Pursuant to the authority granted Council by the Borough Code,[1] the existent seven-member Recreation Board created under
previous ordinances of the Borough is confirmed as, and shall continue
as, the Recreation Board of the Borough.

A.
The Recreation Board shall be comprised of seven residents of the
Borough appointed by Council, and two of those seven residents may
be Councilmen and three of those seven residents may be members or
nominees of the Board of Directors of the Mifflin County School District.
No member of the Planning Commission, Zoning Hearing Board, Board
of Building Appeals, Police Civil Service Commission or any other
board, commission, bureau or agency of the Borough shall be eligible
for appointment to the Recreation Board, and no member of the Recreation
Board shall serve on any of those boards, commissions, bureaus or
agencies unless he first resigns from the Recreation Board.
B.
The seven members of the Recreation Board shall be divided into three
classes, with two members in the first class, two members in the second
class, and three members in the third class.
C.
The term of office of the members in a class shall be three years;
the term to expire on the second Monday in January or at such time
thereafter when successors to the members in the class are appointed
by Council. The terms of office of the members of the classes shall
be so staggered that the term of office of the two members in the
first class expires one year, the term of office of the two members
in the second class expires the following year, and the term of office
of the three members in the third class expires the year after that.
A.
If a vacancy occurs in a class of the Recreation Board other than
by expiration of the term of the members in the class, Council shall
fill the vacancy by appointing a resident of the Borough to serve
for the balance of the unexpired three-year term.
The members of the Recreation Board shall serve without compensation
but may be reimbursed by Council for necessary and reasonable expenses
incurred in the performance of their duties.

A.
Beginning on the first Tuesday in February and to and including the
first Tuesday in February of the following year, the Recreation Board
shall hold regular meetings on the first Tuesday of each month at
7:30 p.m. If there are no matters pending before the Recreation Board
which require its review, study, findings, conclusions, recommendations
or other action at a regularly scheduled meeting, the Chairman of
the Recreation Board may cancel that particular meeting.
B.
The Recreation Board may hold such special meetings as it may determine
are necessary or appropriate.
D.
During the month of January in each calendar year, the Administrative Secretary to the Recreation Board shall give public notice of the dates, times and places of the regular meetings of the Recreation Board scheduled under Subsection A. This public notice shall be published and concomitantly posted at least four days before the date of the first regular meeting of the Recreation Board scheduled under Subsection A.
E.
The Administrative Secretary to the Recreation Board shall give public notice of the date, time and place of any special meeting of the Recreation Board to be held under Subsection B. This public notice shall be published and concomitantly posted at least two days before the date of the special meeting.
A.
Each year at the regular meeting of the Recreation Board scheduled
for February, the members of the Recreation Board shall elect one
member as Chairman of the Recreation Board and one member as Vice
Chairman of the Recreation Board and may elect such other officers
as they may deem necessary or appropriate. The officers of the Recreation
Board shall serve for one year or until their successors are elected
by the members of the Recreation Board. The officers of the Recreation
Board may succeed themselves.
B.
Council shall assign the Borough Secretary (or Assistant Borough
Secretary), or the Borough Manager shall assign some other employee
of the Borough, to serve as Administrative Secretary to the Recreation
Board. The duties of the Administrative Secretary shall be to provide
the Recreation Board with such administrative services as scheduling
meetings, giving notice of meetings, preparing agendas for meetings,
preparing minutes of meetings, preparing reports, forwarding reports
to Council for action, and other like services.
C.
The Borough Manager shall serve as the practical engineering advisor
and public works advisor to the Recreation Board, and any matter which
involves engineering consideration with respect to, or involves equipping,
maintaining or improving, the parks, playgrounds or other recreation
facilities owned or operated by the Borough shall be subject to the
Borough Manager's review and comment.
D.
The Parks and Recreation Director shall serve as the operations and
programs advisor to the Recreation Board, and any matter which involves
the conduct or operation of the parks, playgrounds or other recreation
facilities owned or operated by the Borough or involves existent or
proposed recreation programs or changes thereto shall be subject to
the Parks and Recreation Director's review and comment.
The Recreation Board may make such rules to govern its meetings,
proceedings or review procedures as are permitted by and consistent
with the Borough Code[1] and other applicable laws.

