Except as provided in § 103-26, examinations shall be required for any applicant under each of the following categories of registration: Master Electrician, Limited Electrician and Special Electrician. An application to take an exam shall be filed with the Chairman. Examinations for each type of license authorized by this chapter shall be administered within 45 days of any approved applications.

The Board shall approve the examinations and shall test, for
each type of license authorized by this chapter, the applicant's:

With respect to any examination administered by the Director of Human
Resources, prior to administration of an examination, the Board shall
approve an answer key setting forth the correct answers and, if applicable,
alternative correct solutions.

Except when an outside testing agency is administering examinations,
the Director of Human Resources or his/her designee shall grade the
examinations and report the results to the Chairman. Exams shall be
graded within five business days of the date they were taken. An applicant
will be notified of the result of the examination promptly thereafter.

With respect to any examination administered by the Director of Human
Resources, upon written request by an applicant within 20 days after
the date of notice of the examination results, the Board shall make
the examination and answers to the examination available to the applicant
for review.
Failure to pass the exam or to meet the necessary qualifications as required by § 103-15 or 103-16 shall be grounds for denial of a license under this chapter. In the event that an applicant fails two exams within one year, the applicant must wait one year from the date of the second exam before reapplying for a license. In the event an applicant passes the examination and is approved for licensure, the applicant shall pay the applicable licensing fees before the license shall be issued to the applicant.
If the Board denies a license to an applicant, the Board shall
set forth the reasons for such denial, in writing, and mail the same
to the applicant. Within 20 days after the date of mailing such notice
of denial, the applicant may, by written request, seek review of such
determination before the Board, to hear the evidence presented by
the applicant and may call witnesses. After such hearing before the
Board, the Board shall determine whether to sustain the denial or
issue the license. The Board may allow oral argument. The Board shall
decide the matter within 10 business days after the hearing and notify
the applicant of its decision in writing. No application shall be
denied on the grounds that the applicant was convicted of a crime,
except in accordance with Article 23A of the Corrections Law.
The Board may waive the requirement of taking and passing the examination with respect to any applicant for a temporary license pursuant to § 103-8.
