A. 
The districts established in these zoning regulations are designed to promote and protect public health, safety, comfort, convenience, prosperity and other aspects of moral and general welfare, thus encouraging the highest and best use of land and resources in accordance with a Comprehensive Plan as provided by the laws of the State of Missouri. These general goals include among others, the specific purpose of:
1. 
Providing sufficient space in appropriate locations for all types of land use in a manner that is harmonious and compatible.
2. 
Protecting and encouraging freedom from undue exposure to fire, explosions, toxic and noxious matter, radiation, noise, vibration, smoke, heat, glare, and other objectionable matter and influences.
3. 
Providing appropriate locations where necessary, objectionable or dangerous uses may operate without undue restrictions.
4. 
Protecting against congestion by regulating density of population, bulk of buildings and by encouraging the use of land in a manner which will provide for light, air and open space.
5. 
Protecting all zoning districts, but especially residential districts against heavy and undue vehicular traffic.
6. 
Providing freedom of architectural design in order to encourage the development of more attractive and economic building forms.
7. 
Promoting and developing a strong economic base by protecting the character of individual districts thereby conserving the value of land, buildings and tax revenues.

A. 
The City is hereby divided into the following districts:
1. 
"I-2" Heavy Industrial District.
2. 
"I-1" Light Industrial District.
3. 
"B-3" Central Business District.
4. 
"B-2" General Business District.
5. 
"B-1" Local Business District.
6. 
"S & O" Public Service and Office District.
7. 
"R-3" Multi-Family Dwelling District.
8. 
"R-2" Two-Family Dwelling District.
9. 
"R-1" Single-Family Dwelling District.
10. 
"R-A" Agricultural District.
11. 
"P" Planned District.
12. 
"R-4" Manufactured Homes District.

A. 
Boundaries of the districts, as enumerated in Section 405.030 of this Article are hereby established as shown on the maps hereby designated as the "Zoning District Maps," and said maps and all the notations, references and information shown thereon are hereby made as much a part of this Chapter as if the same were set forth in full herein. It shall be the duty of the City Clerk to keep on file in his/her office an authentic copy of said map, all changes, amendments or additions thereto, and duplicate copies thereof shall be kept on file in the office of Community Development.
B. 
When definite distances in feet are not shown on the Zoning District Maps, the district boundaries are intended to be along centerlines of the existing street, alley or plotted lot lines or extensions of the same, and if the exact location of such line is not clear, it shall be determined by the Community Development Director, due consideration being given as indicated by the scale of the Zoning District Map.
C. 
When the streets or alleys on the ground differ from the streets or alleys as shown on the Zoning District Maps, Community Development Director may apply the district designations on the map to the streets or alleys on the ground in such manner as to conform to the intent and purpose of this Chapter.
D. 
Whenever any street or alley is vacated, the particular district in which the adjacent property lies shall automatically be extended to the centerline of any such alley or street.
E. 
All territory hereafter annexed shall be given the same district classification as currently specified on the Zoning District Map of Ray County.

A. 
"I-2" Heavy Industrial District.
1. 
Purpose. District "I-2" is intended primarily for major basic manufacturing industries and related industrial activities. Many of these industries characteristically store bulk quantities of raw or scrap material for processing to semi-finished products. Commercial uses in this district are generally those which serve the convenience of industrial establishments and their employees. Residential uses are not compatible with this environment and are not included in order that the district may be reserved for its intended heavy industrial purpose.
2. 
Permitted Uses. The following uses shall be permitted in "I-2" District.
a. 
Any use permitted in the "I-1" Districts.
b. 
Any of the following uses unless they are within five hundred (500) feet of any residential properties, in such event a conditional use permit shall be required.
c. 
Manufacturing and storage of products, including, but not limited to, glass; roofing and other construction materials; vehicle, aircraft or other heavy equipment; cement, asphalt or other paving materials; and uses classified as a High-Hazard Group H occupancy as determined by the International Building Code except those uses listed as a Conditionally Permitted Use as listed below.
d. 
Tow lots with adequate fencing as per Section 405.210.
e. 
Metal, wire and metal or wire products manufacturing.
f. 
Recycling or reprocessing of plastics, glass, metals, and batteries.
g. 
Electric generation plants, electric utility maintenance yard, permanent concrete or asphalt manufacturing or mixing plants.
h. 
Fire protection and related activities.
3. 
Conditionally Permitted Uses. The following uses may be conditionally permitted provided they obtain a conditional use permit in accordance with Section 400.340 and comply with Article III Conditional Uses of this Code:
a. 
Agricultural chemicals and fertilizer manufacturing, retail sale of hazardous chemicals or fertilizers, wholesale liquid petroleum gas, explosives, bulk petroleum stations and terminals, corrosive materials, storage or manufacturing.
b. 
Mining, quarrying of gravel, sand or stone.
c. 
Sanitary landfills.
d. 
Stockyards, slaughterhouse or meat processing.
e. 
Solid waste transfer stations or recycling station where all materials are contained in an enclosed trailer or building; composting plants.
f. 
Airports, airstrips, helipads.
g. 
Telecommunication Facilities.
h. 
Scientific research services and facilities, the testing of live animals is prohibited.

