GENERAL REFERENCES
Emergency services — See Ch. 29.
There is hereby established an executive department of the municipal
government of the City of Mendota, which shall be known as the "Police
Department," and which shall embrace the Chief of Police and such
number of policemen as the Council may, by resolution, determine.
A.
Term. The Chief of Police shall be Chief of the Police Department,
and shall hold his office for the term of one year, unless otherwise
removed, and until his successor shall be appointed and qualified.
B.
Appointment. The Chief of Police shall be appointed by the Mayor,
by and with the advice and consent of the Council, on the first Monday
in May after each general City election, or as soon thereafter as
practicable.
C.
Discharge of duties. The Chief of Police shall devote his entire
time and energy to the discharge of the duties of his office. He shall
wear a badge or star on which shall be inscribed "Chief of Police,"
and he shall see that the laws and ordinances of the City are enforced
as far as possible by himself and the force under his command, and
that all offenders are reported to some proper tribunal for punishment.
D.
Control of police force; absence. The Chief of Police shall be the
commanding officer of the police force of the City, subject to the
Mayor and the rules and regulations prescribed by the Council. The
Chief shall in no case absent himself from the City without notifying
the Mayor of his intended absence where practicable.
E.
Serving process in City. The Chief of Police shall have power and
authority, within the corporate limits of the City, to serve and execute
warrants and other legal process for the apprehension and commitment
of persons charged with or held for the commission of any crime or
misdemeanor, or the violation of any law or ordinance of the City,
and while serving or executing, or assisting in the service or execution
of, any such warrant or legal process, he shall be vested with all
the common law and statutory powers of constables for such purpose.
F.
Serving process outside the City. The Chief of Police shall also
have power and authority to execute City warrants, or other legal
process, outside the corporate limits of the City, and within such
distance therefrom as is authorized by law, in all cases when any
ordinance of the City, made pursuant to law, shall prescribe a penalty
for the violation of any of its provisions by persons residing or
doing business outside the limits of the City.
G.
Bystander assistance. The Chief of Police may, at any time, call
upon any able-bodied person, above the age of 18 years, to aid him
in arresting, retaking or holding in custody any person guilty of
having committed any unlawful act, or charged therewith, or to aid
such officer in preventing the commission of any unlawful act.
H.
Attend meetings of Council. The Chief of Police shall attend, in
person, all meetings of the Council, execute all its orders, and all
warrants or other legal process required to be executed by him under
any ordinance of the City.
I.
Police record. The Chief of Police shall keep, or cause to be kept,
books of record of the Police Department, and of all persons arrested
or committed by the police, showing the time, the magistrate or court
before whom such person was tried and the disposition of each case.
J.
Monthly reports. The Chief of Police shall, on the first Monday in
each month, make a written report to the Council, showing the number
of arrests made by the police force during the preceding month, the
name of each person arrested, the policeman making the arrest, the
offense charged, the magistrate or court before whom tried, the disposition
of the case, the amount of fine imposed, if any, and the amount of
such fine collected.
K.
Care of property. The Chief of Police shall have the care, custody
and control of all books, records, equipment and other property belonging
to the Police Department, and of all stolen goods seized and retained
by police authority. Upon the expiration of his term of office or
his resignation or removal therefrom, he shall, on demand, surrender
to his successor in office all books, records, equipment and property
in his possession belonging to the City, or appertaining to said office.

A.
Term.
The Deputy Chief of Police shall hold his office for the term of one
year, unless otherwise removed, and until his successor shall be appointed
and qualified.
B.
Appointment.
The Deputy Chief of Police shall be appointed by the Mayor, by and
with the advice and consent of Council, on the first Monday in May
after each general City election, or as soon as thereafter practicable.
C.
Discharge
of duties. The Deputy Chief of Police will assist the Chief of Police
with the supervision, planning, coordination, and administration of
the Police Department and day-to-day operations. The Deputy Chief
of Police shall also perform other duties as prescribed by law or
ordinance, contained in his position description, and as assigned
by the Chief of Police.
D.
The Deputy
Chief of Police shall be an exempt employee.
E.
The Deputy
Chief may be appointed from any rank of sworn, full-time officers
of the Mendota Police Department, but shall have at least five years
of full-time services as a police officer in the Department.
F.
If removed
from the position, officer will revert to the rank and seniority status
held before appointment.
There is hereby created in the Police Department of the City
of Mendota the position of Police Lieutenant. Said Lieutenant's position
shall be filled by the Board of Police and Fire Commissioners of the
City of Mendota on the basis of ascertained merit, seniority, service
and examination. Such examinations for promotion shall be competitive
among such members of the next rank as desire to submit themselves
to examination. The Board of Fire and Police Commissioners are hereby
authorized to conduct said examination for the office of Police Lieutenant
pursuant to the provisions of 65 ILCS 5/10-2.1-15 et seq.
