Parks shall be open to the public every day of the year as follows:
A. 
During the period from September 1 to April 21, parks shall be open between the hours of 6:30 a.m. and 8:00 p.m.; areas equipped with night lighting shall be open between the hours of 6:30 a.m. and 10:00 p.m.
B. 
During the period from April 22 to August 31, parks shall be open between the hours of 6:30 a.m. and 9:00 p.m.; areas equipped with night lighting shall be open between the hours of 6:30 a.m. and 10:00 p.m.
C. 
In parks containing athletic football practice fields, which fields are immediately adjacent to Township residential areas, the following conditions shall apply:

(1) 
Athletic football practice fields equipped with lighting shall not remain lighted beyond 8:30 p.m.
(2) 
Athletic football practice fields equipped with lighting shall be permitted to use such lighting for football practice from August 15 until December 1 of the calendar year.
(3) 
The lighting provided for such football practice fields from the effective date of this chapter shall not exceed 400 watts HPS floodlights, or equivalent, per light standard.
(4) 
Such football practice fields shall be rotated such that they are not used for athletic football practice or events at least every other year. In those years where the field is not in use, the fields shall remain unlighted.
(5) 
In the event that Evesham Township intends to provide lighting in the future for existing or newly acquired athletic fields, notice shall be provided to all residential property owners within a two-hundred-foot-radius of the property line, and, if requested by five or more of said residents, a public hearing shall be held regarding the placement and related specifics of said lighting.
No person in a public park and recreation area shall:
A. 
Willfully remove, mark, disfigure, tamper with or destroy any sign, playground apparatus, tables, benches or building or any other facilities of public parks or recreation areas.
B. 
Dig, remove, injure or damage any trees, shrubs, plants or other vegetation.
C. 
Hunt or trap any wild animal.
D. 
Dump any materials.
E. 
Carry any firearms of any type in any park or fire any firearms in any park.
F. 
Drive any vehicle on any area except park roads or parking areas, or such areas as may on occasion be specifically designated as temporary areas.
G. 
Allow himself or herself to be indecently exposed.
H. 
Picnic in areas not designated for such purpose. Persons picnicking in designated areas shall place trash in designated areas and completely extinguish fires before leaving the picnic area.
I. 
Bring alcoholic beverages without special permit issued by the Division of Alcoholic Beverage Control or drugs into any park or recreation area or consume alcoholic beverages or drugs at any time; nor shall any person be under the influence of alcohol or drugs while in a park or recreational area. Notwithstanding the provisions of this subsection, the Gibson Mansion located at 535 East Main Street, Marlton, New Jersey, may be used for the consumption of food and alcohol for social purposes, provided that the Township Manager approves the same.

J. 
Have in his or her possession or set or otherwise cause to explode, discharge or burn any firecrackers, rockets or other fireworks or explosive or inflammable material.
K. 
Build or attempt to build a fire except in such areas and under such regulation as may be designated.
L. 
Disturb or interfere unreasonably with any person or party occupying any area or participating in any activity under the authority of a permit.
M. 
Engage in golfing activities at any time, except on the municipally owned driving range or golf course or other areas as designated by the Township Manager by the adoption of the appropriate regulation. For purposes of this subsection, "golfing activities" include hitting a golf ball by any means.

N. 
Play sports or conduct sports activities other than tennis on Township tennis courts.

O. 
Smoke, meaning the burning of, inhaling from, exhaling the smoke from, or the possession of a lighted cigar, cigarette, pipe or other paraphernalia that can be used to consume tobacco or a tobacco-like substance.

A. 
The Township Council of the Township of Evesham has adopted the Evesham Township Department of Open Space and Recreation's Use Policy as a means to reserve use of Evesham’s municipal facilities, thereby improving the accessibility and scheduling facilities and, at the same time, provide for their safe, constructive and prolonged use. Said policy may be amended, from time to time, by resolution duly adopted by a majority of the governing body, at a meeting conducted and held in accordance with the Open Public Meetings Act, N.J.S.A. 10:4-6 et seq.
B. 
No team, group, company, organization, or association of individuals, whether for profit or not for profit, shall use any municipal fields and/or parks, without having first:
(1) 
Filed the appropriate application(s) for permission to use said fields and/or parks;
(2) 
Posted the required proof(s) of insurance;
(3) 
Paid the requisite fee(s);
(4) 
Followed all other procedures required under the Township's Facilities Use Policies; and
(5) 
Received permission from the Township Manager's office, or the Department of Open Space and Recreation.
C. 
Remedies/violations/penalties.
(1) 
Any team, group, company, organization, or association of individuals, whether for profit or not for profit, which violates the foregoing provisions, or who/which permits, allows, facilitates or contributes to a violation or violations of this chapter, shall be liable to the Township of Evesham for payment of the permit fees that would have been due had the policy not been ignored, circumvented, or violated, and shall also be subject to a fine not to exceed $2,000; or to a term of community service not exceeding 90 days; or to a term of imprisonment not exceeding 90 days.
(2) 
Each and every separate event conducted in violation of this section shall be deemed a separate violation giving rise to separate violations and penalties, and separate claims for recovery of fees.
(3) 
In the event that the Township is required to institute litigation to recover the fees that should have been paid by the offending party, and should the Township be successful in recovering those fees, the offending party shall also be liable for all reasonable attorneys' fees and costs incurred by the municipality in pursuing said recovery.

A. 
The Department of Open Space and Recreation and the Department of Public Works staff, in connection with their duties imposed by law, shall diligently administer the provisions of this chapter.
B. 
This chapter shall be enforced by the Police Department of the Township of Evesham, the Department of Open Space and Recreation, the Department of Public Works, and the Township Manager’s office.

In addition to the remedies, fines and penalties set forth in § 110-3C above, any person violating any of the provisions of this chapter or regulation promulgated hereto, shall, upon conviction, be subject to the replacement, repair or restoration of any damaged park property and shall be subject to fine and/or imprisonment as provided for in § 1-15 of the Code of the Township of Evesham.
