[HISTORY: Adopted by the Board of Trustees of the Village of Southampton 4-10-2014 by L.L. No. 3-2014. Amendments noted where applicable.]
The Town of Southampton (hereinafter referred to as the Town) is the owner of various historic burial grounds, including certain historic burial grounds situate within the Village of Southampton (hereinafter referred to as the Village). The Town has enacted regulations which prohibit certain acts on Town-owned historic burial grounds, such regulations being set forth in § 111-2.1 of the Town Code. The Town has requested that the Village enact regulations which prohibit such acts on Town-owned historic burial grounds situate within the Village, so that violations of the Town's regulations with respect to Town-owned historic burial grounds situate within the Village may be enforced as violations of the Village Code. The purpose of this chapter is to accomplish the foregoing.
As used in this chapter, the following terms shall have the meanings indicated:
TOWN-OWNED HISTORIC BURIAL GROUNDS
Includes all historic cemeteries, burial grounds and abandoned cemeteries owned by the Town of Southampton situate within the Village of Southampton.
The following shall be prohibited on Town-owned historic burial grounds:
A. 
Defacement; damage; graffiti. No person shall deface, destroy or damage in any manner nor place graffiti on any structure, roadway, sign, building or gravestone located on a Town-owned historic burial ground.
B. 
Glass objects, litter, refuse and injurious substances. No person shall throw, break, or deposit a glass object, litter or refuse, including household waste, or any injurious substance of any nature on any Town-owned historic burial ground or upon any parking area, roadway or pathway thereof.
C. 
Animals. Dogs or other domestic animals shall not be allowed on Town-owned historic burial grounds.
D. 
Prohibited recreational use: No person shall use Town-owned historic burial grounds for recreational uses, including but not limited to games such as football, soccer, baseball, kickball, frisbee and softball; Halloween walks; gravestone rubbing; or any other recreational use that may injure or damage historic grave sites and/or stones.
E. 
Hours. No person shall enter Town-owned historic burial grounds for any purpose between the hours of 8:00 p.m. and 6:00 a.m.
A. 
In the event that the Code of the Town of Southampton is hereafter amended so as to repeal any prohibited act incorporated in § 66-3 above, such prohibited act shall automatically be deleted from § 66-3 above.
B. 
In the event that the Code of the Town of Southampton is hereafter amended so as to modify any prohibited act incorporated in § 66-3 above, such prohibited act shall automatically be deleted from § 66-3 above. The Village Board of Trustees may by resolution incorporate the modified prohibited act in § 66-3 above.
C. 
In the event that the Code of the Town of Southampton is hereafter amended so as to add any new or additional prohibited act with respect to historic burial grounds, the Village Board of Trustees may by resolution incorporate such new or additional prohibited act in § 66-3 above.

Any person who violates this chapter or fails to comply with any of its requirements shall, upon conviction thereof, be subject to the penalties provided in Article II of Chapter 1 of the Code of the Village of Southampton.