Accessory Uses. Accessory uses customarily incidental to permitted uses and otherwise conforming to the provisions contained in Section 405.210.
B. 
"I-1" Light Industrial District.
1. 
Purpose. District "I-1" is intended primarily for those manufacturing industries and related industrial activities in which the production performance of the manufacturing industries characteristically produces a finished product from semi-finished materials, but requires little or no outside material storage. The effect of the production process upon surrounding areas is normally that of the traffic generated by the receipt and delivery of goods and materials. Commercial uses in this district are generally those which serve the convenience of industrial establishments and their employees. Residential uses are not compatible with this environment and are not included in order that the district may be reserved for its intended light industrial purpose.
2. 
Permitted Uses. The following uses shall be permitted in "I-1" Districts.
a. 
Any wholesale establishment which provides supplies and/or services primarily to commercial and industrial customers, such as janitorial services, sign shops, packaging or shipping service, locksmith or printing, lithographing, engraving, photocopying, blueprinting, publishing and binding establishments.
b. 
Any manufacturing, production, processing, cleaning, servicing, testing, repair or storage of materials, goods, products or food products and business and sales offices accessory thereto.
c. 
Any non-residential use allowed in the "B-1," "B-2," and "B-3" Districts, including any office/retail/warehouse combinations, provided not more than twenty-five percent (25%) of the gross building floor area shall be used for retail activities; and the outdoor storage of manufactured materials or products provided all outside storage is screened from any public right-of-way.
d. 
Heavy equipment and machinery, farm equipment, commercial truck and tractor sales, rental and service.
e. 
Fire protection and related activities.
f. 
Comprehensive Marijuana Cultivation Facility, Microbusiness Wholesale Facility, Medical Marijuana Cultivation Facility (Indoor Only).

3. 
Conditionally Permitted Uses. The following uses may be conditionally permitted provided they obtain a conditional use permit in accordance with Section 400.340 and comply with Article III Conditional of this Code:
a. 
Electric generation plants, electric utility maintenance yard, permanent concrete or asphalt manufacturing or mixing plants, prisons, mining, quarrying of gravel, sand or stone.
b. 
Telecommunication Facilities.
c. 
Sewage and water treatment Facilities.

C. 
"B-3" Central Business District.
1. 
Purpose. District "B-3" is intended primarily for major business services and retail business activity related to the core of the central business district serving the metropolitan trade area. The high volume of pedestrian movement generated within this district will be facilitated as much as possible by the separation of pedestrian and vehicular traffic.
2. 
Permitted Uses. The following uses shall be permitted in "B-3" Districts.
a. 
Restaurants, bars, pubs and other drinking establishments; and entertainment venues such as bowling alleys, billiard halls, arcades and reception halls.
b. 
Retail establishments, including, but not limited to, art studios, general stores, convenience stores, gasoline and service stations, liquor stores, department stores, small appliance and electronic sales and service, lumberyards, hardware stores and other general retail and service establishments.
c. 
Pest control services, electrical, plumbing, HVAC and general contractor offices and shops; small manufacturing operations that serve a retail or general sales outlet in the same premises such as bakeries, brew pubs, candy or confectioneries, florists, picture frame manufacturing, repair and sales, cabinetmakers, printing shops, sign shops, home decor product manufacturing and other similar, low impact manufacturing operations that primarily serve a retail outlet at the same location.
d. 
Schools, day cares and office uses, including, but not limited to, doctors, chiropractors, accountant and tax preparation, legal, planning, engineering or surveying, insurance, travel agencies, and other similar services.
e. 
Fire protection and related activities.
f. 
Any uses allowed within "B-1" and "S & O" Zoning.
3. 
Conditionally Permitted Uses. The following uses may be conditionally permitted provided they obtain a conditional use permit in accordance with Section 400.340 and comply with Article III Conditional Uses of this Code:
a. 
Product wholesalers, warehousing and storage not an accessory use to an otherwise permitted use.
b. 
Residential Structure per Section 405.160.
c. 
Firearms and ammunition.
d. 
Substance Abuse Rehabilitation.
e. 
Telecommunication Facilities.
4.

