The name of the Board described in this division is the Board of Building Code Appeals.

The purposes and duties for which the Board of Building Code Appeals has been established are:
A. 
Those set forth in Section 106 of the Virginia Uniform Statewide Building Code as incorporated in § 18-31.
B. 
To consider appeals from any persons aggrieved by decisions of the Building Official.
C. 
Those set forth in § 18-94, relating to enforcement of Volume II (the Building Maintenance Code) of the Virginia Uniform Statewide Building Code.
D. 
Those that are set forth in this Code, Chapter 10, Article II, Division 10, for the Fire Prevention Appeals Board.

A. 
The Board of Building Code Appeals shall consist of five members appointed by the City Council.
B. 
All persons appointed to the Building Code Appeals Board shall serve terms of five years. In order to provide for continuity, the terms of the members may be of different length so that less than half will expire in any one-year period.
C. 
To the extent such persons may be available, the Board shall consist of one individual from each of the following professions or disciplines:

(1) 
An experienced builder;
(2) 
A licensed professional engineer or architect;
(3) 
A registered design professional; and
(4) 
An experienced property manager.
D. 
The Director of the Community Planning and Building Department, the Building Official, inspectors, or other employees of the Community Planning and Building Department shall not serve as members of the Board.

The Building Code Appeals Board shall conduct its business in accordance with Section 106 of the Uniform Statewide Building Code, 2000 edition, as amended, and other applicable law. The Board shall adopt and make available to the public through its secretary the procedures under which hearings and appeals are heard.
