A.
General
Municipal Law § 103(1) allows political subdivisions to
award certain purchase contracts on the basis of best value, as defined
in State Finance Law § 163, to a responsive and responsible
bidder or offeror, provided that the use of best value for awarding
purchase contracts is authorized by local law. The purpose of this
article is to authorize the Village of Southampton to award such purchase
contracts on the basis of best value.
B.
"Best
value" is defined in State Finance Law § 163 as a basis
for awarding contracts to the offeror which optimizes quality, cost
and efficiency, reflecting, wherever possible, objective and quantifiable
analysis. Such basis may also identify a quantitative factor for offerors
that are small businesses or certified minority- or women-owned business
enterprises as defined in Executive Law § 310.
The Village of Southampton is hereby authorized to award purchase
contracts (including contracts for service work, but excluding any
purchase contracts necessary for the completion of a public works
contract pursuant to Article 8 of the Labor Law) on the basis of best
value, as defined in State Finance Law § 163, to a responsive
and responsible bidder or offeror, in the manner provided by General
Municipal Law § 103.
