Any owner of any tract of land in the City of Franklin, Virginia, who desires to subdivide the same shall cause a plat of such subdivision to be made in accordance with the regulations set forth in this ordinance and in accordance with the Code of Virginia, as amended from time to time, and shall cause a copy of said plat to be recorded in the Clerk's office of the Circuit Court of Southampton County.

No such subdivision plat shall be recorded unless and until it shall have been submitted to and approved by the City of Franklin Planning Commission (herein called "the commission") except that the zoning administrator may approve plats of minor subdivisions without submitting such plats to the commission, provided that such plats otherwise meet the requirements of this ordinance.

(a) 
No property in a subdivision created after December 21, 1956, shall be transferred or offered for sale, nor shall a building permit be issued for a structure thereon, until a final plat of such subdivision shall have been recorded in accordance with this article.
(b) 
No building permit may be issued for a structure on property in a subdivision created after December 21, 1956, until the improvements required to be installed by Article VI of this ordinance have been installed by the subdivider and approved by the director of public works, except that installation of the surface course asphalt, the required sidewalks, and streetlights may be delayed as agreed upon in the Subdivision Agreement.

(a) 
At the time that a plat of a minor subdivision is presented for approval by the zoning administrator, a fee of $100.00 plus $5.00 for each lot in the subdivision shall be paid to the city by the owner of the property being subdivided.
(b) 
At the time that a preliminary plat of a major subdivision is presented for approval by the commission a fee of $100.00 plus $5.00 for each lot in the subdivision shall be paid to the city by the owner of the property being subdivided.
(c) 
At the time that a final plat of a major subdivision is presented for approval by the commission a fee of $100 plus $5.00 for each lot in the subdivision shall be paid to the city by the owner of the property being subdivided.

(a) 
If, in the discretion of the Director of Public Works, it is determined that a review by the City's consulting engineering firm, or any other expert or other consultant is prudent and necessary to ensure that the subdivision plan is in compliance with the City's Zoning and Subdivision Ordinances, the City's development and construction standards, and other State and Federal laws, then the applicant submitting said subdivision plan shall be required to pay the fees and costs incurred for such review.
(b) 
Inspection fees for subdivision inspections and all off-site appurtenances shall be paid to the City by the owner of the property at an hourly rate of $35.00 for inspections completed by city forces. If, in the discretion of the Director of Public Works, it is determined that an inspection by the City's consulting engineering firm, or any other expert or other consultant is prudent and necessary to ensure that the construction is in compliance with the approved construction plans, then the developer shall be required to pay the fees and costs incurred for such inspection.