D. 
"B-2" General Business District.
1. 
Purpose. District "B-2" is intended primarily for general trades and commercial services located at specific points on major thoroughfares outside of central or local business districts. This district is particularly appropriate adjoining a major highway. Such an area draws highway uses such as restaurants, service stations and motels, which are not totally compatible with shopping center developments but which may be grouped together quite advantageously as highway service centers. Residential uses are not included in this district.
2. 
Permitted Uses. The following uses shall be permitted in "B-2" Districts.
a. 
Any use allowed in the "B-1" and "S & O" District and retail trade, business and professional offices, not listed in the "B-1" District.
b. 
Automobile sales, service, storage, and rental uses; retail sale or rental of building materials, light construction equipment, farm machinery and equipment, electrical, mechanical, plumbing and HVAC supplies; and repair services for such automobile, farm or light construction equipment.
c. 
Banks; research, development, laboratory and testing services; copying and printing services that have a retail component, open to the public at the facility; gasoline service stations; retail sales of tobacco, package liquor, beer, wine or other alcohol; restaurants, bars, pubs and taverns.
d. 
Hospital services; churches; hotels, motels, tourist courts; schools.
e. 
Fire protection and related activities.
f. 
Comprehensive Marijuana Dispensary Facility, Microbusiness Dispensary Facility, Medical Marijuana Dispensary Facility.

3. 
Conditionally Permitted Uses. The following uses may be conditionally permitted provided they obtain a conditional use permit in accordance with Section 405.090 of this Code:
a. 
Amusement parks, go-cart tracks, animal and vehicle racetracks, golf driving ranges.
b. 
Heliport pads, prisons, telecommunications towers.
c. 
Trash services, truck washing services.
d. 
Kennels; Breeding and boarding.
e. 
Telecommunication Facilities.

E. 
"B-1" Local Business District.
1. 
Purpose. District "B-1" is intended primarily for retail trades and convenience services related to a limited trade area providing neighborhood shopping accommodations. Businesses which generate traffic in volumes beyond local traffic requirements are generally not included in this district. Parking accommodations are a premium requirement since the private automobile is the dominant mode of transportation. The district is generally located at intersecting streets, at least one (1) of which is a major street.
2. 
Permitted Uses. The following uses shall be permitted in "B-1" Districts.
a. 
Art studios and galleries; bed and breakfast establishments (as per Section 405.140); clubhouses for non- or for-profit organizations; limited repairs services, such as jewelry, small appliance, and business machine repair shops; personal service establishments such as barber and beauty shops, shoe repair, tailor shops, dance, music and drama schools, dry cleaning pick-up stations and self-service laundry facilities; restaurants, bakeries, coffee shops, cafes, delicatessens, ice cream parlors, and catering services. Food service establishments may serve alcoholic beverages as an incidental and accessory use only; retail businesses, such as food and grocery stores, drugstores, apparel shops, variety stores, hardware stores, antique shops, florists, or book shops.
b. 
Commercial picnic groves, campgrounds, or fishing lakes, including concessions; health and athletic clubs, tanning salons, racquet and sports clubs, and commercial swimming pools; lawn and garden nurseries, garden shops, and greenhouses.
c. 
Museums, libraries, community buildings.
d. 
Parking lots servicing adjacent uses only.
e. 
Fire protection and related activities.
f. 
Permitted uses within "S & O" Districts.
3. 
Conditionally Permitted Uses. The following uses may be conditionally permitted provided they obtain a conditional use permit in accordance with Section 400.340 and comply with Article III Conditional Uses of this Code:
a. 
Bars, brew pubs, taverns and other drinking establishments.
b. 
Drive-up services and vehicle fueling and service stations, subject to both the site plan review process, and the following additional performance standards:
(1) 
No merchandise or equipment which is displayed outside of a building shall be kept outside beyond the hours of operation of such business, kept off the public sidewalk or street right-of-way, not reduce the capacity of a parking lot beyond the minimum(s) required by this Chapter, and not exceed an area greater than twenty percent (20%) of the ground floor area of the building.
(2) 
Not more than two (2) separate pumping stations for fuel stations shall be installed on such property and in no event shall any such pumping station be within one hundred (100) feet of any building used in whole or part for residential purposes.
c. 
Residential as per Section 405.160.
d. 
Telecommunications Facilities.
e. 
Adult Businesses.
f. 
Bed and Breakfast establishments as per Section 405.140.

