Wherever a space is marked off on any street for the parking
of an individual vehicle, every vehicle parked there shall be parked
wholly within the lines bounding that space, and it shall be a violation
of this article for any person to park a vehicle or allow it to remain
parked otherwise. [For the requirement that a vehicle standing or
parked upon a street be positioned parallel to the curb with its wheels
within 12 inches of the curb, see § 3354 of the Vehicle
Code.[1]]

A.Â
It shall be unlawful to park a vehicle at any time of day in a Borough
alley.
B.Â
It shall be unlawful to park or leave any mechanically inoperable
vehicle or any vehicle without a current registration or any vehicle
without a current inspection sticker on any public street, alley or
highway in the Borough of Lewistown, metered parking lots owned or
operated by the Borough, or unmetered parking lots owned or operated
by the Borough.

It shall be unlawful for any person to park, or to allow to remain parked, a truck, tractor, truck tractor, trailer or semitrailer on any of the streets or parts of streets referred to in § 233-26A of this chapter, provided nothing in this section shall prohibit a person from parking an emergency vehicle on any of those streets or parts of streets while the emergency vehicle is responding to an emergency and, as in § 233-26, nothing in this section shall prohibit a person from parking on any of those streets or parts of streets a truck or other vehicle referred to in this section which is making local deliveries to or pickups from premises located along that street or part of a street.

B.Â
The Borough Council shall have the power to establish special-purpose parking spaces under this § 233-35 for such purposes or such vehicles and for such periods of parking time as the Council may determine necessary or appropriate under the particular circumstances. Such special-purpose parking spaces may be established by Council at any location on any Borough street (irrespective of whether the location is in a parking meter zone) or at any location in a service drive, parking lot, playground, park, recreation area, or other facility owned or operated by the Borough. However, in establishing a special-purpose parking space on a Borough street (and irrespective of whether the special-purpose parking space will be located in a parking meter zone), Council shall consider such circumstances or factors as:
(1)Â
The benefit to the public in providing a special-purpose parking
space for public business or other special public purpose.
(2)Â
The benefit to the public health, safety or welfare in providing
a special-purpose parking space for law enforcement officers or for
those federal, state, county or Borough personnel whose duties require
frequent daily trips back and forth from their offices.
(3)Â
The benefit to patient care in providing a special-purpose parking
space for a doctor or the like whose duties require frequent daily
trips back and forth between his office and a hospital, medical center,
emergency center, or the like.
(4)Â
The benefit to passenger service or carrier dispatch in providing
a special-purpose parking space for taxicab stands.

The Borough Council shall have the power under this § 233-35C to establish (by resolution adopted by Council from time to time) parking spaces reserved exclusively for handicapped individuals or severely disabled veterans. Such parking spaces (which are referred to hereafter as "HP spaces") may be established by Council at any location on any Borough street (irrespective of whether the location is in a parking meter zone) or at any location in a service drive, parking lot, playground, park, recreation area, or other facility owned or operated by the Borough. However, in establishing an HP space on a Borough street (and irrespective of whether the HP space will be located in a parking meter zone), Council shall consider such circumstances or factors as:

The benefit to handicapped members of the public in providing
an HP space on a Borough street to address a need or problem special
to the handicapped.
[2]Â
The benefit to a handicapped individual who resides or works
at a location where entry and exit by the handicapped individual (or
parking by the handicapped individual) is limited to a site on a Borough
street in providing an HP space on the street as close as possible
to that handicapped individual's place of residence or place of work.
(b)Â
After Council has established an HP space, a copy of the resolution establishing that HP space shall be placed in the HP Book kept in the office of the Borough Secretary, and the location of the HP space shall be plotted and shown on the HP Map kept in the office of the Borough Secretary. The HP Book and the HP Map (with all the explanatory matter, notations, references and other information shown on the Map) are hereby incorporated in and made a part of this § 233-35C by reference and shall be as much a part of this subsection as if the contents of the book and the map were fully set forth herein or attached hereto.
(2)Â
Except for persons parking vehicles lawfully bearing a handicapped
or severely disabled veteran registration plate or displaying a handicapped
or severely disabled parking placard when such vehicles are being
operated by or for the transportation of a handicapped individual
or a severely disabled veteran, it shall be unlawful for any person
to park a vehicle in an HP space.
D.Â
In establishing a special-purpose parking space or HP space (and
irrespective of where the special-purpose parking space or HP space
will be located), Council may require that the person seeking the
benefit of a special-purpose parking space or HP space is established
or the person who will use the special-purpose parking space or HP
space:

