The purpose of the provisions of this article is to provide for the curtailment of water usage through voluntary or mandatory restrictions or reductions in water usage during a water supply shortage affecting the City and its adjacent service areas.

The City Council, after consultation with the City Manager and the Director of Public Works concerning the condition of the City's water supply and the possibility or probability of any shortage therein, may declare a Stage I, II or III water shortage as set forth below in §§ 30-102, 30-103 and 30-104.

(a) 
Upon determination by the City Council that the City's water supply is limited, it may declare, by resolution, a Stage I water shortage.
(b) 
Upon the City Council's declaration of a Stage I water shortage, the City Manager shall request that persons utilizing City water voluntarily minimize the use of water:
(1) 
In washing motor vehicles and other motorized equipment;
(2) 
In washing down streets, sidewalks, driveways, other hard-surfaced areas, buildings and other exterior structures; and
(3) 
In watering shrubbery, trees, lawns and other growing plants other than farm crops.

(a) 
Upon determination by the City Council that the City's water supply is very limited, it may declare, by resolution, a Stage II water shortage.
(b) 
Upon the City Council's declaration of a Stage II water shortage, the City Manager shall order that persons utilizing City water curtail any or all of the following less essential uses of water:
(1) 
The use of water to wash automobiles, trucks, trailers and any other type of mobile equipment, except in facilities operating with an alternate water source or with a water recycling system. Any facility operating with an approved recycling system must prominently display a sign stating that such a recycling system is in operation.
(2) 
The use of water to wash down streets, sidewalks, driveways, other hard-surfaced areas, buildings and other exterior structures.
(3) 
The watering of shrubbery, trees, lawns and other growing plants other than farm crops, except when using an alternate water source, recycled water or a water container not exceeding three gallons in capacity. Any such watering shall be limited to the hours between 8:00 p.m. and 10:00 a.m.
(4) 
The use of water in the operation of any ornamental fountain.
(5) 
The use of water from fire hydrants for construction purposes or any purpose other than fire suppression or other public emergency, except as may be authorized by the Director of Public Works upon specific request.
(6) 
The use of water to fill or refill swimming pools.
(7) 
The serving of drinking water in restaurants unless requested by the customer.

(a) 
Upon determination by the City Council that the City's water supply is critically limited, it may declare, by resolution, a Stage III water shortage.
(b) 
Upon the City Council's declaration of a Stage III water shortage, the City Manager shall order that persons utilizing City water curtail all of the kinds of water usage set forth in § 30-103(b).
(c) 
In addition, the City Manager may impose specific pro rata reductions in water supply of residential, business and institutional users based on each user's average water usage for the previous 12 months or for as many months as water service has been received, whichever is lesser.

The City Manager shall give public notice of restrictions on water usage or reductions in water supply by having printed a notice of same in a newspaper having general circulation in the City and by having broadcast a notice of same on a radio serving the City. Such restrictions in water usage or reductions in water supply shall become effective on the date of first written publication thereof.

In the event that the City Manager orders a reduction in water supply and a person uses an amount in excess of the amount allotted to such user, then such person shall pay a surcharge of $5 per 1,000 gallons or any portion thereof used in excess of such allotment. In addition, the City Manager may terminate such person's water service for the duration of the water shortage, and such person shall be subject to the penalties set forth in § 30-108.

Any person may apply to the City Council for an exception from the restrictions on water usage or the reductions in water supply ordered by the City Manager. City Council will consider such applications on a case by case method and will balance the economic or other hardship to the applicant against the individual and cumulative impact on the water supply resulting from the granting of such exception(s).

Any person violating any of the provisions of this article or any order of the City Manager made pursuant to § 30-104 or 30-105 shall be guilty of a Class 3 misdemeanor.

The City Manager may issue an order rescinding a previous order restricting water use or reducing the water supply and shall give public notice thereof as set forth in § 30-105 above. In addition, such order of rescission shall be reported to the City Council at its next scheduled meeting.
