A. 
A certain document, three (3) copies of which one (1) is on file in the office of the City Clerk of the City of Berkeley, being marked and designated as the ICC Codes 2009 Edition, as published by the International Code Council, be and is hereby adopted as the Building and Housing Codes of the City of Berkeley in the State of Missouri and made a part hereof, as fully set out in this ordinance, with the additions, insertions, deletions and changes.
ADOPTION OF THE INTERNATIONAL BUILDING CODES
The City of Berkeley, Missouri, hereby adopts the entire International Building Code/2009, including Appendices A — C, E — G and I — K; International Residential Code/2009, including Appendices A — K, N — Q; International Fire Code/2009 including Appendices B — J; International Mechanical Code/2009 including Appendix A; International Existing Building Code/2009, including Appendices A — B and Resource A; International Plumbing Code/2009 (includes the 2009 IPSDC), including Appendices B — G, International Property Maintenance Code/2009, International Fuel Gas Code/2009, International Private Sewage Disposal Code/2009, International Code Council Performance Code (ICCPC) with Appendices A — D; and International Wildland-Urban Interface Code/2009, with Appendices A — H with supplements and American National Standards Accessible and Usable Buildings and Facilities/2003; appendices and referenced standards, thereto, which codes were prepared by the International Code Council (ICC) and as amended in Subsection (C) below and made a part hereof as if more fully set forth herein; and further providing that all prior adoptions of the ICC and BOCA Building, Fire, Electric, Mechanical, Plumbing, Property Maintenance and Residential Codes; and prior adoption of the National Electric Code are hereby repealed and held for naught. A copy of these codes, which bear the signatures of the Mayor and the City Clerk, shall be kept on file at all times in the office of the City Clerk.
B. 
Whenever the words "State" and "municipality" appear in said documents, the same shall be construed to mean "State of Missouri" and "City of Berkeley, Missouri", respectively.
C. 
Additions, Deletions, Insertions And Changes. The following Sections are hereby revised as follows:
International Building Code (IBC)
Section 101.1 Insert: City of Berkeley and any other inserts deemed appropriate.

Section 304.1.1 (14) Insert: Exterior Board Up - Property owner(s) are required to board up a building/structure if it becomes vacant and is not secure. Accessory buildings/structures on the property, such as storage sheds and garages, also must be secured.No building shall remain boarded for more than six (6) months. Property owners must maintain the structure in good shape.All points of entry to a vacant building, including windows and doors, must be secured. See Appendix A for Boarding Standard.
Section 304.13.3 Insert: Window Board Up - In the event of breakage, the owner shall cause the immediate removal of broken glass from the premises and shall temporarily board up the affected openings with suitable material to provide protection from the elements and to prevent entry of insects, birds or animals and to provide security to occupants or contents of the building. The window board up shall not exceed 20 days in an occupied structure.

Section 404.4.1 Change: Every room occupied for sleeping purposes by one (1) occupant shall have a minimum floor area of seventy (70) square feet; and every room occupied for sleeping purposes by more than one (1) occupant shall have a minimum floor area of fifty (50) square feet for each occupant thereof.
Section 404.4.1.1 Insert: 1). Each bedroom must have six (6) square feet of closet space opening into the bedroom with an operable door(s). 2).No sleeping room may be used by two (2) children of opposite sex beyond the age of five (5) years nor may a minor child sleep in the same room as his parents on a permanent basis over five (5) years of age. 3). No room may be classed as a bedroom or sleeping room on a permanent basis by use of a cot, rollaway bed, sofa bed or any in-the-wall closet bed.

Appendix A103.6 Insert: Jurisdiction right to board up - Any person failing to board up a building/structure when it becomes vacant and unsecure within twenty-four (24) hours from the service of the notice, the City reserves the right to enter upon the property to secure by board up and to remove any debris from the exterior of the property. A cost shall be billed to the owner of record or last known owner.

D. 
Penalty. Any person violating any of the provisions of this Article or the Code adopted in this Article shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in an amount not exceeding five hundred dollars ($500.00) or be imprisoned in the City or County Jail for a period of not exceeding ninety (90) days, or both such fine and imprisonment. Each day such a violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder.

A. 
Section 412.7 of the International Building Code, 2015 Edition, as prepared and edited by the International Code Council, which code is hereby specifically incorporated by reference for the sole purpose of meeting the necessary travel distance in aircraft manufacturing facilities.
B. 
Any person violating any of the provisions of this Section or the Code adopted in this Section shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined in an amount not exceeding one thousand dollars ($1,000.00) or be imprisoned in the City or County Jail for a period of not exceeding ninety (90) days, or both such fine and imprisonment. Each day such a violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder.
