any case wherein the penalty for an offense is fixed by any Statute of the State, the statutory penalty, and no other, shall be imposed for the punishment of such offense, except that imprisonment may be made in the City Jail or workhouse instead of the County Jail.
Whenever any provision of the Revised Statutes of Missouri or other Statute of the State limits the authority of the City to punish the violation of any particular provision of this Code or other City ordinance or rule, regulation, notice or order promulgated pursuant thereto a fine of less amount than that provided in this Section, then the violation of such particular provision in this Code or other City ordinance, rule regulation, notice or order shall be punished by the imposition of not more than the maximum fine or imprisonment so authorized, or by both such fine and imprisonment.
B. 
Continuing Violation. A separate offense shall be deemed committed upon each day during or on which a violation of this Code or any other City ordinance, rule, regulation, notice or order promulgated pursuant thereto, occurs, or continues, unless otherwise provided.

Section 100.040 Fees for Use of Credit Cards.

Customers paying by credit or debit card shall be assessed a service fee to be determined by the purchasing agent.

Section 100.050 Retirement Benefits.

A. 
Retirement Plan — Adopted; Employees Covered. The City elects to have all its eligible employees covered by the Missouri Local Government Employees Retirement System.
B. 
Benefit Program Selected. The City's benefit program for member employees under the retirement system shall be contributory Benefit Program L-7 in accordance with Sections 70.655, 70.705, and 70.730, RSMo.
C. 
Determination Of Final Average Salary. A thirty-six (36) consecutive-month period shall be used for determining a member employee's final average salary under the retirement system in accordance with Sections 70.600 and 70.656, RSMo.
D. 
Retirement Age. The retirement age provision of covered employees provides member employees the option of retirement upon attaining minimum service retirement age in accordance with Sections 70.600, 70.645 and 70.646, RSMo.
