A. 
Establishment of barricade. A permanent barricade across Mathews Avenue shall be established in the area of the Wilma Quinlan Nature Center and shall be constructed of such materials and in such a fashion that emergency vehicles can drive over or through the area of the barricade without endangering persons or property. The Borough Traffic Engineer and/or Borough Engineer shall present a proposed design or design options for the form of barricade to Borough Council for consideration and adoption by resolution. The sawhorse barricades utilized during the sixth-month trial period shall remain in place unless and until they are replaced by another barricade system pursuant to this subsection. All of the terms and conditions of this article apply to the existing sawhorse barricades as well as to any new barricade system installed hereunder.
B. 
Establishment of signage. Signage consistent with PennDOT signage regulations warning traffic of the road blockage shall be posted at all approaches to Mathews Avenue.
C. 
Violation and penalties. No vehicles, other than emergency vehicles, shall attempt to avoid the barricade by driving through the barricaded area or by driving off the road surface or partially off the road surface around the barricade. Any driver, other than a driver of an emergency vehicle, who drives or attempts to drive around the barricade by driving off the road surface or partially off the road surface around the barricade or who drives through the barricaded area by physically moving the barricade or by driving through or over the barricade or who attempts to do so, commits a summary offense and, upon conviction thereof, shall be liable to pay a fine of not more than $300 and/or to undergo imprisonment for up to 90 days. This provision establishing a summary offense for traveling around or through the barricaded area shall not prevent law enforcement officers from citing offenders with any appropriate violations of the Pennsylvania Vehicle Code, including but not limited to violations of traffic control devices, Title 75 Pa.C.S.A. § 3111. Nor shall promulgation of this article prevent law enforcement officers from citing offenders hereunder for the destruction of Borough property or for any other appropriate offenses pursuant to the Pennsylvania Crimes Code, 18 Pa.C.S.A. § 101 et seq.
