A.
No person shall place or maintain over any sidewalk any awning, shade,
shade frame, canopy, sign, or signboard without a permit from the
Select Board, but no such awning, shade, shade frame, canopy, sign,
or signboard shall be less than eight feet from the ground in the
lowest part or extend beyond the line of the sidewalk.
B.
Exemption for A-frame or sandwich board signs. A-frame or sandwich board signs advertising local businesses may be allowed in the Downtown Business Zone only when properly permitted by the Inspector of Buildings and in conformance with the size, location and hours of display standards for signs in the Mansfield Zoning Bylaw (Chapter 230 of the Town Code).
No person shall allow any wood, coal or other obstruction to
remain within the limits of a street or upon any sidewalk so as in
any manner to obstruct the travel thereon, or for more than 24 hours
after they have been notified to remove the same by the Town Manager
or by an officer having charge of the highway or any constable or
police officer.
A.
No person who is not in the employ of the Town or of some office
or department thereof, having authority so to do, shall dig up, excavate,
or assist in breaking or digging up or excavating any part of a public
street, highway, or Town way, or remove any gravel or other material
from a public street, highway, or Town way, unless they have obtained
from the Select Board or Town Manager a written permit therefor.
B.
Whoever, by virtue of such a permit, breaks, digs up, or excavates,
or causes to be dug up, broken up, or excavated, any part of a public
street, highway, or Town way shall cause a rail or other sufficient
barriers to be placed so as to enclose part of the street so dug up,
broken up, or excavated; and they shall cause a sufficient number
of lighted lanterns for public protection to be attached to some part
of such barrier and so kept from the beginning of twilight through
the whole of every night during all the time such street, highway,
or Town way remains dug or broken up or such excavation exists.
Said person or persons shall restore said street, highway, or
Town way immediately upon completion of work; and the expense of repairs
on said ways rendered necessary by said digging up and accruing within
one year thereafter shall be paid by such person or persons.
No person shall allow any gate or door belonging to premises
under their control and adjoining any sidewalk or public way to swing
on, over, or into said walk or way.
No person shall place or cause to be placed or empty or cause
to be emptied upon any street, way, lane, sidewalk, or brook any leaves,
house dirt, offal or rubbish, any sewage or the drainage of any sink
or stable, or the contents of any cesspool, vault, privy or privy
well, or any waste matter whatsoever.
No person shall discharge water from a sump pump or other mechanical
source into any street, way, land, or sidewalk which could cause safety
concerns due to icing or dangerous driving conditions or cause damage
to the Town's property.
No person or company shall violate the provisions of the Town
of Mansfield drain layers license and regulations.
A.
Definition. This section refers to scooters, power boards, all-terrain
vehicles and mini-motorbikes that have handlebars that have two or
more wheels, that are designed to be stood upon or sat upon by the
operator, and that are electric or gas-powered by an engine or motor
capable of propelling the vehicle with or without human thrust, excluding
wheelchairs and vehicles which are medically necessary.
B.
Prohibition from sidewalks. No person may use, ride or otherwise
operate an electric or a gas-powered scooter, power board, or mini-motorbike
on a sidewalk of the Town of Mansfield.
C.
Prohibition from streets. No person may use, ride or otherwise operate
an electric or a gas-powered scooter, power board, all-terrain vehicle
or mini-motorbike on a public way, private way, street or on the grounds
of any public school in the Town of Mansfield unless that person is
16 years of age or older and is carrying a valid Massachusetts driver's
license in their possession.
D.
Penalties. Any person violating the provisions of this section shall
be subject to a fine of $25 for a first offense and $50 for a second
or subsequent offense.
E.
Exceptions. Nothing in these subsections shall prevent the legal
use of:
(1)
Any
mechanical or motorized device designed and used to assist a person
with a disability affecting ambulation;
(2)
A moped
that has been registered with the Massachusetts Registry of Motor
Vehicles; and
(3)
A motorized
bicycle that has been registered with the Massachusetts Registry of
Motor Vehicles.
F.
Enforcement. The Mansfield Police Department shall have the authority
to enforce this section. The provisions of MGL c. 40, § 21D,
may be used to enforce these subsections. The Chief of the Mansfield
Police Department shall have the authority to promulgate rules and
regulations necessary to implement and enforce these subsections.
G.
Regulatory authority. The Chief of the Mansfield Police Department
shall have the authority to promulgate rules and regulations necessary
to implement and enforce these subsections.
H.
Severability. If any provisions of these subsections are held to
be invalid by a court of competent jurisdiction, then such provision
shall be considered separately and apart from the remaining provisions,
which shall remain in full force and effect.
J.
Vendors. All vendors selling vehicles described in Subsection A shall be required to post in clear and conspicuous terms the statement that these vehicles are banned on public and private ways, sidewalks, and public grounds and deliver a copy of this bylaw to a purchaser of any vehicle defined under this bylaw.
