§ 99-1 Certified Animal Control Officer; term; obligations.

There is hereby created within the Borough of Buena the position of Certified Animal Control Officer. The Mayor of the Borough shall appoint a Certified Animal Control Officer for a term of one year with the advice and consent of Council, or the Council may award a contract for the services, and the person so appointed is hereby designated to license dogs in the Borough of Buena, to enforce this chapter and to enforce the provisions of N.J.S.A. 4:19-15.1 et seq., as amended, including but not limited to the obligations of canvassing for dogs in the municipality, the impounding of dogs and the citing of persons for violations of this chapter or of state statute.

§ 99-2 Definitions.

As used in this chapter, the following terms shall have the meanings indicated:
CAT
Any member of the domestic feline species, male, female or altered.
CERTIFIED ANIMAL CONTROL OFFICER
Any person or agency certified by the State of New Jersey as defined under N.J.S.A. 4:19-15.1 et seq.
DOG
Any dog, bitch or spayed bitch.
DOG OF LICENSING AGE
Any dog which has attained the age of seven months or which possesses a set of permanent teeth.
DOMESTIC ANIMALS
Any of various animals (including livestock) domesticated by man so as to live and breed in a tame condition.
KENNEL
Any establishment wherein or whereon the business of boarding or selling dogs or boarding dogs for sale is carried on, except a pet shop.
NEUTERED
Rendered permanently incapable of reproduction as certified by a licensed veterinarian.
OWNER
When applied to the proprietorship of any dog, cat or other animal, includes every person having a right (or custody) in such an animal and every person who has such an animal in his or her keeping or who harbors or maintains an animal or knowingly permits such an animal to remain on or about any premises occupied by that person or who feeds such an animal on a regular basis.
PERSON
Any individual, corporation, partnership, organization or institution commonly recognized by law as a unit.
PET SHOP
Any room or group of rooms, cage or special pen not part of a kennel, wherein dogs for sale are kept or displayed.
POUND
Any establishment for the confinement of dogs seized either under the provisions of this chapter or otherwise.
SHELTER
An establishment where dogs are received, housed and distributed without charge.
