The Chief of Police of Franklin is hereby designated as the 911 Coordinator for the Borough of Buena. The 911 Coordinator shall be responsible to enforce this chapter and to update the Street Address Map and list with the Municipal Engineer from time to time in order that said map may be kept current.
The owner, occupant or lessee of every occupied building in the Borough of Buena, whether residential, commercial or industrial, or whether designated for any other use, which now fronts or which may hereafter front upon any public or private street within the Borough of Buena shall, at his or her own expense, within 90 days after the effective date of this chapter, cause the authorized and assigned number of each occupied building to be permanently and conspicuously placed in accordance with the specifications set forth in this chapter.
A. 
All numbers required by § 75-2 of this chapter shall be:
(1) 
In numerals.
(2) 
A minimum size of three inches in height.
(3) 
Mounted in a secure fashion to the front wall or porch of each occupied building so as to be clearly visible from the traveled portion of the street on which such building fronts. If numbers affixed to the front of the building are not visible from the street because of setback, trees or other vegetation, or for any other reason, there shall, in addition, be a second number as specified by this section placed upon a post, rod, mailbox or other type of fixture of substantial nature at or near the road frontage so that the number will be conspicuous and visible from the street upon which the building fronts.
B. 
Numbers mounted in accordance with this chapter shall have a reflective surface or be illuminated in order to be sufficiently visible as to contrasting background, arrangement, spacing and uniformity and so as to be clearly visible to anyone attempting to locate the property in the event of an emergency.
C. 
All numbers mounted in accordance with this chapter shall be at least at aboveground level and placed in such a manner that trees, shrubs and other obstructions do not block the line of sight of the numbers from the street upon which the building fronts, or shall be otherwise located in such a manner to be visible to persons traveling on the roadway.
D. 
The final determination of whether the numbers installed in accordance with this chapter comply with these specifications shall be determined by the 911 Coordinator or his designee.
Building numbers required by this chapter shall be determined by the Municipal Engineer or by the 911 Coordinator. Every owner, occupant or lessee of an occupied building which is constructed in the Borough of Buena shall receive a 911 number from the Tax Collector of the Borough of Buena which shall be included with tax bills which are mailed after the adoption of this chapter. Any person who does not receive a house number as provided for in this chapter shall apply to the 911 Coordinator for a number in order to comply with the requirements of this chapter.
Any occupied building which is erected, repaired, altered, modified or subject to any change of use or change of occupancy after the effective date of this chapter shall have the certificate of occupancy withheld until permanent and proper numbers have been affixed. For purpose of this chapter, an "occupied building" shall be one in which human beings live or work or which may be used by one or more persons for social, residential or commercial purposes. Storage sheds, detached garages or similar-type facilities which are accessory to the primary use on a property shall not be required to have separate numberings pursuant to this chapter.
A list entitled "Street Address List of the Borough of Buena" is hereby adopted by reference with this chapter and shall be amended from time to time by the 911 Coordinator or the Borough Engineer in order to keep said street address list and the Street Address Map current. Said map shall be the official street map for the identification and location of all buildings in the Borough of Buena which shall be numbered pursuant to this chapter. A copy of said map and list shall be kept on file with the Borough Clerk.

Any person who fails to comply with the numbering requirements of this chapter after receiving a warning from the 911 Coordinator, and any person found guilty of vandalizing or removing house numbers which are posted in accordance with the requirements of this chapter shall, upon conviction thereof, be liable to such penalties as set forth in Chapter 1, General Provisions, Article III, of this Code.
