Section 500.080 Plumbing Code — Adopted.

A certain document, one (1) copy of which was on file in the office of the City Clerk of the City of Wentzville, Missouri, for at least ninety (90) days before adoption of this Section, and shall remain on file in the office of the City Clerk of the City of Wentzville, Missouri, after adoption of this Section being marked and designated as the 2015 International Plumbing Code, Second Printing (May 2015), be and is hereby adopted as the Plumbing Code of the City of Wentzville, Missouri, and made a part of this Section as if fully set forth herein. This Code shall apply to all commercial structures as provided under the International Building Code.

Section 500.085 Plumbing Code — Jurisdictional Titles.

Throughout the Plumbing Code adopted in Section 500.080 wherever the term "Name of Jurisdiction" or "Local Jurisdiction" appears, it shall be deemed to mean the City of Wentzville, Missouri.

Section 500.090 Plumbing Code — Code Official Titles.

Throughout the Plumbing Code adopted in Section 500.080 whenever the term "Code Official" or "Plumbing Code Official" appears, it shall be deemed to mean the Building Official.

Section 500.097 Plumbing Code — Amendments.

The 2015 International Plumbing Code, Second Printing (May 2015), as it applies to commercial structures is amended by the following provisions. Each Section, Subsection or Clause of the Code that numerically corresponds to one (1) of the following numbered provisions is hereby deleted where so noted, or amended to read as set forth below. Each provision set out below without a corresponding Section, Subsection or Clause number in the Code is hereby enacted and added thereto.
101.1 Title, Amend: These regulations shall be known as the International Plumbing Code of the City of Wentzville, Missouri, hereinafter referred to as "this Code."
106.6.2 Fee Schedule. Delete in entirety and insert: The fees for all plumbing work shall be in accordance with the adopted Fee Ordinance established by the City of Wentzville.
106.6.3 Fee Refunds. Delete in entirety and insert: Fee refunds shall be in accordance with the adopted Fee Ordinance established by the City of Wentzville.
108.4 Violation Penalties. Delete in entirety and insert: Penalties for violating this Code shall be as directed in Section 500.115.
108.5 Stop Work Orders. Insert in the space provided: "fifty dollars ($50.00)," "five hundred dollars ($500.00)."
312.9 Shower Liner Test. Delete.
403.2 Separate Facilities. Delete: "fifteen (15) or less" and insert: "thirty-five (35) or less."
Section 403.6 Public Facilities. Customer facilities are not required in building or tenant spaces with a customer occupancy load of fifteen (15) or less which do not serve food or beverages. All gas or filling stations shall have public toilet rooms regardless of the occupancy load. Public toilet facilities shall be located not more than one (1) story above or below the space required to be provided with public toilet facilities and the path of travel to such facilities shall not exceed a distance of five hundred (500) feet (152 m).
Section 604.9 Water Hammer. The flow velocity of the water distribution system shall be controlled to reduce the possibility of water hammer. A water-hammer arrestor shall be installed where quick-closing valves are utilized. Water-hammer arresters shall be required for dishwashers, clothes washers and for each bathroom group, unless otherwise approved.
918.3 Air Admittance Valves. Where permitted: insert: All air admittance valves shall be installed at the discretion of the Building Code Official where unusual structural conditions exist.

Section 500.100 Persons Authorized to Do Work.

A. 
Any contractor providing plumbing contracting service within the corporate limits of the City of Wentzville, Missouri, shall first be duly examined and licensed by St. Charles County and/or St. Louis County.
B. 
No person having obtained a license under the provisions of this Code shall allow their license to be used by another person either for the purpose of obtaining permits or for doing business or work under the license.

Section 500.115 Penalty.

A. 
Any person violating any of the provisions of the Code adopted in this Article shall be deemed guilty of an offense and upon conviction thereof the court shall not assess a fine, if combined with the amount of court costs, totaling in excess of:
1. 
Two hundred dollars ($200.00), if the defendant has committed no Municipal Code violations within twelve (12) months prior to the violation for which the defendant is to be sentenced;
2. 
Two hundred seventy-five dollars ($275.00), if the defendant has committed one (1) Municipal Code violation within twelve (12) months prior to the violation for which the defendant is to be sentenced;
3. 
Three hundred fifty dollars ($350.00), if the defendant has committed two (2) Municipal Code violations within twelve (12) months prior to the violation for which the defendant is to be sentenced; or
4. 
Four hundred fifty dollars ($450.00), if the defendant has committed three (3) or more Municipal Code violations within twelve (12) months prior to the violation for which the defendant is to be sentenced.
B. 
The Court shall not sentence a person to confinement for violating any of the provisions of the Code adopted by this Article. Each day such violation continues or is permitted to continue shall constitute a separate offense and shall be punishable as such hereunder.