There is hereby created in the Police Department of the City
of Mendota the position of Police Sergeant. Said Sergeant's position
shall be filled by the Board of Police and Fire Commissioners of the
City of Mendota on the basis of ascertained merit, seniority, service
and examination. Such examinations for promotion shall be competitive
among such members of the next rank as desire to submit themselves
to examination. The Board of Fire and Police Commissioners are hereby
authorized to conduct said examination for the office of Police Sergeant
pursuant to the provisions of 65 ILCS 5/10-2.1-15 et seq.
A.
Appointment; oath; bond. Whenever the Mayor shall deem it necessary
to establish a temporary night watchman, or temporarily to increase
the number of watchmen or policemen, he may appoint, in writing, under
the corporate seal, a suitable number of reputable and discreet citizens
of the City as temporary watchmen or policemen, whose powers, duties,
and liabilities shall be the same as other watchmen and policemen,
and who shall be under the same oath and shall be required to execute
bond to the City in like manner. The Mayor shall report all such temporary
appointments to the Council at its next regular meeting, and the Council
may continue or discontinue the same in its discretion, and the person
or persons so appointed shall receive such reasonable compensation
as may be fixed by the Council.
B.
Special police for corporations. The Mayor and Council may, on application
being made to them, appoint any suitable person in the employ of any
corporation, association or firm as a special policeman in and for
the City; or they may, if they deem proper, appoint any person employed
in any other branch of the City service to be such special policeman.
Special policemen shall have all the qualifications required in the
case of regular policemen; they shall take and subscribe the same
oath, give like bond, exercise the same powers, and be subject to
the rules and regulations of the Police Department, so far as the
same are applicable to them; provided, however, that such special
policemen shall receive no pay from the City for their service. The
special policemen shall be provided with stars by the person, firm,
association or corporation asking their appointment, on which shall
be inscribed "Special Police."
There shall be a police pension fund established in the City
of Mendota, as provided by Chapter 40, Act 5, Article 3, of the Illinois
Compiled Statutes (40 ILCS 5/3-101 et seq.).
A.
Any police officers initially employed by the City of Mendota on
or after September 6, 1988, who receive police training at the City's
expense shall reimburse the City for all of said training costs if
said officers leave the City's employ within two years of completion
of said training. This reimbursement shall apply to the initial police
training paid for by the City for newly employed officers.
B.
Every newly employed police officer shall be required to enter into
an agreement with the City consenting to said terms of employment
at the time of said officer's initial employment.
C.
Said reimbursement shall be made within 60 days of termination of
employment.
A.
Any group, organization, private person or any other entity requesting
the City of Mendota to provide contractual police services for special
events or occasions, which will require police officers to be on duty
for extended periods of time, shall pay to the City for the providing
of police contractual services a rate established by the Chief of
Police and Public Safety Committee.[1]
B.
An agreement for providing of police services shall be entered into
between the City of Mendota and the group, organization, person, or
other entity requesting said contractual services, and any compensation
shall be paid directly to the City of Mendota.

A.
Employment. The City of Mendota may employ part-time police officers
from time to time as it deems necessary.
B.
Duties. A part-time police officer shall have all the responsibilities
of a full-time police officer and such specific duties as delineated
in the general orders/policies/regulations of the Mendota Police Department,
but the number of hours a part-time officer may work within a calendar
year is restricted. Part-time police officers shall not be assigned
to supervise or direct full-time police officers. Part-time police
officers shall be trained in accordance with the Illinois Police Training
Act (50 ILCS 705/1 et seq.) and the rules and requirements of the
Illinois Law Enforcement Training Standards Board (ILETSB).
C.
Hiring standards. Any person employed as a part-time police officer
must meet the following standards:
(1)
Be of good moral character, of temperate habits, of sound health,
and physically and mentally able to perform assigned duties.
(2)
Be at least 21 years of age.
(3)
Pass a medical examination.
(4)
Possess a high school diploma or GED certificate.
(5)
Possess a valid State of Illinois driver's license.
(6)
Possess no prior felony convictions.
(7)
Any individual who has served in the United States military must
have been honorably discharged.
D.
Discipline. Part-time officers shall be under the disciplinary jurisdiction
of the Chief of Police. Part-time police officers serve at the discretion
of the City of Mendota authorities and shall not have any property
rights in said employment, and may be removed by the City of Mendota
authorities at any time. Part-time police officers shall comply with
all applicable rules and general orders/policies issued by the Mendota
Police Department.
