There is hereby designated a Recreation and Parks Commission for Millcreek Township, Erie County, Pennsylvania to be known as the "Millcreek Township Recreation and Parks Commission."

The Commission shall be composed of five members (two members of which shall be school directors of the Township of Millcreek or shall be appointees of the school directors of said school district), with the power to provide, conduct and maintain public recreation areas, facilities and centers subject to all responsibilities of the recreation enabling legislation. The Commission members shall serve for terms of five years and until their successors are appointed, except that the members first appointed shall be so appointed that the term of at least one member shall expire annually thereafter. Vacancies shall be filled in the same manner as original appointments are made and shall be made for the same term. Members shall serve without pay.
The Recreation and Parks Commission shall appoint from its membership a Chairman and such other officers as it may deem necessary for the orderly conduct of its business. It may adopt by-laws, rules and regulations to govern those procedures not contrary to the provisions of the Laws of the Commonwealth of Pennsylvania. The Recreation and Parks Commission shall from time to time make rules governing the operation and conduct of the recreation facilities operated by the Commission. The Commission shall hold regular meetings at such times and places as it may designate.
The Recreation and Parks Commission shall maintain, operate and supervise public playgrounds and all outdoor and indoor recreation areas and facilities owned or controlled by the Township of Millcreek.
The Recreation and Parks Commission may accept any grant, gift, bequest or donation of service, equipment, real estate or money from any individual or group to be used as specified by the donor or by the terms of acceptance. The Recreation and Parks Commission shall have no authority to enter into any contract or incur any expenses binding upon the Township of Millcreek other than current obligations or contracts to be fully executed within the then current fiscal year and all within the budget appropriation made by the Board of Supervisors of the Township of Millcreek.
The Recreation and Parks Commission shall have the power to appoint a Director of Education who shall possess the necessary qualifications and who has demonstrated by actual work his ability to organize and direct a community recreation system and supervise the activities of such other personnel as may be deemed necessary to carry out the program.
Funds appropriated by the Board of Supervisors of the Township of Millcreek and budgeted to the Recreation and Parks Commission shall be disbursed by the fiscal disbursing officer of the Township upon vouchers issued by the Recreation and Parks Commission and within the budget appropriated and funds received by the Recreation and Parks Commission from sources other than budget appropriations shall be disbursed by the Supervisors of Millcreek Township to the credit and for the use of said Commission and disbursed as the above funds are disbursed, except that funds received by gift, bequest or otherwise shall be disbursed in accordance with the terms of such gift or bequest or the terms of the acceptance thereof.
The Recreation and Parks Commission shall make full and complete report to the Board of Supervisors of the Township of Millcreek at such times as may be requested by said Supervisors. The fiscal year of said Recreation and Parks Commission shall conform to that of the Township of Millcreek.
Such powers as are now or may hereafter be provided by the Statutes of the Commonwealth of Pennsylvania or by ordinance of the Township of Millcreek relating to the operation and maintenance of public recreation areas and playgrounds are hereby vested in the Recreation and Parks Commission to be exercised by it subject to any and all restrictions contained in such powers and ordinances.