F. 
"S & O" Service And Office District.
1. 
Purpose. District "S & O" is intended to provide areas for public, semi-public, institutional, professional and office types of uses. Density or intensity of use may be considered similar to the "R-3" District. The primary difference between this and the "R-3" District is that this zone is primarily used to allow for uses which provide a direct service to the total community without being in conflict with its residential neighbors.
2. 
Permitted Uses. The following uses shall be permitted in "S & O" Districts.
a. 
Office buildings to be used for professional and administrative functions of companies, corporations, social or philanthropic organizations or societies.
b. 
Trade schools, business colleges or other specialty schools that do not generate traffic from patrons other than those enrolled at such school.
c. 
Large day care home and day nurseries.
d. 
Fire protection and related activities.
e. 
Bed and breakfast as listed in Section 405.140.
3. 
Conditionally Permitted Uses. The following uses may be conditionally permitted provided they obtain a conditional use permit in accordance with Section 400.340 and comply with Article III Conditional Uses of this Code:
a. 
Parking lots for adjacent multi-unit residential dwellings, hotels, clubs, motels, and accessory uses to such businesses; or for hospitals, churches, and institutions when such use is adjacent to or within three hundred (300) feet of the main use.
b. 
Radio, television, broadcasting and recording studios. Associated towers and antennae for radio and television studios shall meet the additional requirements for such use, as contained in the conditional use permit provisions of this Chapter.
c. 
Residential as per 405.160.

G. 
"R-3" Multi-Family Dwelling District.
1. 
Purpose. District "R-3" is intended primarily to accommodate non-elevator or walk-up type apartment buildings located generally in or adjacent to central areas of the City in proximity to principal areas of development and commercial activity or in convenient relation to outlying major thoroughfares and outlying business centers.
2. 
Permitted Uses. The following uses shall be permitted in "R-3" Districts.
a. 
Single-, two- and multi-family dwellings.
b. 
Fire and police protection and related activities.
c. 
Historic sites and monuments.
d. 
Parks, playgrounds, primary and secondary schools.
e. 
Retirement, convalescent, nursing and rest homes; convents, monasteries, churches, orphanages, schools, dormitories, fraternity and sorority houses; boarding and rooming houses.
3. 
Conditionally Permitted Uses. The following uses may be conditionally permitted provided they obtain a conditional use permit in accordance with Section 400.340 and comply with Article III Conditional Uses of this Code:
a. 
Recreational and entertainment uses, including amphitheaters, athletic fields, campgrounds, country clubs, golf courses and driving ranges, fairgrounds, recreation centers, resorts, riding stables, swimming clubs, tennis clubs and zoos.
b. 
Social facilities, including museums; charities; colleges and universities (public and private); educational and scientific research services; libraries; schools for primary, secondary, vocation and higher education, day cares with more than five (5) children.
c. 
Public health and safety facilities, including clinics, health centers, hospitals and counseling, treatment and correctional centers.
d. 
Transportation, communication and utility facilities, including electrical power stations and substations; railroad stations, depots and maintenance facilities, so long as adjacent to an existing railroad line; postal services; sewage treatment plants; telephone exchange stations and relay towers; and towers for communications transmission.

