There shall be a Municipal Court which shall have jurisdiction to hear and determine all cases arising under the Charter and ordinances of the City. The Municipal Court may punish contempts of court by fine not to exceed five hundred dollars ($500.00) and/or ninety (90) days in jail or both. It may enforce its orders and judgments as a court of record may, and render final judgment on any forfeited bond or recognizance returnable to such court.
The Municipal Court shall be presided over by a judge appointed by the Council for a term of four (4) years. He shall be a licensed member of the Missouri Bar except that any person who has heretofore been elected Police Judge in the City of Berkeley shall be eligible for appointment to the office of Municipal Court Judge without being so licensed. He shall receive compensation as fixed by the Council, and may be removed from office at any time for cause in the same manner as provided in this Charter for the removal of the City Manager.
Whenever the Municipal Court Judge is temporarily absent or unable to act, the Council shall designate a person of like qualifications to act during such absence or disability.
The Chief of Police and his subordinates, or some other person or persons appointed for this purpose by the Council, shall serve as Marshal and Deputy Marshals of the Municipal Court and shall enforce its orders, judgments and decrees.
The forms of complaints and all proceedings in the Municipal Court shall be prescribed by ordinance.