A.
The Recreation Board shall review, study, prepare and recommend to
Council for adoption, action or other disposition by Council:
(1)
Plans and programs for equipping, maintaining and improving the parks,
playgrounds and other recreation facilities owned or operated by the
Borough;
(2)
Plans for operating, regulating and supervising the parks, playgrounds
and other recreation facilities owned or operated by the Borough;
(3)
Recreation programs suited to the interests of the residents of the
Borough and appropriate in light of the facilities available and the
appropriations budgeted by Council;
(4)
Policies and procedures for the use of the parks, playgrounds and
other recreation facilities owned or operated by the Borough; and
policies and procedures for the conduct of, and participation in,
recreation programs;
(5)
Rules and regulations for the conduct and behavior and the protection
of persons and property at the recreation programs and recreation
facilities of the Borough;
(6)
Personnel policies governing the duties and responsibilities and
the salaries and other benefits of the personnel employed in the Parks
and Recreation Department;
(7)
The names and qualifications of individuals recommended for employment
in the Parks and Recreation Department in such capacities as recreation
directors, pool managers, lifeguards, playground supervisors, program
leaders, and the like; and
(8)
Such other plans, programs, policies, procedures, rules, regulations
or reports as are related to matters expressly or impliedly within
the purview of the Recreation Board or as are related to tasks or
projects assigned to the Recreation Board by Council.
B.
The Recreation Board shall promote interest in and public understanding
of the recreation programs and recreation facilities of the Borough
and the advantages and benefits to be derived therefrom.
C.
The Recreation Board shall assist and cooperate with other municipalities,
governmental agencies, civic organizations and the like in studying
and developing the recreation potential of the area and in coordinating
the use and enjoyment of the recreation programs and recreation facilities
available in the area.
D.
The Recreation Board shall perform such other functions and tasks
and undertake such projects as are assigned to it from time to time
by Council.
A.
With the approval of Council, the Recreation Board may accept and
use such funds, personnel, equipment, real estate, or other assistance
which may be made available by another municipality, the Mifflin County
School District, the county, the commonwealth or the federal government
or any of its or their agencies or made available by civic organizations
or other private sources.
B.
The powers of the Recreation Board shall be those powers granted
from time to time by Council with respect to administrative, business
or proprietary matters.
C.
The Recreation Board shall have the authority to form an Events Committee
from its members, together with other residents of the Borough recommended
by it to Borough Council and approved by Borough Council, as follows:

(1)
The purpose of the Events Committee is to organize and/or promote
special events and/or activities for utilization of the Borough's
parks, playgrounds and other recreation facilities owned or operated
by the Borough, in coordination with and with the express approval
of the Recreation Board.
(2)
The Events Committee shall be composed of five members, at least
one of whom shall be a member of the Recreation Board, who shall be
residents of and registered electors within the Borough of Lewistown,
who are citizens of the Commonwealth of Pennsylvania and who are at
least 18 years of age.
(3)
The Events Committee shall be established annually at the first regular
meeting of the Recreation Board or at such time thereafter as determined
by the Recreation Board. The members thereof shall serve for the calendar
year. If a vacancy occurs by death, by resignation or by removal from
the Committee by the Recreation Board, as approved by Borough Council,
the Recreation Board, subject to approval of Borough Council, shall
appoint a resident and registered elector of the Borough to hold such
Committee membership for the remainder of the term vacated due to
death, by resignation or by removal from the Committee by the Recreation
Board with approval Borough Council.
(4)
Members of the Events Committee who are not members of the Recreation Board shall be approved by Borough Council prior to serving on the Events Committee. Furthermore, a member of the Events Committee shall not be a member of any board, commission, bureau or agency referred to in § 55-2, above, as being ineligible to serve as a member of the Recreation Board.
(5)
Members of the Events Committee shall serve at the pleasure of Recreation
Board and may be removed from the Events Committee by the Recreation
Board upon recommendation for removal by the Recreation Board to Borough
Council and approval thereof by Borough Council.
(6)
Members of the Events Committee shall serve without compensation.
(7)
Upon the annual organization of the Events Committee, the membership
of the Events Committee shall appoint a Chairman and Secretary who
shall serve at the pleasure of the membership of the Events Committee
for the year or until his/her successor is appointed.
(8)
Meetings of the Events Committee shall be subject to the Sunshine
Act, 65 Pa.C.S.A. § 701 et seq., as it may be amended and
revised, and any successor law. Meetings shall be held as necessary,
but no less than quarterly.
(9)
Public records of the Events Committee shall be subject to the Right-to-Know
Law, 65 P.S. § 67.101 et seq., as it may be amended and
revised, and any successor law.
The Recreation Board shall make such periodic reports to Council
of the activities, business and actions of the Recreation Board as
the Board may deem timely or appropriate or as Council may direct.
