The purpose of this Chapter is to provide rules and regulations for the use of and conduct in the parks and recreation areas of the City.

This Chapter shall apply in all parks and recreation areas under the jurisdiction of the City unless expressly exempted.

Any requirement or prohibitions of any act shall respectively extend to and include the causing and procuring, directly or indirectly, of such act.

No provision hereof shall make unlawful any act necessarily performed by any officer or employee of the City in the line of duty or work.

Any act otherwise prohibited by law or local ordinance shall be lawful if performed under by virtue of and strictly within the provisions of a permit so to do and to the extent authorized thereby.

A. 
It shall be unlawful for any person in a public park or recreation area to:
1. 
Mark, deface, disfigure, injure, tamper with or displace or remove any buildings, bridges, tables, benches, fireplaces, railings, pavings or paving materials, water lines or other public utilities or parts or appurtenances thereof, signs, notices or placards, whether temporary or permanent, monuments, stakes posts or other boundary markers or other structures or equipment, facilities or park property or appurtenances whatsoever, either real or personal.
2. 
Fail to cooperate in maintaining rest rooms and washrooms in a neat and sanitary condition.
3. 
Dig or remove any soil, rock, sand, stones, trees, shrubs or plants or other wood or materials or make any excavation by tool, equipment, blasting or other means or agency.
4. 
Construct or erect any building or structure of whatever kind, whether permanent or temporary, or run or string any public service utility into, upon or across such lands, except on special written permit issued hereunder.
5. 
Damage, cut, carve, mark, transplant or remove any plant or injure the bark or pick flowers or seed of any tree or plant, dig in or otherwise disturb grass areas or in any other way injure the natural beauty or usefulness of any area.
6. 
Throw, discharge or otherwise place or cause to be placed in the waters of any fountains, pond, lake, stream or other body of water in or adjacent to any park or any tributary, stream, storm sewer or drain flowing into such water any substance, matter or thing, liquid or solid, which will or may result in the pollution of said waters.
7. 
Take into, carry through or put into any park any rubbish, refuse, garbage or other material. Such refuse and rubbish shall be deposited in receptacles so provided. Where receptacles are not provided, all such rubbish or waste shall be carried away from the park by the person responsible for its presence and properly disposed of elsewhere.
8. 
Hunt, molest, harm, frighten, kill, trap, pursue, chase, tease, shoot or throw missiles at any animal, wildlife, reptile or bird; nor shall anyone remove or have in his/her possession the young of any wild animal or the eggs or nest or young of any reptile or bird.
9. 
Ride a horse except on designated trails and roadways.
10. 
Disregard a posted age limit sign on any swings or playground equipment.

A. 
It shall be unlawful for any person in a public park or recreation area to:
1. 
Drive any vehicle on any area except the paved park roads or parking areas or such areas as may on occasion be specifically designated as temporary areas.
2. 
Park a vehicle anywhere except on a designated parking area.
3. 
Leave a vehicle standing or parked in established parking areas or elsewhere in the park and recreation areas during hours when the park and recreation area is closed.

A. 
Park hours are from thirty (30) minutes prior to the official sunrise until thirty (30) minutes after official sunset unless the park is being used for a preapproved rental or by special permission of the Board of Aldermen.

B. 
The Mayor or City Administrator may close any park, or a portion of a park, whenever it is in the best interests of the City to do so. The park will remain closed until the Mayor or City Administrator deems the situation in the park has been satisfactorily resolved.
C. 
Lighted sports fields and courts, including basketball, baseball, soccer and tennis may be in use until 11:00 P.M., provided they are used for their intended purpose.

The City Police Department and employees of the Parks and Recreation Department diligently enforce the provisions of this Chapter. They and the City Administrator shall have authority to order any person or persons acting in violation of this Chapter to leave the park or recreation area.

A. 
The City of Eldon sports fields and other park facilities (pavilions and softball/baseball and soccer fields) are available for reservation by the public when not otherwise scheduled.
1. 
Reservations.
a. 
Reservation Procedures.
(1) 
Reservations for park facilities may be made throughout the year based on availability. The Parks and Recreation Department must approve all reservations.
(2) 
Reservations shall be made by submitting a park use application for permit prior to the event.
(3) 
Reservations requested the day of the event may be taken at the discretion of the Parks and Recreation Department.
(4) 
Field reservations include field preparation and field lights as needed. Renters prepare the field between games.
(5) 
The City staff will work the concession stand. No vendors will be allowed.
b. 
Inclement Weather. The City's Parks and Recreation Department will determine field playability. In the event inclement weather occurs after the Parks and Recreation Department's business hours, the applicant will be responsible for determining if the event occurs or is canceled.
(1) 
If an event is canceled prior to starting due to inclement weather, user fees will be reimbursed in full.
(2) 
If an event is shortened due to inclement weather, user fees will be charged based on time used.
2. 
User Fees.
a. 
The Eldon City Parks Fee Schedule shall be substantially the same in form and content as set forth below:

Failure to clean the rented area on a repeated basis will result in being denied future privileges.

If there is any damage to the facility it will be handled on a case by case basis between the City and the renter.

b. 
Payments And Deposits.
(1) 
Park user fees shall be paid prior to the event. The City reserves the right to request a non-refundable security deposit if deemed necessary by the City.
(2) 
Other applicable fees determined to be owed by the applicant at the conclusion of the event may be invoiced and paid within ten (10) days from the event date, if agreed to by the City.
c. 
Modifications And Refunds.
(1) 
Applicants may cancel reservations no less than forty-eight (48) hours prior to the reserved date to receive a full refund; otherwise, no refund or credit will be given.
(2) 
Applicants may modify reservations forty-eight (48) hours prior to the reserved date to receive any refund or credit due. Any additional user fees due to the City shall be paid at the time of modification. The Parks and Recreation Department must approve all modifications.
(3) 
The City reserves the right to postpone, cancel or delay any activity on City property.
d. 
Use Terms Of Agreement.
(1) 
Reservations are only for the designated area/facility permitted and limited to the activity listed. Use of other areas/facilities not listed on the permit may result in user fees assessed and may be grounds for immediate removal from City property.
(2) 
Admission fees shall not be charged to the general public to any City facility for any event without prior approval from the City.
(3) 
It is unlawful for any material such as sand, dirt or other substances to be added or taken off any sports fields at any time. All sports field preparation shall be done by the Parks and Recreation Department.
(4) 
Tents, awnings, canopies and temporary structures or fences are not allowed without prior approval in writing by the Parks and Recreation Department.
(5) 
The City reserves the right to cancel or revoke any permit at its discretion.
(6) 
The applicant agrees to indemnify and hold harmless the City of Eldon, its employees and agents for all liability claims arising out of the event.
(7) 
The City reserves the right to request a certificate of insurance showing the City as additional insured with specific liability coverage as deemed necessary by the City.
(8) 
The applicant agrees to comply with all City codes, applicable laws, regulations and orders of the City Administrator.
