Pursuant to Section 11 of the Uniform Fire Safety Act (P.L. 1983, c. 383),[1] the New Jersey Uniform Fire Code shall be locally enforced in the Borough of North Haledon.

The Fire Prevention Code shall be enforced by the North Haledon Fire Prevention Bureau, which is hereby created. The North Haledon Fire Prevention Bureau shall consist of:
A. 
A Fire Official certified by the New Jersey Division of Fire Safety; and
B. 
A minimum of one Fire Inspector certified by the New Jersey Division of Fire Safety.

The Bureau of Fire Prevention shall perform such duties as are provided in the Fire Prevention Code. The Bureau of Fire Prevention shall from time to time appoint inspectors who shall be certified by the State of New Jersey Division of Fire Safety.
The local enforcement agency shall enforce the Uniform Fire Safety Act and the codes and regulations adopted under it in all buildings, structures and premises within the established boundaries of the Borough of North Haledon, other than owner-occupied one- and two-family dwellings, and shall faithfully comply with the requirements of the Uniform Fire Safety Act and the Uniform Fire Code.

A. 
The Borough of North Haledon Fire Prevention Bureau shall enforce the Uniform Fire Code of the State of New Jersey in the following manner:
(1) 
Life-hazard uses. The Borough of North Haledon Fire Prevention Bureau shall carry out the periodic inspections of life-hazard uses required by the Uniform Fire Code of the State of New Jersey.
(2) 
Non-life-hazard uses. The Borough of North Haledon Fire Prevention Bureau shall carry out a yearly inspection of all non-life-hazard uses.
B. 
The fees for such inspection shall be prescribed by Chapter 275 of the Code of the Borough of North Haledon.

The Borough of North Haledon Fire Prevention Bureau shall be under the direct supervision and control of the Fire Official, who shall report to the Mayor and Council.

A. 
Appointment of Fire Official. The Fire Official shall be certified by the State of New Jersey Division of Fire Safety and appointed annually by the Mayor and Council.
B. 
Appointment of Fire Inspector. The Fire Inspector(s) shall be certified by the State of New Jersey Division of Fire Safety and appointed annually by the Mayor and Council upon the recommendation of the Fire Official.
C. 
Terms of office. The terms of office for the Fire Official and Fire Inspector(s) shall be one year.
D. 
Removal from office. The Fire Official, Fire Inspector(s) or any other employee of the North Haledon Fire Prevention Bureau shall be subject to removal by the governing body for cause. Prior to being removed from office, the Fire Official, Fire Inspector(s) or any other employee of the North Haledon Fire Prevention Bureau, as the case may be, shall be afforded an opportunity to be heard by the governing body or a hearing officer designated by the governing body. In the event the governing body designates a hearing officer, said hearing officer shall make a written recommendation to the governing body.

Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act,[1] any person aggrieved by any order of the North Haledon Fire Prevention Bureau shall have the right to appeal to the Construction Board of Appeals of the County of Passaic.

In addition to the inspection and fees required pursuant to the Act and the regulations of the Department of Community Affairs, the following additional inspections and fees shall be required:
A. 
The permit fees established by the Uniform Fire Code shall be amended to be as provided in Chapter 275, Fees.
B. 
Multiple-family dwellings of three families or more shall be as provided in Chapter 275, Fees, for annual inspections, inclusive of all common areas of the structure.
C. 
Structures that do not qualify as a life-hazard use shall be as provided in Chapter 275, Fees.

Fees shall be paid directly to the Borough of North Haledon within 14 calendar days of inspection of the structure.

A certificate of inspection shall be issued upon receipt of the inspection fee. Failure to pay the required fee on time will result in an assessed penalty equal to the amount of the unpaid fee. These fees shall be assessed to the building owner as listed on the tax rolls of the Borough of North Haledon.

A. 
For purposes of this section, the term "building" includes all buildings, structures and premises within the Borough of North Haledon, with the exception of detached one- and two-family dwellings used exclusively for dwelling purposes.
B. 
No propane cooking equipment or open burning equipment shall be stored or used on any balcony, deck or similar portion of a building or under any building overhang.
C. 
No outdoor cooking equipment shall be used within any room or space or a building.
D. 
There shall be no storage of propane or other container-stored fuel on any porch, balcony, deck or other similar portion of a building, within any room or space of a building.
E. 
Approved equipment shall be placed a minimum of five feet vertically or horizontally from any exterior combustible wall.
F. 
Penalty for violation. Any person, firm, or corporation violating any section of the code, or failing to comply with any order issued pursuant to any section thereof, upon conviction thereof, shall be punishable as provided in Chapter 1, General Provisions, Article II, General Penalty.[1]
