This chapter shall be known and may be cited as the "Borough Trailer Camp and Trailer Court Regulations Ordinance." This chapter shall be considered as auxiliary to Chapter 240, Zoning; Chapter 125, Flood Damage Protection; Chapter 220, Subdivision and Land Development; and Chapter 110, Article I, Building, Plumbing, Electrical and Property Maintenance Codes.

The following definitions shall apply in the interpretation of this chapter:
DEPARTMENT
The Building Codes, Property Codes and Zoning Code Department of the Borough or a Department officer.
OWNER and PERSON
Shall have the meanings respectively ascribed to them by Chapter 110, Article I, Building, Plumbing, Electrical and Property Maintenance Codes.
TRAILER, DEPENDENT TRAILER, HOUSE TRAILER or MOBILE HOMES, TRAILER CAMP, TRAILER COURT or MOBILE HOME PARK and HOUSE TRAILER LOT or MOBILE HOME LOT
These terms shall have the meanings respectively ascribed to them in Chapter 240, Zoning.

A. 
License. It shall be unlawful for any person to establish, maintain, operate or permit to be established, maintained or operated any trailer court, trailer camp or mobile home park within the limits of the Borough of Lewistown without having first secured a license therefor from the Building Codes, Property Codes and Zoning Code Department. The license fee shall be adopted by separate resolution by the Borough Council of the Borough of Lewistown, and such may be amended from time to time by the Borough of Lewistown. All licenses shall be effective as of July 1 of each year and shall expire on June 30 of the following year. All licenses shall be subject to renewal, and the application for renewal shall be submitted at least one month before the license expires on June 30.
B. 
Inspection. The Building Codes, Property Codes and Zoning Code Department shall inspect all trailer camps, trailer courts or mobile home parks prior to issuing a license therefor in order to ensure compliance with the provisions of the Borough ordinances referred to in § 148-1. In the event that the Department shall find that the trailer camp, trailer court or mobile home park is not in compliance with the provisions of those ordinances, the Department shall refuse to grant a license until compliance is achieved.
C. 
Applications for licenses. All applications for licenses shall be filed in the Building Codes, Property Codes and Zoning Code Department, shall be in writing signed by the owner on a form to be provided by the Department, and shall contain the following information:
(1) 
The name and business address of the applicant, and the name and residence address of each manager and each proprietor, partner, officer or the like of the applicant.
(2) 
The location and legal description of the property where the trailer camp, trailer court or mobile home park is located.
(3) 
A complete plan and description of the trailer camp, trailer court or mobile home park, setting forth: the locations and dimensions of each tent or trailer site in the trailer camp or each house trailer lot or mobile home lot in the trailer court or mobile home park; the location of all streets, service roads, driveways and on-site or on-lot parking spaces in the camp, court or park; the lines, facilities and other equipment for water service, sanitary sewer service, electric service, telephone service, natural gas service, and roof water and surface water runoff; the locations and dimensions of all accessory buildings and service buildings; the equipment for firefighting; the flood evacuation plan, if such a plan is required by Chapter 125, Flood Damage Protection; and the plan or method for refuse collection.
(4) 
The place on the premises where the register referred to in § 148-4 is kept.
(5) 
Such other information as may be required by the Department so as to enable it to determine whether the trailer camp, trailer court or mobile home park complies with the requirements of this chapter and the ordinances and codes to which this part is auxiliary.

A. 
Every trailer camp and every trailer court or mobile home park shall maintain on the premises a register containing the following information:
(1) 
The name and permanent address of all occupants in the trailer camp or the trailer court or mobile home park;
(2) 
The year, make, model and vehicle license number of each dependent trailer, house trailer or mobile home;
(3) 
The date of arrival and departure of each trailer or mobile home; and
(4) 
The site or lot number on which each trailer or mobile home is placed.
B. 
The Borough shall have the right to inspect the register at any time.

Each licensee shall adhere to the following regulations at all times:
A. 
He shall maintain the trailer camp, trailer court or mobile home court or park in a clean, orderly and sanitary manner.
B. 
He shall see that no disorderly conduct or violation of any law or ordinance is committed upon the premises and shall immediately report to the proper authorities any violations which shall come to his attention.
C. 
He shall immediately report to the Borough Manager or the Department all cases of persons or animals having or suspected of having any communicable disease.
D. 
He shall prohibit the use of any trailer or mobile home by any greater number than it was designed to occupy.
E. 
He shall prohibit the lighting of any open fires upon the premises.

The Building Codes, Property Codes and Zoning Code Department shall have the right to revoke a license if the licensee fails to comply with any of the provisions or standards of this chapter or any ordinance or code to which this chapter is auxiliary or if there has been any false statement or misrepresentation as to a material fact in the application on which the license was based.

Whenever the ownership or management of any trailer camp, trailer court or mobile home court shall have been changed, the new owner or manager thereof shall, within five days from the date of such transfer, notify the Building Codes, Property Codes and Zoning Code Department, which shall amend the license for such trailer camp, trailer court or mobile home court as well as the records of the Borough relating to such change. No license issued under this chapter shall be transferable to a different location.

Any person aggrieved by any order, requirement or decision made by the Building Codes, Property Codes and Zoning Code Department may file an appeal with the Zoning Hearing Board or the Board of Building Appeals. The types of appeals over which the Zoning Hearing Board shall have jurisdiction and the types of appeals over which the Board of Building Appeals shall have jurisdiction, and the procedure for filing an appeal, the amount of the filing fee, and the respective duties, functions, powers and authority of the Zoning Hearing Board and the Board of Building Appeals, shall be as set forth for those respective boards in Chapter 10, Building Appeals Board, and Chapter 70, Zoning Hearing Board.
All mobile home courts, parks and communities which shall be in operation prior to the effective date of this chapter and having lot areas of less than 2,400 square feet per stand for mobile homes shall reduce the number of stands in use so as to provide a minimum lot area for each stand of 2,400 square feet.

The Building Codes, Property Codes and Zoning Code Department is hereby charged with the administration and enforcement of the provisions of this chapter, and the Department is hereby authorized and empowered to prescribe, adopt, promulgate and enforce rules and regulations relating to any matter pertaining to the administration or the enforcement of this chapter; provided, however, that such rules and regulations shall not become effective until the same are approved by Council.

Any person who shall fail, neglect or refuse to comply with any provision of this chapter or of any regulation or requirement pursuant thereto and authorized thereby, or who shall knowingly make any incomplete, false or fraudulent application thereunder, shall be guilty of a violation and, for each and every such violation, upon conviction thereof, shall be sentenced to pay a fine of not more than $300 and/or to imprisonment for not more than 90 days, provided that each day's neglect to comply with any provision shall be considered a new violation thereof and subject in all respects to the same penalty as is hereby provided, and a separate proceeding may be instituted and a separate fine imposed for each offense committed after the first conviction.
