A.
Any
person(s), corporations, LLC, partnership or legal entity of any kind
in building a residential home in the City of Truesdale, shall contain
a minimum living space of one thousand (1,000) square feet excluding
garage and basement.
B.
Any
person or entity that violates this Section shall be subject to a
civil injunction and/or a lawsuit in equity and/or a fine of up to
three hundred dollars ($300.00) per day for violation of this Section.
C.
Each
and every day that any of the provisions of this Section are violated
shall be subject to repeat fine, suits, attorney fees and costs.

A.
No
person, corporation or entity of any kind, including any governmental
entity, shall build, construct or place a commercial building, residential
house, modular, mobile home or trailer within the City limits of the
City of Truesdale without first submitting a site plan and obtaining
a permit.
B.
The
permit is necessary to ensure the proper sewer, water, electrical
and gas connections are made and to overall ensure that all City ordinances,
as well as Federal, State and County laws, have been met.
C.
Penalty. Any persons or entity (person or entity shall include
a partnership, limited liability company, corporation or governmental
entity) found to have violated any of the provisions of this Article
shall be subject to a civil injunction and/or suit in equity and the
City may recover its costs, including attorney fees, if meritorious,
and upon conviction in Municipal Court, a fine of from five dollars
($5.00) to three hundred dollars ($300.00) for each offense. Each
and every day that any of the provisions of this Article are violated
shall be subject to repeat fines, suits, attorney fees and costs.

A.
All
construction within the City limits of Truesdale must be accomplished
in accordance with the International Regional Code (IRC) 2003 and
the City's standards. The applicant for all construction is required
to submit plans showing the details of the construction, including,
but not limited to, the size, the plans, type of material to be used,
and if the material is new or used. A plot plan showing the area of
the construction should also be included. An approved permit must
be obtained and all fees paid prior to any construction on the project.
City inspections will be performed by the Board members appointed
or their representative. Engineer Building Inspector inspections will
be performed by a competent person or persons hired by the Board of
Aldermen for this purpose. Any and all variance must be approved by
a majority of the Board of Aldermen. All permits and building fees
will be collected at the Truesdale City Hall, and it will be the City's
responsibility to pay the Building Inspector.

It shall be required to submit plans of the proposed porch or decks
and to obtain a permit.
a.
City permit. A City permit should be required for
the following:
(1)
A porch or deck that is sixty-four (64) square feet or less
in size, and
(2)
The height from the ground to the floor of the porch is thirty-six
(36) inches or less, and
(3)
The material being used is all new.

The City permit fee will be twenty-five dollars ($25.00) for
two (2) inspections. Additional cost could occur if additional inspections
are required.

b.
Building Inspector permit. A Building Inspector
permit shall be required for the following:
(1)
A porch or deck that is over sixty-four (64) square feet in
size, or
(2)
The height from the ground to the floor is over thirty-six (36)
inches, or
(3)
The material is being used is not new.

The Building Inspector permit will be two hundred dollars ($200.00)
for two (2) inspections. Additional cost could occur if additional
inspections are required.

2.
It shall be required to submit the information concerning the sheds,
garages and carports.
a.
City permit. A City permit would be required for:
(1)
A single-story storage shed twelve (12) feet by twelve (12)
feet or smaller, or a carport ten (10) feet by twenty (20) feet or
smaller that are pre-fabricated and erected on site without electricity.

The City permit fee will be twenty-five dollars ($25.00) for
two (2) inspections. Additional cost could occur if additional inspections
are required.

b.
Building Inspector permit. A Building Inspector
permit would be required for:
(1)
All sheds, garages and carports (regardless of size) with electricity,
or
(2)
All sheds, garages and carports that are building on site, or
if material for construction is used, or
(3)
The shed or garage is over twelve (12) feet by twelve (12) feet
in size or the carport is larger than ten (10) feet by twenty (20)
feet in size.

The Building Inspector permit fee will be two hundred dollars
($200.00) for two (2) inspections. Additional cost could occur if
additional inspections are required.

B.
It
shall be required to obtain a Building Inspector permit for manufactured
homes or modular homes within the City of Truesdale. The building
inspection fee will be one hundred dollars ($100.00) for two (2) inspections.
Additional cost could occur if additional inspections are required.
If home is placed on basement or foundation, then the home will be
inspected under the building codes.
C.
The
City of Truesdale has a fee of one hundred dollars ($100.00) for the
permit approving the placement of a mobile home or manufactured home
within the City of Truesdale.
D.
Deposit Required. A deposit of one hundred fifty dollars
($150.00) is required prior to any review of site plan and/or building
plan, except a City permit. If the project proceeds, the one hundred
fifty dollars ($150.00) will be deducted from the total fees. If the
project does not proceed, the one hundred fifty dollars ($150.00)
would be the fee charged for any work already performed by the City
of Truesdale or the Building Inspector.
E.

G.
No
corporation, LLC, partnership, entity, individuals or group of any
kind shall commence construction in any manner as set out in this
Section before obtaining a building permit. Any person(s) or entity
who violates this Section shall be subject to all civil remedies and/or
fines of one dollar ($1.00) to five hundred dollars ($500.00) and/or
jail sentence of one (1) day to ninety (90) days, and each day in
violation will be a separate violation and occurrences.