H. 
"R-2" Two-Family Dwelling District.
1. 
Purpose. District "R-2" is intended primarily to accommodate one- or two-family detached dwellings and related residential activities. This district is located generally in more central areas of the City peripheral to higher density multi-family apartment or business districts or in limited outlying areas of the City peripheral to apartment districts or business centers. The district is intended to accommodate a moderately high population density for these types of dwelling units.
2. 
Permitted Uses. The following uses shall be permitted in "R-2" Districts.
a. 
Detached single-family and attached two-family dwellings.
b. 
Fire and police protection and related activities.
c. 
Historic sites and monuments.
d. 
Parks, playgrounds, primary and secondary schools, day cares with four (4) or less children, churches.
3. 
Conditionally Permitted Uses. The following uses may be conditionally permitted provided they obtain a conditional use permit in accordance with Section 400.340 and comply with Article III Conditional Uses of this Code:
a. 
Cemeteries and mausoleums.
b. 
Museums, libraries, day cares with no more than ten (10) children.
c. 
Amphitheaters, athletic fields, golf courses, tennis, handball, squash and basketball courts.

Purpose. District "R-1" is intended primarily for one-family detached dwelling units and related residential activities which are in general peripherally related to higher density and more centrally located residential areas or may be peripherally related to more limited outlying higher density districts or business centers. The district is intended to accommodate a moderate population density for this type of dwelling unit or medium size lot areas.
2. 
Permitted Uses. The following uses shall be permitted in "R-1" Districts:
a. 
Detached, single-family dwellings.
b. 
Fire and police protection and related activities.
c. 
Historic sites and monuments.
d. 
Parks, playgrounds, primary and secondary schools, churches.
3. 
Conditionally Permitted Uses. The following uses may be conditionally permitted, provided they obtain a conditional use permit in accordance with Section 400.340 and comply with Article III, Conditional Uses, of this Code:
a. 
Cemeteries and mausoleums.
b. 
Museums, libraries, home daycare/child care centers with not more than ten (10) children.
c. 
Athletic fields, golf courses, tennis, handball, squash and basketball courts.

Exemption for Previously Platted or Recorded Lots. The minimum lot size standards shall not be interpreted as prohibiting the construction of a detached single-family dwelling unit, in accordance with all other applicable regulations, on a lot that was legally platted or recorded before the adoption of this Section by Ordinance No. 2470 on November 13, 2018, so long as the lot size and dwelling unit meet the following design and performance standards:

a. 
Single-family dwellings shall have a minimum of nine hundred (900) square feet of habitable floor area, excluding basements, garages, attics and other areas not designed for living space.
b. 
All accessory structures, including, but not limited to, garages, carports, sheds, and gazebos must be located in the rear yard, be no less than three (3) feet from side and rear property lines and have a maximum height of twelve (12) feet at side wall.
c. 
A minimum of two (2) off-street parking spaces shall be provided for each single-family dwelling and conform to design standards as provided by Chapter 406.
d. 
The scale, placement on the site, and street setback must conform to the scale, placement, and setback of adjacent structures. Styles of architecture must ensure that exterior design and materials are in harmony with neighboring structures and neighborhood.
J. 
"R-A" Agricultural District.
1. 
Purpose. District "R-A" is intended primarily for use in areas of the City on the outer edge of the urbanized development. More intense urban usage is usually premature in this district due to lack of adequate utility services or transportation systems. It is likely that this district will be changed to more intense urban zoning districts as utility services can be feasibly extended and the undeveloped areas within existing service limits are used up or become in short supply. Uses within this district are mostly related to farming or semi-urban functions and are not necessarily compatible with higher density residential development.
2. 
Permitted Uses. The following uses shall be permitted in "R-A" Districts.
a. 
Pastures for grassland and livestock grazing.
b. 
Single-family dwellings.
c. 
Animal husbandry in conjunction with a single-family dwelling as per Section 405.200:
(1) 
Minimum Required Acreage: thirty thousand (30,000) square feet.
(2) 
The slaughter of animals, such as poultry, rabbits, or beef cattle is permitted only where intended for consumption by the resident family or to be gifted.
(3) 
Animals other than household pets shall not be kept within a residence, or within one hundred (100) feet of a residence or within sixty (60) feet of the front property line of the building site.
(4) 
Housing or caging of animals shall be adequate and sanitary, and subject to all State health requirements for health and sanitation. All animal food except for hay and straw shall be stored in rodent-proof containers. Should any "R-A" property rezoned to another use where animal husbandry is not a permitted use, any such use therein shall cease within one (1) year from the effective date of the rezoning.
d. 
Public parks, playgrounds, tot lots or play lots.
e. 
In-home day cares with five (5) or fewer children.
f. 
Religious, educational and social facilities, including museums; charities; accessory buildings associated with houses of worship; colleges and universities (public and private); educational and scientific research services; libraries; schools for primary, secondary, vocational and higher education.
3. 
Conditionally Permitted Uses. The following uses may be conditionally permitted provided they obtain a conditional use permit in accordance with Section 400.340 and comply with Article III Conditional Uses of this Code:
a. 
Recreational and entertainment uses, including athletic fields, campgrounds, golf courses and driving ranges, riding stables, and zoos.
b. 
Residential uses, including bed and breakfasts; in-home day care/child care centers for not more than ten (10) children.
c. 
Public health and safety facilities, including Armed Forces installations, armories, clinics, firehouses, health centers, hospitals and police stations.
d. 
Transportation, communication and utility facilities, including electrical power stations and substations; railroad stations, depots and maintenance facilities, so long as adjacent to an existing railroad line; postal services; sewage treatment plants; telephone exchange stations and relay towers; and towers for communications transmission.
e. 
Other service uses including cemeteries, pet cemeteries, funeral houses.
f. 
Private airport runways.
g. 
Telecommunication Facilities.

