A. 
Only single-family dwellings and duplexes shall be eligible for municipal trash collection in the Borough of Buena, provided that the owner, lessee, occupant or other person having control of each dwelling unit places and makes readily accessible for collection and removal of residential trash suitable and sufficient covered containers for such purpose in accordance with the provisions of this article.
B. 
Where the owner of a building or apartment house containing three dwelling units resides in one of the units and rents the two remaining units located in said building, all three residential dwelling units shall be eligible for municipal trash collection.
C. 
No dwelling unit shall be disqualified for trash collection because it is in common ownership with other dwelling units in the Borough of Buena, whether or not located on the same lot with other dwelling units.
Receptacles for the collection of mixed garbage, trash and rubbish from within the Borough of Buena may be made of metal, plastic or wood or may consist of heavy-duty plastic bags or cardboard boxes properly tied, none of which shall exceed 50 pounds when full. All such containers shall have lids to prevent mixed garbage, trash or rubbish from spilling on the ground or roadway prior to collection.
Receptacles for ashes shall be metallic containers of such size that can be handled by one man and so constructed as to prevent the spilling or leaking of their contents, and such receptacles shall not be filled higher than three inches below the top of the container.
Containers or receptacles from which mixed garbage, ashes, trash and rubbish are to be collected shall be placed near the gutter line or curbline of each property by the owner, lessee, agent, occupant or other person having control of such residential property so as to be easily collected from the roadway, but such containers or receptacles shall not be placed so near the gutter line or roadway as to project therein or as to interfere with vehicles lawfully using said street or roadway. No container or receptacle shall be placed at the gutter line prior to 5:00 p.m. of the day immediately preceding the day of collection, and all such containers or receptacles shall be removed from the gutter line promptly but no later than 7:00 p.m. of the day of collection.
Rubbish which is not suitable for placement in containers or receptacles, such as light brush or wood, shall be properly bundled and tied in such a manner that it can be handled by one man. Ashes shall not be placed in the same receptacle with garbage or mixed trash but shall be placed in separate containers as above described.

No person shall throw, lay, deposit or leave or cause to be thrown, lain, deposited or left in or upon any street, avenue, roadway, sidewalk or public thoroughfares any mixed garbage, ashes, trash or rubbish of any kind whatsoever.
In the interpretation of this article, the following words shall have the definitions hereinafter stated:
ASHES
The residue from fires used for cooking foods and heating buildings, as well as floor sweepings, which may accumulate in connection with the ordinarily general use of dwellings and apartment houses.
GARBAGE
Meat, vegetable solids and foodstuffs resulting from the handling, preparation, cooking and consumption of foods and considered to originate principally in kitchens.
OTHER COLLECTIBLE TRASH (WHICH MAY BE PLACED FOR COLLECTION PURSUANT TO THE TERMS OF THIS ARTICLE)
Includes all lawn cuttings and rakings, including twigs, leaves raked from a lawn, light brush or wood not over six feet in length, not exceeding 50 pounds and properly bundled and tied; provided, however, that leaves shall not be placed for collection during the fall season beginning at a time as determined by the Council of the Borough of Buena when residents are requested to rake leaves into roadway gutters for collection by Borough trucks.
TRASH AND RUBBISH
Any and all wastes other than ashes or garbage, including paper, cans, straw, small pieces of metal, bottles, glass and combustible materials from domestic use, cardboard boxes and other articles or refuse, discarded by householders in the usual and ordinary course of living; provided, however, that the same must be properly broken up and placed in containers or bundles for convenient handling.
The Council of the Borough of Buena may, in addition to the within article, adopt rules and regulations pertaining to the collection, removal and disposal of garbage, rubbish, ashes and other refuse matter within the Borough of Buena, by resolution, as it may deem appropriate for the proper collection of such garbage, rubbish, ashes or trash.
No person shall place for collection by the company or person collecting mixed garbage, ashes, trash and rubbish pursuant to a contract with the Borough of Buena any earth, stone, plaster, wood or other material from excavating or from constructing, altering or repairing any buildings.

Any person violating any provision of this article shall, upon conviction, be liable to such penalties as set forth in Chapter 1, General Provisions, Article III, of this Code.
