Peddling and soliciting — See Ch. 177.
The Borough of Buena shall permit charitable organizations, as defined in Section 3 of the Charitable Registration and Investigation Act, N.J.S.A.45:17A-18 et seq., to solicit contributions in the streets and highways of the Borough of Buena in accordance with the provisions of this chapter.

All charitable organizations which are domiciled or which have offices in the Borough of Buena, or which provide services to residents of the Borough of Buena and wish to solicit contributions in the streets and highways of the Borough of Buena shall file a request with the Borough Clerk and with the Chief of the Franklin Township Police Department specifying the following information:
The name of the charitable organization.
The address of the organization.
The organization's telephone number.
A contact person for such organization.
The location of the proposed charitable solicitation.
The dates and times of the proposed charitable solicitation.
If said request involves a county roadway and/or highway, said request shall include a copy of an authorization from the Atlantic County Board of Chosen Freeholders to permit said charitable solicitation.
If said request involves a state roadway and/or highway, said request shall include a copy of an authorization from the State of New Jersey, Commissioner of Transportation, to permit said charitable solicitation.
A list of all proposed safety regulations, safety devices and training for individuals who shall participate in the charitable solicitation and/or a report as to the procedures to be used to ensure the safety of the members of the public who will be traversing the roadways and/or highways of the Borough of Buena.

The request required by § 84-2 of this chapter shall be reviewed by the Chairman of the Public Safety Committee along with the Chief of Police or his designee, and the Chairman shall make a recommendation to the Mayor and Council of the Borough of Buena as to the relative aspects of the request, including a review of the location, dates and times of the request and a review of the safety procedures and/or methods to be employed by said charitable organization. The Chairman of the Public Safety Committee shall thereafter forward a report to the Mayor and Council, a copy of which shall be placed on file with the Borough Clerk as to his or her recommendations of the granting, rejecting or modification of any proposed charitable solicitation.
In no event shall any charitable organization requesting authorization from the Borough of Buena for a charitable solicitation on the Borough's streets or highways use any individual under the age of 18 years to perform any function or task associated with such charitable solicitation.
Any charitable organization requesting authorization from the Borough of Buena for a charitable solicitation on the Borough's streets or highways shall comply with all of the terms and conditions provided for in N.J.S.A. 39:4-60, as amended, together with any regulations adopted by the Department of Transportation to regulate or control the solicitation of charitable contributions on streets and highways in the State of New Jersey.
This chapter is adopted pursuant to N.J.S.A. 39:4-60, as amended, and shall take effect upon final passage and publication, in accordance with all applicable laws, and upon the effective date of N.J.S.A. 39:4-60, as amended by P.L. 1997, c. 82, as approved April 30, 1997.
