(a) Generally. The speed limits for vehicles being operated in the City,
as set out in the following subsections of this section, have heretofore
been established pursuant to the statutory procedure; and it shall
be unlawful for any person to operate a vehicle at a speed in excess
of such limits.
(b) Fifty-five miles per hour. A speed limit of 55 miles per hour is
hereby established on the following streets:

(a) The speed limits in all areas of the City designated in §
17-70 shall be clearly marked by signs or markers.
(b) No person shall be convicted of a violation of an ordinance enacted by the City Council pursuant to the provisions of Code of Virginia, § 46.2-1300, decreasing the speed limits established in §
17-70, when such person has exceeded the speed limit in an area where the speed limit has been decreased, unless such area is clearly indicated by a conspicuous marker at the termini of such area.

The City Manager may reduce, for a temporary period not to exceed
60 days, without the engineering and traffic investigation provided
for and required in Code of Virginia, § 46.2-1300, the speed
limit on any portion of any street of the City on which men are working
or where the street is under construction or repair.

(a) The speed limitations set forth in this article shall not apply to
vehicles, when operated with due regard for safety under the direction
of the police in the chase or apprehension of violators of the law
or of persons charged with or suspected of any such violations, or
in testing the accuracy of speedometers on police vehicles, or in
testing the accuracy of the radio microwave or other electrical devices
specified in the Code of Virginia, § 46.2-882, nor to Fire
Department vehicles when traveling in response to a fire alarm or
pulmotor call, nor to ambulances when traveling in emergencies.
(b) The exemptions granted by this section to a moving vehicle shall
apply only when the operator of such vehicle displays a flashing,
blinking or alternating red light and sounds a siren, bell, exhaust
whistle or air horn designed to give automatically intermittent signals,
as may be reasonably necessary and only when there is in force and
effect for such vehicle standard automobile liability insurance covering
injury or death to any one person in the sum of at least $100,000
in any one accident and, subject to the limit for one person, to a
limit of $300,000 because of bodily injury to or death of two or more
persons in any one accident, and to a limit of $10,000 because of
injury to or destruction of property of others in any one accident.
(c) The exemptions granted by this section shall not protect the operator
of any such vehicle from criminal prosecution for conduct constituting
reckless disregard of the safety of persons and property. Nothing
in this section shall be construed to release the operator of any
such vehicle from civil liability for failure to use reasonable care
in such operation.

As defined in Code of Virginia, § 46.2-100, residence
district means the territory contiguous to a street, not comprising
a business district, where 75% or more of the property abutting such
street, on either side of the street, for a distance of 300 feet or
more along the street consists of land improved for dwelling purposes,
is occupied by dwellings, or consists of land or buildings in use
for business purposes.

Any person who wishes to have a street, streets or portion of
a street located in a residence district designated for an additional
fine for speeding shall present a petition or petitions signed by
at least one occupant of at least 60% of all residential properties
located on both sides of the street, streets or portion of a street
located in the residence district to the City Manager, who shall cause
such traffic and other studies as he shall deem necessary to be conducted,
including a determination that the street, streets or portion of a
street is in fact in a residence district, and shall present the petition
and the result of such studies to City Council for its consideration.

If, based upon the petition and studies presented to it by the City Manager and such other information it shall deem necessary, City Council finds that the additional fine should apply to the street, streets or portion of a street specified in the petition, than it shall set forth the street, streets or portion of a street in §
17-77 below.

Pursuant to Code of Virginia, § 46.2-878.2, any person
who operates a motor vehicle in excess of the maximum limit established
for the following street, streets or portion of a street, on or after
the effective date, when indicated by appropriately placed signs displaying
the maximum speed limit and the penalty for violations, shall be guilty
of a traffic infraction punishable by a prepayable fine of $200, in
addition to other penalties provided by law. No portion of the fine
shall be suspended unless the court orders 20 hours of community service.
