GENERAL REFERENCES

The Borough Administrator, or the Borough's employee designated by her/him but under her/his ultimate responsibility and control, shall approve all use of the Berlin Community Center and control the scheduling of events in such facility so as to ensure that, as much as possible, the facility is used primarily by Borough residents. The Berlin Community Center may only be used for social and nonsocial functions of the following:
A. 
Individual residents;
B. 
Borough senior citizen groups and organizations;
C. 
Recognized Borough organizations. Organizations falling in this category must apply for status as a recognized Borough organization in order to use the Berlin Community Center under this category. The application must include a copy of the bylaws, charter or other organization governing document that requires the organization to maintain a membership comprised of at least 90% Borough of Berlin residents or businesses with officers or business locations within the Borough limits. Borough Organizations will be given preference where appropriate.

D. 
Non-Borough organizations which provide that residents have the right to be members of such organizations. Examples of such organizations are county political groups, regional or county business organizations and county or regional athletic groups.

The fees for use of the Berlin Community Center are as follows:
A. 
Banquet facility (exclusive use of entire Community Center for private events).

Fees.

(a) 
Use fee for Berlin residents: $175 for two hours (minimum charge).
(b) 
Use fee for Berlin residents: $350 for four hours; each additional hour, $50.
(c) 
Use fee for nonresidents: $225 for two hours (minimum charge).
(d) 
Use fee for nonresidents: $450 for four hours; each additional hour, $50.
(e) 
Security deposit: $100.
(f) 
Attendant fee: $15 per hour.
(2) 
The Borough shall assign an attendant to oversee the use of the banquet facility who shall be compensated at the rate set forth above, which cost is in addition to the use fee.
(3) 
The use fee is nonrefundable if a cancellation occurs within 30 days of the scheduled event.
B. 
Conference rooms (per room).

(1) 
Nonprofit Berlin Borough organizations: no charge for up to 8 hours per week; $25 per hour for each hour in excess of 8 hours. Organizations are permitted use of the conference rooms and gymnasium without charge for a total of 8 hours per week combined.

All other Berlin residents: $25.
(3) 
All other organizations/nonresidents: $50.
(4) 
Surcharge for food in conference rooms: $50.
C. 
Gymnasium (fee applies to one half of gymnasium, either blue or yellow side).

(1) 
Nonprofit Berlin Borough organizations: no charge for up to 8 hours per week; $25 per hour for each hour in excess of 8 hours. Organizations are permitted use of the conference rooms and gymnasium for a total of 8 hours per week combined.
(2) 
All other Berlin residents: $25.
(3) 
All other organizations/nonresidents: $50.
(4) 
Security deposit: $100 for use of one half of the gymnasium and $150 for use of full gymnasium.
D. 
Reception area (includes desk area in front of kitchen).
(1) 
Nonprofit Berlin Borough organizations: $25 per hour.
(2) 
All other organizations: $50 per hour.
(3) 
Security deposit: $100.
E. 
Field: $50 for the first three hours, and $25 for each additional hour.
F. 
A twenty-dollar refundable key fob deposit is required for use of the conference room and gymnasium.
G. 
The individual or entity using the Berlin Community Center ("responsible party") shall be responsible for cleanup immediately following the event and for any damage to the Berlin Community Center. In the event the responsible party fails to clean up, or if the cleanup is not acceptable to the Borough, any additional costs to clean up or for damage to the Berlin Community Center shall be deducted from the security deposit. In the event the cost to clean up or to repair damage exceeds the amount of the security deposit or if there is no security deposit, the responsible party shall be liable to Berlin Borough for the excess amount.
H. 
Insurance. Users of the Berlin Community Center and/or field must provide proof of insurance with Berlin Borough named as an additional insured. Any additional equipment, machinery, or inflatable devices to be used in the Community Center or field must also be insured by either the supplier or user of the Community Center or field with Berlin Borough named as an additional insured.
I. 
Storage. Users of the Community Center may use the storage area during the term of the rental only. Within seven days of the date the rental period ends, all materials, equipment and/or supplies must be removed from the storage area. If any equipment, materials and/or supplies remain in the storage facility thereafter, the user will be billed at the rate of $100 per month or a pro rata share thereof as applicable
J. 
Nonprofit organizations. To qualify as a nonprofit, the community organization must be composed of 90% Berlin residents and provide proof of 501(c)(3) tax-exempt status. Additionally, no member of the nonprofit organization can be compensated in any manner whatsoever.

All use of the Berlin Community Center shall be in compliance with all laws, ordinances, and regulations of the State of New Jersey, the County of Camden Health Department, and all rules and regulations promulgated by the Borough of Berlin, including, but not limited to, the sale or distribution of alcoholic beverages, which shall be limited to beer and/or wine only. The governing body of the Borough of Berlin shall adopt such additional regulations as it deems necessary regarding the use of the Berlin Community Center.

A. 
Use of the Berlin Community Center is subject to prior scheduling and approval by the Borough of Berlin.
B. 
Users shall be required to complete all forms and paperwork deemed appropriate by the Borough of Berlin.
C. 
When scheduling use of the community center, users must name a designated adult supervisor, who must be present at all times during the user's activities at the community center. The designated adult supervisor shall sign in at the community center and document any problems encountered upon entering the community center, such as damage, trash, general cleanliness, etc.
D. 
All users of the community center are restricted to use of the facility for the reasons set forth in the scheduling application. For example, users of the conference center are not permitted use of the gymnasium and vice versa.
E. 
Anyone wishing to use the community center as a nonpaying rental must schedule at least two months in advance.
F. 
If an event is canceled less than 30 days prior to the event, the deposit shall be nonrefundable.
G. 
Final payment for use of the community center is due no later than 14 days prior to the scheduled event.
H. 
Anyone submitting a fraudulent application for nonpaying use shall be barred from using the community center free of charge.

Any user of the Berlin Community Center who causes damage to the facility, commits fraud in the application process, or who improperly uses the community center shall be subject to penalties, as follows:
A. 
First offense: warning letter.
B. 
Second offense: thirty-day suspension from all use of the community center.
C. 
Third offense: one-year suspension from all use of the community center.
D. 
For a fourth or other flagrant violations, the governing body may, in its sole discretion, terminate all use of the community center.
