Municipal fire and emergency medical services ("EMS") in the territories serviced by the Mount Horeb Area Joint Fire Department ("Department"), as designated in the Fire Protection and Rescue Service Agreement, shall be under the exclusive control of the Department, the operation and coordination of which shall be in accordance with procedures set forth in this chapter.
A. 
Requests for fire or emergency medical services made to the Dane County Public Safety Communications Center ("Center'') shall be dispatched to the scene. Such units shall consist of fire and emergency medical units operated by the Mount Horeb Area Joint Fire Department and municipal mutual aid ambulances pursuant to the Dane County Intergovernmental Agreement. The Center may also dispatch such other municipal Fire Department units as necessary when conditions warrant.
B. 
Fire and EMS vehicles shall be dispatched regardless of whether the accident or incident occurred on public or private property.
A. 
Any person conveyed in a Department emergency medical vehicle to any hospital or similar facility shall be charged a conveyance fee as established from time to time by the Department Board.
B. 
The conveyance fee may be waived in whole or in part based upon the ability to pay determined by available resources for the payment of the conveyance fee and the conveyed person's income level or the income level of the parent or guardian of the conveyed person in the event that the conveyed person is less than 18 years old. The waiver of fees shall be established by the Department Board.
C. 
The Department reserves the right to withhold waiver in whole or in part for the conveyance fee when it is reasonably ascertained that the fees assumed by a person conveyed in a Department emergency medical vehicle were the result of the actions or negligence of a third party. The Department reserves its subrogation rights to any funds received by the conveyed person in compensation or as a result of the actions or negligence of a third party, be it through settlement, civil litigation, or any other means.
D. 
The Department Board may appoint a billing company to administer the collection of Department emergency rescue ambulance services conveyance fees. Contested bills will be reviewed by a Department-established committee for billing disputes.
A. 
The Department is the exclusive authorized fire and emergency medical service provider permitted to service within the Department's exclusive territories.
B. 
The Department is authorized to contract or enter into cooperative agreements for fire or emergency medical services without effect to the Department's exclusive authority and service within these territories.
C. 
Private fire and emergency medical services, or the like, are prohibited from operating in an emergent fashion within the Department's exclusive territories.
D. 
Waiver of prohibition of private fire and emergency medical services, or the like, is subject to the Department's sole discretion and requires formal approval through a service contract or a cooperative agreement between the Department and the private provider.