(1)Â
Fill out an application on a form provided by the Borough;
(2)Â
Provide such information as is required by the Borough; and
(3)Â
Pay any application fee required by the Borough. The amount of any
application fee shall be adopted by separate resolution by the Borough
Council of the Borough of Lewistown, and such may be amended from
time to time by the Borough of Lewistown. The current Borough Costs
and Fees Schedule shall be on file in the Borough's offices and otherwise
available to the public.
E.Â
In establishing a special-purpose parking space or HP space (and
irrespective of where the special-purpose parking space or HP space
will be located), Council may:
(1)Â
Require that the person for whose benefit the special-purpose parking
space or HP space is established or the person who will use the special-purpose
parking space or HP space: a) reimburse the Borough for the costs
of such official signs as are installed by the Borough to designate
the special-purpose parking space or HP space and the conditions,
restrictions, or the like on parking in that space; and b) reimburse
the Borough for the costs incurred by the Borough in installing the
signs; and
(2)Â
If the special-purpose parking space or HP space will replace a metered
parking space and result in the removal of a parking meter (as distinguished
from making the space a special-purpose metered parking space or an
HP metered parking space), require that the person for whose benefit
the special-purpose parking space or HP space is established or the
person who will use the special-purpose parking space or HP space:
a) reimburse the Borough for the costs incurred by the Borough in
removing the parking meter; and b) pay the Borough a weekly, monthly,
annual or other periodic fee in lieu of the parking meter revenues
forfeited by the Borough in removing the parking meter.
F.Â
If a special-purpose parking space or HP space is once established
and is thereafter abandoned, forfeited, relinquished or turned back
to the Borough, the Borough Manager may:
(1)Â
Require that the person for whose benefit the special-purpose parking space or HP space was established or the person who used the special-purpose parking space or HP space: a) reimburse the Borough for the costs incurred by the Borough in removing any signs installed under Subsection E(1); and b) reimburse the Borough for the costs incurred by the Borough in reinstalling any parking meter removed under Subsection E(2); and
(2)Â
If the periodic fee paid for the special-purpose parking space or HP space under Subsection E(2) was other than a weekly or monthly fee, refund a proportionate part of the fee — the refund to be based on the number of whole calendar months (excluding any fraction of a month) remaining until the expiration of the period for which the fee was paid, and the refund to be reduced and offset by any costs due the Borough under Subsection F(1) above.

A.Â
Except as provided in Subsection B of this section, it shall be unlawful for any person to stop, stand or park a vehicle on the roadway side of any vehicle which is stopped or parked at the edge or curb of any street.
B.Â
Double standing or double parking for the purpose of loading or unloading
persons or property, for no longer than reasonably necessary, shall
be permitted Monday through Sunday on streets within parking meter
zones of the Borough, except between the hours of 10:00 a.m. and 6:00
p.m., prevailing time, daily, during which time double standing or
double parking for the purpose of loading or unloading persons or
property is expressly prohibited on streets within parking meter zones.
Except where parking is limited to a shorter period of time
at all times or at certain specified times, or except where parking
is permitted for a longer period of time at all times or at certain
specified times, it shall be unlawful to park a vehicle or to allow
a vehicle to remain parked in the same location on a street for longer
than 12 consecutive hours.
It shall be unlawful to do any of the following acts or things
in or on any service drive, mall, parking lot, playground, park, recreation
area, or other facility owned or operated by the Borough:
A.Â
To drive a vehicle in any place except in a road or lane designated
for driving or clearly intended for driving.
B.Â
To drive a vehicle in a road or lane except in the direction indicated
by signs, lines or markings as the direction for driving.
C.Â
To drive a vehicle in excess of 10 miles per hour.
D.Â
To park a vehicle in any place except in a parking space designated
as such or in a place clearly intended for parking.
E.Â
To drive or park a vehicle with reckless disregard for the rights
or safety of others or in a manner so as to endanger any person or
property.
F.Â
To drive or park a vehicle or to allow a vehicle to remain parked
in the facility at any time when the facility is closed to public
use.
Except for making such minor emergency repairs as changing a
flat tire, jump-starting a battery, changing a battery, replacing
a fan belt, or the like, no person shall repair a vehicle in or on
any sidewalk in the Borough, any public highway in the Borough, or
any Borough street or alley or in or on any service drive, mall, parking
lot, playground, park, recreation area, or other facility owned or
operated by the Borough.

A.Â
Any person who violates § 233-30 shall, upon conviction, be sentenced to pay a fine of not less than $50 and the costs of prosecution for a first conviction; a fine of not less than $150 and the costs of prosecution for a second conviction occurring 15 days or more after a first conviction; a fine of not less than $300 and the costs of prosecution for a third or subsequent conviction occurring 15 days or more after a second conviction. Any person who violates § 233-35C(2) shall, upon conviction, be sentenced to pay a fine of not less than $150 and not more than $250 and the costs of prosecution. Any person who violates § 233-34 shall, upon conviction, be sentenced to pay a fine of not less than $100 and the costs of prosecution. Any person who violates a section of this Article IV other than § 233-30, 233-34 or 233-35C(2) shall, upon conviction, be sentenced to pay a fine of $30 and the costs of prosecution.

B.Â
In enforcing and administering this Article IV, it shall be the duty of a police officer or parking enforcement officer of the Borough to report to the Police Department office:
(1)Â
The state license number and the make of a vehicle driven, parked, left standing or being repaired in violation of a section of this Article IV;
(2)Â
The date and time when the violation occurred;
(3)Â
The nature of the violation;
(5)Â
Any other relevant facts necessary to understand the circumstances
attending the violation.
C.Â
In addition to the report to be made under Subsection B, the police officer or parking enforcement officer shall place on the vehicle a courtesy ticket containing:
(2)Â
A notice substantially to the effect that the owner or operator of
the vehicle may, within seven days after the date noted on the ticket,
pay at the Lewistown Municipal Building as the penalty cost for the
violation:
(3)Â
A warning substantially to the effect that, if the penalty cost is
not paid within the seven-day period after the date noted on the ticket,
a summons will be issued by a Magisterial District Judge, and a fine
will be imposed and costs of prosecution added.
D.Â
An owner or operator who does not pay the penalty cost within the seven-day period after the date noted on the ticket shall be subject to prosecution and conviction and to payment of the fine and costs of prosecution, under Subsection A.
