A certain document, three (3) copies of which one (1) is on file in the office of the City Clerk of the City of Berkeley, being marked and designated as the 2008 National Electric Code (NEC), as published by National Fire Protection Association (NFPA), is hereby adopted as the Electrical Code of the City of Berkeley in the State of Missouri and made a part hereof, as fully set out in this Article, with the additions, insertions, deletions and changes.
ADOPTION OF THE NATIONAL ELECTRICAL CODE/2008, NFPA 70
National Electrical Code/2008, including Annex A — H; prior adoptions of the National Electric Code are hereby repealed and held for naught. A copy of this code, which bears the signatures of the Mayor and the City Clerk, shall be kept on file at all times in the office of the City Clerk.
Whenever the words "State" and "municipality" appear in said documents, the same shall be construed to mean "State of Missouri" and "City of Berkeley, Missouri", respectively.
Additions, Deletions, Insertions And Changes. The following Sections are hereby revised as follows:
National Electrical Code (NEC)
Annex H. Insert: Adopts NFPA 70, NEC Electrical Code/2008 with amendments and appendices.
Section 80.2 Insert: Shall mean the City of Berkeley.
Section 80.5 Insert: Adopts Article 80, the National Electrical Code for the City of Berkeley.
Section 80.15 Delete: Delete in its entirety.
Section 80.19(E) Insert: Appendix A — Schedule of Fees.
Section 80.23(B) Insert: $1.00 and $1,000.00; 5 days or 90 days in jail.
Section 80.25(C) Insert: Five (5).
Section 80.25(E) Change: Board to Building Commissioner.
Section 80.27(A) Insert: City of Berkeley.
Section 80.27(B) Insert: (3) Ordinances (4) three (3) or five (5).
Section 80.29 Insert: City of Berkeley.
Section 80.35 Insert: Thirty (30).
Penalty. Any person violating any of the provisions of this Article or the code adopted in this Article shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in an amount not exceeding one thousand dollars ($1,000.00) or be imprisoned in the City or County Jail for a period of not exceeding ninety (90) days, or both such fine and imprisonment. Each day such a violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder.