K. 
"P" Planned District. Purpose. District "P" is intended for the purpose of permitting and regulating the zoning districts previously cited in this Chapter (i.e., "R-A-P" through "I-2-P," inclusive), to provide for the implementation of urban design standards, and to provide latitude and flexibility in the location of buildings, structures, open spaces, play areas, parking, roads, drives, and variations in setback and yard requirements.
L. 
"R-4" Manufactured Homes District/Recreational Vehicle Park.
1. 
Purpose. District "R-4" is intended primarily for low-density single-family manufactured home use to be developed in a park-like atmosphere.
2. 
Permitted Uses. The following uses shall be permitted in the "R-4" Districts.
a. 
Manufactured homes.
b. 
Fire and police protection and related activities.
c. 
Historic sites and monuments.
d. 
Parks, playgrounds, primary and secondary schools, churches.
3. 
Conditionally Permitted Uses. The following uses may be conditionally permitted provided they obtain a conditional use permit in accordance with Section 400.340 and comply with Article III Conditional Uses of this Code;
a. 
Cemeteries and mausoleums.
b. 
Museums, libraries, day cares with less than ten (10) children.
c. 
Athletic fields, golf courses, tennis, handball, squash and basketball courts.
d. 
Recreational Vehicle Use.
4. 
Density Regulations.
a. 
District Regulations. In "R-4," no structure or land shall be placed, altered or enlarged, which is arranged, intended, or designed for other than one (1) of the uses listed in the Use Regulations.
b. 
Use Limitations.
(1) 
Single-family resident.
(2) 
Churches, synagogues, and other similar places of worship.
(3) 
Day care homes.
(4) 
Home occupations.
(5) 
Accessory structures (See Article on Supplementary District Regulations).
c. 
Use Regulations.
(1) 
Recreational vehicles shall not be set up or occupied as a dwelling.
(2) 
Manufactured home sales lot shall not be permitted.
(3) 
Signs shall not be permitted, unless required by law.
(4) 
One (1) principal structure per lot.
d. 
General Requirements For Manufactured Home Development. For the purpose of "R-4" Manufactured Home Development in the following Sections, the term "street" will mean private street (a private street is a street that will not be dedicated to or accepted by the City as a City street, nor is the responsibility of the City to maintain).
(1) 
Development shall have a minimum area of five (5) acres.
(2) 
Development shall have a single tract of land under one (1) ownership.
(3) 
A surveyed plot plan shall be made to include, but not be limited to:
(a) 
Sewer.
(b) 
Water.
(c) 
Landscaping.
(d) 
Spaces for manufactured homes.
(e) 
Fencing.
(f) 
Street.
(g) 
Parking.
(4) 
The development must have a storm sewer drainage and detention plan.
(5) 
All utilities, storm sewer and detention plans must be recommended by the Commission to the City Council for approval.
(6) 
Laundry facilities may be provided in a service building.
(7) 
Minimum frontage shall be one hundred (100) feet and located on a major thoroughfare. Principal ingress and egress shall be from said frontage.
e. 
Design Requirements For Manufactured Home Development.
(1) 
Street.
(a) 
Shall be a minimum of twenty-eight (28) feet in width, constructed of asphalt or concrete.
(b) 
Shall have concrete curb and gutter.
(c) 
Shall have adequate lighting.
(2) 
Porches, steps and ramps shall be constructed and placed according to the following, but not limited to:
(a) 
City Building Code.
(b) 
Steps shall be placed at every means of egress.
(3) 
Walkways.
(a) 
Shall not be less than thirty (30) inches in width and of poured concrete.
(b) 
Shall be provided from the front steps of each unit to the driveway for that unit.
(c) 
A sidewalk of at least thirty (30) inches shall be constructed along one (1) side of each street within the manufactured home development and may or may not adjoin the curb of each street.
(4) 
Fencing.
(a) 
Shall be required along all exterior boundaries.
(b) 
