A. 
Definitions. Whenever in this Section the following items are used, they shall have the meanings respectively ascribed to them.
AUTOMOBILE SALVAGE YARDS
Any yard, lot, premises, parcel or tract of land in or upon which is placed, stored or kept any automobile or motor vehicle of any kind for the purpose of wrecking, dismantling, taking apart, removing parts therefrom or salvaging either automobiles or motor vehicles or parts thereof whether for resale, reuse or other disposition.
AUTOMOBILE WRECKING YARDS
Any yard, lot, premises, parcel or tract of land in or upon which is placed, stored or kept any automobile or motor vehicle of any kind for the purpose of wrecking, dismantling, taking apart or removing parts therefrom so as to render them incapable of being operated.
JUNK YARDS
Any yard, lot, premises, parcel or tract of land in or upon which is placed, stored or kept any of the following: junk, rags, old rope, paper or bagging, used pipes, used plumbing or housing fixtures or supplies, secondhand material, worn or discarded material, surplus, used brass, used copper, used aluminum, used steel or other used metals or wire, empty bottles, or used automotive parts or equipment, regardless of whether or not any of the foregoing items are considered to be antique.
SALVAGE YARDS
Any yard, lot, premises, parcel or tract of land in or upon which is placed, stored or kept for the purpose of wrecking, dismantling, reconstructing, rebuilding, resale, reuse or salvaging either in its original form or some other form or shape any of the following: junk, rags, old rope, paper or bagging, used pipes, used plumbing or heating fixtures or supplies, secondhand material, worn or discarded material, surplus, used brass, used copper, used aluminum, used steel or other used metals or wire, empty bottles, or used automotive parts or equipment, regardless or whether or not any of the foregoing items are considered to be antique.
B. 
Regulations. It shall be unlawful and constitute an offense for any person, firm or corporation to carry on, operate, maintain or conduct a junk yard, salvage yard, automobile salvage yard or automobile wrecking yard, as herein defined, or combination thereof unless such establishment or business is carried on, maintained or conducted in compliance with the following regulations:

It shall be first legally licensed as required by the City of Berkeley licensing ordinances.
2. 
It is in conformity with and complies with the Zoning Code of the City of Berkeley and all other ordinances applicable thereto.
3. 
It is carried on, maintained or conducted entirely inside an enclosed building or buildings or upon premises, yards, lots, tract of land, acres, places or parcels of land fully enclosed with a solid, non-transparent fence or wall or combination thereof with a minimum height of eight (8) feet from the ground level. All entrances and exits shall contain gates constructed of solid, non-transparent materials with a minimum of eight (8) feet from the ground level. The fence, wall or gates shall not contain any poster or advertising of any kind excepting one (1) sign of the license not exceeding one hundred (100) square feet in size.
4. 
Such fence or wall shall be maintained in a neat, substantial, safe condition.
5. 
Water or any other liquid shall not be permitted to accumulate until it becomes vile or stagnant; trash, weeds or rank vegetation shall not be permitted on said premises.
6. 
The premises shall be kept free from vermin, rodents, reptiles and animals of all kinds other than properly licensed dogs and cats.
C. 
Compliance Time. Existing businesses properly licensed and in operation at the time of the effective date of this Section shall be given ninety (90) days in which to comply herewith.
D. 
Penalty. Any person, firm or corporation violating any of this provisions of this Section, upon conviction thereof, shall be fined not more than five hundred dollars ($500.00) or by imprisonment not exceeding ninety (90) days, or by both such fine and imprisonment and each day of such violation shall constitute a separate offense.
