This ordinance was amended 3-15-2005 by Ord. No. 05-013 to consolidate the responsibilities of the Zoning Board of Appeals and the Plan Commission. Original Sec. 3 of Ord. No. 01-018, Creation of Zoning Board of Appeals, was therefore deleted. Ord. No. 05-013 provided that the Plan Commission shall be vested with all powers and perform all duties of the former Zoning Board of Appeals; provided, however, that any action taken by the Zoning Board of Appeals prior to 4-1-2005, or any matter pending before the Zoning Board of Appeals as of 4-1-2005, shall be continued by the Plan Commission.
There is hereby created and established in and for the Village of Homer Glen a Plan Commission, to consist of seven members, to be appointed by the Village President with the advice and consent of the Village Board, with one of the aforesaid seven members being annually designated by the Village President to serve as the Chairperson of the Plan Commission. All members of the Plan Commission shall be residents of the Village of Homer Glen, and shall serve without compensation therefor.

Any member of the Plan Commission may be removed at any time by the Village Board at any time for any cause deemed sufficient therefor by the Village Board. In addition, any Plan Commissioner absent from any three consecutive meetings of the Plan Commission without advising the Chairperson of the Plan Commission of the reasons therefor shall be subject to removal by the Village President. Any vacancy on the Plan Commission shall be filled by appointing a new member to serve for the balance of the unexpired term of the vacancy. The term of office for all Plan Commission members appointed to office subsequent to the expiration of the appointment of an initial appointee shall be for three years.

Upon its initial appointment and thereafter at such times as may be necessary, the Plan Commission shall meet, organize and elect officers as it deems necessary, and shall adopt such rules and regulations as it sees fit for the conduct of its business, which shall be consistent with state law and the applicable ordinances of the Village. Meetings may be held at such times as the Plan Commission shall desire, and notice shall be given therefor in accordance with the Open Meetings Act (5 ILCS 120/1 et seq.). Written minutes shall be kept of all proceedings of the Plan Commission, and an annual report describing the business of the Plan Commission for the preceding year and making recommendations for the forthcoming year shall be presented to the Village Board on or before May 31 of each year.
The jurisdiction and responsibilities of the Plan Commission shall be as set forth below:
A. 
To conduct hearings upon, review and make recommendations to the Village Board regarding amendments to the zoning ordinances of the Village.
B. 
To conduct hearings upon, review and make recommendations to the Village Board concerning a Comprehensive Plan for the present and future development or redevelopment of the Village and contiguous unincorporated territory not more than 1 1/2 miles beyond the corporate limits of the Village and not included in any other municipality. Such plan must be adopted in whole or in separate geographical or functional parts, each of which, when adopted, shall be the official Comprehensive Plan, or part thereof, of the Village of Homer Glen. Such plan shall be advisory except as to such part thereof as has been implemented by ordinances duly enacted by the Village Board of Trustees. All requirements for public hearing, filing of notice of adoption with the County Recorder of Deeds and filing of the plan and ordinances with the Village Clerk shall be complied with as provided for by law. In order to provide for the health, safety, comfort, and convenience of the inhabitants of the Village and contiguous territory, such plan may be implemented by ordinances establishing reasonable standards of design for subdivisions and for resubdivisions of unimproved land and of areas subject to redevelopment in respect to public improvements as herein defined: establishing reasonable requirements governing the location, width, course, and surfacing of public streets and highways, alleys, ways for public service facilities, curbs, gutters, sidewalks, streetlights, parks, playgrounds, school grounds, size of lots to be used for residential purposes, stormwater drainage, water supply and distribution, sanitary sewers, and sewage collection and treatment; and designating land suitable for annexation to the Village and the recommended zoning classification for such land upon annexation.
C. 
To recommend to the Village Board, from time to time, such changes in the official Comprehensive Plan, or any part thereof, as may be deemed necessary.
D. 
To prepare and recommend to the Village Board, from time to time, plans or recommendations, or both, for specific improvements in furtherance of the official Comprehensive Plan.
E. 
To give aid to the officials of the Village of Homer Glen charged with the direction of projects for improvements embraced within the official Comprehensive Plan, or parts thereof, to further the making of such projects for improvements, and generally to promote the realization of the official Comprehensive Plan.
F. 
To arrange and conduct any form of publicity relative to its activities for the general purpose of public understanding.
G. 
To cooperate with municipal or regional planning commissions and other agencies or groups to further the local planning program and to assure harmonious and integrated planning for the area.
H. 
To conduct hearings upon, review and make recommendations to the Village Board concerning special uses, special use permits, variances, and planned unit developments.
I. 
To make recommendations to the Village Board designating land suitable for annexation to the Village and the appropriate zoning classification therefor upon such annexation.
J. 
To periodically review the ordinances of the Village pertaining to zoning, planning and subdivision and to make recommendations to the Village Board for the improvement thereof.
K. 
To review and make recommendations to the Village Board concerning such other matters as may come within its purview pursuant to law or the applicable ordinances of the Village.
L. 
To review applications for liquor licenses that are assigned to it by the Village President, acting in his capacity as Local Liquor Commissioner, and make advisory recommendations to the Local Liquor Commissioner concerning the applications and their compliance with Village ordinances.

A. 
The Village Board of Trustees shall assume the jurisdiction and responsibilities of the Plan Commission, as more fully set forth in § 10-4 above, when the number of members of the Plan Commission duly appointed by the Village President with the advice and consent of the Village Board falls below the number of four for any reason.
B. 
During the period of time the Village Board assumes the duties and responsibilities of the Plan Commission, the Trustees will elect one member of the Village Board to serve as Chairperson of any meeting or hearing to be conducted when it is necessary for the Board to act in the place of the Plan Commission.
C. 
When the duly appointed membership of the Plan Commission returns to four or more members, the jurisdiction and responsibilities assumed by the Village Board pursuant to § 10-4A will be resumed by the Plan Commission and the Board of Trustees will no longer act in this capacity.
