There shall be a Department of Public Works for the purpose of performing public works activities, including maintenance of streets, shade trees, sanitary and storm sewer systems, parks, playgrounds, open space, athletic fields, vehicles, equipment, land, buildings, facilities, fixtures, and/or similar items related to the physical plant, infrastructure, and property of the Borough.

A. 
The Department shall be staffed by any number of employees possessing the knowledge, skills, training, licenses, credentials, and experience necessary to perform public works activities as determined by the Mayor and Council. Said employees shall consist of personnel such as managers, supervisors, laborers, repairers, mechanics, and drivers, of various levels and grades, and of permanent, temporary or seasonal status, as provided for by the Civil Service Commission and as determined by the Mayor and Council.
B. 
The Department shall be organized into four divisions: Operations, Facilities, Vehicles & Equipment, and Shade Tree. Assignments of employees to the various divisions, temporary or otherwise, and to perform the various duties and responsibilities of the Department shall be at the discretion of the Superintendent of Public Works, in consultation with the Borough Administrator. During times of emergency, all personnel of the Department shall be responsible for performing any and all duties necessary to respond to said emergency as determined by the Superintendent of Public Works or other Borough Official managing the response to said emergency.
C. 
The employees of the Operations Division shall consist of all employees not otherwise assigned to another division of the Department, according to the criteria prescribed in this section. The employees of the Division shall be responsible for the maintenance, repair, and cleaning of streets, storm sewer systems, sanitary sewer systems, and pump stations; curbside collection of leaves, branches, bulk items, and public garbage cans; snow plowing and removal; landscaping and grounds maintenance; janitorial, cleaning, and material handling services; and such other duties and responsibilities as may be assigned.
D. 
The employees of the Facilities Division shall possess knowledge, skills, and experience in performing a craft and/or trade such as carpentry, electrical, glazing, masonry, mechanical, plastering, painting, plumbing, roofing, steam-fitting, sheet metal, and/or other types of maintenance work related to repair and maintenance of public facilities.
E. 
The employees of the Vehicle & Equipment Division shall possess knowledge, skills, and experience in performing maintenance, repair and servicing of various types of motor vehicles, motorized construction equipment and/or small motor power tools and equipment.
F. 
The employees of the Shade Tree Division shall possess knowledge, skills, and experience in performing maintenance, trimming, planting, and removal of shade trees located adjacent to streets in the public rights-of-way and upon public property. The work and employees of the Division may be supplemented and assisted by the use of outside licensed tree care operators, certified tree experts, and certified arborists.
The Department shall be managed by the Superintendent of Public Works, or an Acting Superintendent of Public Works, appointed by the Mayor with advice and consent of the Council, in accordance with civil service rules. The Superintendent, who shall report to the Borough Administrator, shall supervise the employees of the Department in carrying out the duties and responsibilities of the Department.
The Mayor and Council may establish the position of Assistant Superintendent of Public Works as well as any number of Supervisors and Assistant Supervisors of Public Works who shall report to and assist the Superintendent in managing the personnel and fulfilling the duties of the Department. Any such appointments shall be made by the Mayor with advice and consent of the Council, in accordance with civil service rules.
The Mayor, with the advice and consent of the Council, shall appoint a qualified person to serve as Principal Public Works Manager pursuant to N.J.S.A. 40A:9-154.6g (2013). The Principal Public Works Manager, who need not be the Superintendent of Public Works and need not be a full-time employee of the Borough, shall perform or cause to be performed such duties as required by N.J.S.A. 40A:9-154.6a (2013) and shall report to the Borough Administrator.