Construction of fences shall meet all City requirements (see Article on Supplementary District Regulations).
(c) 
Not less than five (5) feet in height, having a density of not less than seventy percent (70%).
(5) 
Landscaping.
(a) 
A ten-foot landscape buffer along all exterior boundaries, which shall consist of trees, shrubs, evergreens and grass.
(b) 
All yards (front, side and rear) shall be seeded and mulched.
(c) 
All structures (new, remodeled and additions) shall obtain appropriate permits.
(6) 
All structures shall be placed according to the following, but not limited to:
(a) 
City Building, Electrical, Plumbing, Mechanical and Fire Code.
(i) 
Placed on a permanent foundation or piers.
(ii) 
Ground anchors.
(iii) 
Skirting.
(iv) 
Shall conform to all applicable codes.
(b) 
Building setbacks.
(7) 
No accessory structure shall be erected in any required front or side yard.
(8) 
Parking.
(a) 
Off-street parking must be provided.
(b) 
Two (2) parking spaces per housing unit.
(c) 
A required off-street parking space shall be paved with a hard surface (asphalt or concrete.)
(d) 
A required off-street parking space shall be at least nine (9) feet in width and at least twenty (20) feet in length.
(9) 
Only resident owners may offer homes for sale in the development.
(10) 
When abutting any single-family residential district, no manufactured home or building shall be permitted within thirty (30) feet of said abutting district.
(11) 
An underground storm shelter(s) shall be provided which is sufficient to accommodate two (2) persons per manufactured home and shall be located throughout said development so that no manufactured home is more than six hundred sixty (660) feet away from an underground storm shelter.
f. 
Intensity Of Use Regulations — Manufactured Home Development. Except as hereafter provided, all structures hereafter placed, enlarged, relocated, or reconstructed shall be located upon lots containing the following areas.
(1) 
Each space shall contain an area of not less than five thousand (5,000) square feet for single-wide, six thousand (6,000) square feet for double-wide.
(2) 
Each space shall be clearly marked and must have a minimum street frontage of forty (40) feet; corner lots shall not be less than sixty (60) feet in width.
(3) 
No lot shall be less than one hundred (100) feet in depth.
(4) 
No manufactured home shall be located closer than twenty (20) feet from any property line bordering the manufactured home development.
(5) 
Minimum building setbacks shall be provided on each manufactured home space measured from the space boundaries as shown on the manufactured home development site plan, as follows:
(a) 
Minimum front yard: fifteen (15) feet.
(b) 
Minimum rear yard: ten (10) feet.
(c) 
Minimum side yard: ten (10) feet.
(6) 
Each manufactured home shall be skirted within thirty (30) days after placement in a development by enclosing the open area under the unit with a metal or synthetic material that is compatible with the exterior finish of the manufactured home.
g. 
Parking Regulations. Two (2) parking spaces per manufactured home.
h. 
Sign Regulations. Sign shall not be permitted unless required by law.
i. 
Business License Required. A business license shall be required by the Manufactured Home Development from the City Collector of the City of Richmond.
j. 
Register Of Occupants Required. It shall be the duty of each licensee to keep in the park office a register containing a record of all manufactured home owners and occupants located within the manufactured home development. The register shall contain the following information:
(1) 
The name and address of each manufactured home occupant.
(2) 
The name and address of the owner of each manufactured home.
(3) 
The make, model, year and license number of each manufactured home and motor vehicle and the State, territory or country issuing such license.
(4) 
The date of arrival and departure of each manufactured home.
(5) 
Whether or not each manufactured home is a dependent or independent manufactured home.
