Borough of Lewistown, PA Article VII Unmetered Parking Lots

§ 233-64 Unmetered parking lots established.

A. The following parking lots, which are owned or operated by the Borough, are established as unmetered parking lots:

B. Except as provided in § 233-65, the maximum parking time in an unmetered parking lot referred to in Subsection A shall be 24 consecutive hours.

§ 233-65 Reserved parking spaces may be provided.

The Borough Manager may provide, at convenient and suitable locations in an unmetered parking lot, reserved parking spaces for such persons, for such periods of time, for such rental charges, and on such other terms and conditions as the Borough Manager may determine appropriate under all the circumstances. A reserved parking space provided under this § 233-65 shall be designated as a reserved parking space by an appropriate sign or notice. It shall be unlawful and a violation of this section for any person to park a vehicle in a reserved parking space which is not reserved for that person or the vehicle he is parking.

§ 233-66 Vehicle to be parked wholly within space marked .

A vehicle parked in an unmetered parking lot shall be parked wholly within the lines or other markings delineating a parking space and shall be parked with its front headed into the parking space. It shall be a violation of this § 233-66 to park a vehicle contrary to the provisions of this section.

§ 233-67 Violations of use of unmetered parking lot.

In addition to the violations referred to in §§ 233-38 and 233-39 of this chapter, it shall be a violation of this § 233-67 to do any of the following acts or things in an unmetered parking lot:

A. To park a vehicle or to allow a vehicle to remain parked for longer than the maximum parking time prescribed by § 233-64B.

B. In the case of reserved parking under § 233-65, to park a vehicle or to allow a vehicle to remain parked after the period of time (for which the reserved parking space was provided) has expired.

C. Except where permission has been granted by the Borough Council, the Borough Manager, or the Chief of Police, to drive or park any type or class of vehicle which is longer or wider than a luxury-size passenger automobile.

§ 233-68 Special-purpose parking spaces.

For the power of Council to establish special-purpose parking spaces in an unmetered parking lot, see § 233-35 of this chapter.

§ 233-69 Ticket and penalty for violation; fine upon prosecution and conviction.

A. Any person who violates § 233-65, 233-66 or 233-67 of this Article VII shall, upon conviction, be sentenced to pay a fine of not more than $15 and the costs of prosecution.

B. In enforcing and administering § 233-65, 233-66 or 233-67, it shall be the duty of a police officer or a parking enforcement officer of the Borough to report to the Police Department office:

(1) The state license number and the make of a vehicle parked or driven in violation of § 233-65, 233-66 or 233-67;

(2) The date and time when the violation occurred;

(3) The nature of the violation;

(4) The section of this Article VII which has been violated; and

(5) Any other relevant facts necessary to understand the circumstances attending the violation.

C. In addition to the report made under § 233-69B, the police officer or parking enforcement officer shall place on the vehicle a courtesy ticket containing:

(1) The information referred to in Subsection B(1), (2) and (3);

(2) A notice substantially to the effect that the owner or operator of the vehicle may, within seven days after the date noted on the ticket, pay at the Lewistown Municipal Building as the penalty cost for the violation:

(a) For violation of § 233-65, 233-66 or 233-67: $5.

(3) And a warning substantially to the effect that, if the penalty cost is not paid within the seven-day period after the date noted on the ticket, a summons will be issued by a Magisterial District Judge, and a fine will be imposed and costs of prosecution added.

D. An owner or operator who does not pay the penalty cost within the seven-day period set forth in Subsection C shall be subject to prosecution and conviction, and to payment of the fine and costs of prosecution under Subsection A of this section.

E. Exoneration. For the authority and power of certain designated personnel in the Police Department to exonerate a person who has violated § 233-65, 233-66 or 233-67 from payment of the penalty cost referred to in Subsection C(2) or from prosecution under Subsection D, see Chapter 46, § 46-16.
