A. 
The Board of Aldermen of the City of Plattsburg, Missouri, shall appoint a Chief of Police who shall perform all duties required of the Marshal by law, and shall appoint any other Police Officers found by the Board of Aldermen to be necessary for the good of the government of the City of Plattsburg, all as provided by Section 79.050 of the Revised Statutes of the State of Missouri.
B. 
The compensation to be paid such Chief of Police and additional Police Officers shall be determined by ordinance by the Board of Aldermen.

The Chief of Police shall be the conservator of the peace, and shall be active and vigilant in the preservation of good order within the City.

Before entering on the discharge of his duties, the Chief of Police shall execute to the City a bond in such sum as shall be prescribed by the Board of Aldermen, conditioned that he will faithfully discharge the duties of his office, and account for all money and other property belonging to the City that shall come into his hands by virtue of his office.
The Board of Aldermen shall appoint such Policemen as may be deemed expedient.

The Chief of Police shall have the power to serve all warrants, subpoenas, writs, and other legal process.

The Chief of Police shall have power to make arrests without process in all cases in which any offense against the ordinances of this City or the laws of the State of Missouri shall be committed in his presence. He shall have power, at all times, to make or order an arrest, with proper process for any offense against the City ordinances of the laws of the State of Missouri.

It shall be the duty of the Chief of Police as well as all other Police Officers, to see that all the laws and ordinances of the City are duly enforced, and without warrant to arrest forthwith and bring before the Judge any person who, in the presence of such Officers, shall commit any offense against any law of the City or of the State, and to promptly execute all warrants and other processes put in their hands for service, and to perform such other duties incident to the office as may be required by law or the ordinances of the City.

It shall be the duty of the Chief of Police to see that all persons pursuing any calling or business in the City for which a license is required take out such license, and he shall diligently prosecute all persons for failure to take out such license or pay the amount thereof.

The Chief of Police and all other Police Officers, shall, at all times, be diligent in preventing the obstruction of any and all sidewalks and streets in the City, and particularly in the business portion thereof, and not allow any crowd or assemblage or persons to obstruct such street or sidewalk by gathering together, either on the corners of the street or elsewhere thereon, so as to prevent or discommode persons in traveling the same. When the Chief of Police or any Policeman shall command any such crowd or assemblage to disperse, and any one or more of them shall fail to do so, he or they shall be immediately arrested by such Officer and taken before the Judge, where, upon conviction, such person shall be fined not less than two dollars ($2.00).

The Chief of Police and Policemen of the City shall, at all times, be active and vigilant in the preservation of good order within the City; shall suppress all riots and breaches of the peace; shall diligently inquire into all violations of the ordinances of the City, and cause the persons guilty of such violations to be prosecuted before the proper authorities.

The Chief of Police or any Policeman may receive and accept a good and sufficient bond of any person arrested by him.

The Chief of Police shall have power to detain any person duly arrested in a proper place to prevent his escape until a trial can be had before the proper Officer, unless such person shall give a good and sufficient bond for his appearance for trial.

The Chief of Police shall attend the elections in the City and shall perform such duties as are enjoined on him by the law under the direction of the election judges.

The Mayor and the Board of Aldermen shall have the authority to delegate any authority as to the Police Department of said City to any duly authorized governing body by ordinance and through that body delegate any powers consistent with that of the Chief of Police to any Police Officer duly appointed by the designated body.

A. 
Any duly elected or appointed Law Enforcement Officer of the City of Plattsburg, Missouri, may enter upon public private property to investigate suspected criminal activities or to apprehend persons suspected of committing a crime under the ordinances of the City of Plattsburg, Missouri, provided however, that the said public private property shall be open and no destruction of private property shall be necessary for the said Law Enforcement Officer to enter thereupon.
B. 
"Public Private Property" shall be that property which is held open to the public and at the hours and time that said property is generally held open to the public and all other public property that is open and without physical boundaries or restrictions and the movement to and upon is free from boundary line obstructions. Private areas not open to the public shall not be considered "Public Private Property".

A. 
The City hereby adopts and will enforce this policy prohibiting the use of excessive force by law enforcement agencies within its jurisdiction against any individual engaged in non-violent civil rights demonstrations. The City also prohibits the physical barring of any entrance or exit to such a facility and will enforce all applicable State laws in this regard.
B. 
Penalty.
1. 
Any person charged with a violation of any provision of this Section will be served by the City with written notice stating the nature of the violation.
2. 
Any person convicted of this violation shall be guilty of a misdemeanor, and shall be fined an amount not to exceed one hundred dollars ($100.00) for each violation. Each day on which such violation occurs shall be deemed to be a separate offense.
3. 
Any person violating any of the provisions of this Section shall become liable to the City for any expense, loss, or damage occasioned the City by reason of such violation.

A. 
No person shall hold a commission as a Police Officer without a valid Peace Officer license as defined in Chapter 590, RSMo.
B. 
Persons holding a commission as a Police Officer shall maintain required continuing education standards as established by the Missouri Peace Officers Standards and Training (POST) Commission.
