1. 
Collection schedule. All solid waste other than bulky items, recyclable materials and compostable materials shall be collected in accordance with a twice-weekly schedule. Each household will have collection dates either on Monday and Thursday, Tuesday and Friday, Wednesday and Saturday in accordance with the attached map.[1] Every householder shall be notified by the contractor at least once per month in advance of any change to the above-referenced collection schedule.

2. 
Holidays. There shall be no collection provided on the following holidays:
A. 
January 1, known as New Year's Day.
B. 
The third Monday in February, known as Presidents Day.
C. 
The fourth Monday of May, known as Memorial Day.
D. 
July 4, known as Independence Day.
E. 
The first Monday of September, known as Labor Day.
F. 
Thanksgiving Day.
G. 
Christmas Day.
H. 
Households whose collection day falls on these holidays shall be skipped until the next regularly scheduled collection day.
3. 
Hours and days of collection. May commence at 6:00 a.m. prevailing time and continue to completion, but shall be no later than 6:00 p.m. except in cases of weather emergencies. No collections shall be made on Sundays.
4. 
Preparation of collection. Garbage shall be thoroughly drained of all water, wrapped securely in paper and/or plastic, and placed in a proper receptacle. Ashes, trash and rubbish shall be placed in a receptacle used to contain the wrapped garbage. Where any such rubbish is too bulky to be placed in a proper receptacle it may be disassembled, broken or cut up as much as practicable and placed on the curb on the prescribed collection day. All such rubbish shall be securely tied, where applicable, and shall be of such size that the longest dimension thereof shall not exceed three feet and the total weight thereof shall not exceed 50 pounds. Paper shall be secured or properly tied into bundles and other packages in a manner designed to prevent any scattering while the same is being handled by the collectors. Packages shall be of a size and construction so as to permit ease of handling by one man and shall in no event exceed 50 pounds in weight.
5. 
Receptacles. The receptacles for refuse collection shall be waterproof and shall not exceed in capacity 30 gallons. Residents are encouraged to use metal and/or durable plastic receptacles.
6. 
Collection location. All household solid waste containers and/or dumpsters shall be placed at the curb or within five feet of the roadway prior to the time of collection on each collection day.
7. 
Quantity. Each residential unit or household shall be entitled to set out for collection on each collection day an amount of household solid waste not to exceed six containers, receptacles, bundles, bags or combination thereof. From December 16 to March 31 each residential unit shall be entitled to set out for solid waste collection bundles, receptacles, containers or combination thereof consisting of yard waste. A maximum of five containers of yard waste is permitted. Tree limbs and brush shall be prepared in accordance with compostable material regulations (§ 20-204).
8. 
Ashes. Ashes placed in refuse containers at the curbside for collection must be cold and at least 24 hours old.

1. 
Definition. Bulky item(s) or waste shall mean any large item(s) of refuse, including, but not limited to, appliances, large auto parts, furniture, and large trees and branches, which require collection in other than conventional compactor refuse collection vehicles.
2. 
Collection schedule. Bulky item collection shall be scheduled regularly at least once per week. The bulky waste collection day shall be on the second collection day of the week.
3. 
Quantity and collection location. Each household may place one item of bulky waste at the curb or at the regular collection location.

All commercial and institutional establishments as defined in § 20-103 of this chapter are required to participate in the program involving the separation and collection of recyclable materials to be placed at their designated indoor or outdoor refuse collection station and separated from normal commercial and institutional solid waste for collection as follows.
A. 
Definition. Recyclable materials shall mean:
(1) 
Required recyclable materials.
(a) 
High-grade office paper.
(b) 
Aluminum.
(c) 
Corrugated paper.
(d) 
Leaf waste.
(2) 
Optional recyclable materials.
(a) 
Steel and/or bimetal cans.
(b) 
Plastics.
(c) 
Clear and/or colored glass.
(d) 
Ferrous materials.
(e) 
Newsprint.
B. 
Collection schedule and disposal.
(1) 
Recyclable materials shall be collected on a scheduled day, at least once per month, as arranged with a private collector licensed to collect solid waste in Lower Southampton Township.
(2) 
Every commercial, institutional and property owner shall ensure that its recyclable materials are separated from solid waste and provided to a licensed or otherwise bona fide recycling facility for recycling or, if provided in mixed waste, to a private collector that agrees to separate and recycle these materials.
C. 
Reporting requirements.
(1) 
Each licensed hauler shall be required to complete and submit to the Township or an agency designated by the Township on an annual basis a source separation and recycling report on the form prescribed (see attached form) and provided by the Township. The report shall contain the following information:
(a) 
Type and total amount of recyclable material collected and recycled within that calendar year (to be provided by private collector).
(b) 
Type and total amount of compostable material collected within the reporting period (if any).
(c) 
Type and total amount of all recyclable, compostable and solid waste material that is collected within the reporting period (to be provided by private collector).
(2) 
Every hauler shall submit to the Township or its designated agency, the source separation and recycling report on or prior to the previous calendar year.
D. 
Alternative recycling program. The Township Manager and/or his/her designee (hereinafter referred to as "Township Manager") is hereby authorized to exempt any and/or all commercial or institutional establishments located within Lower Southampton Township from the requirements for separation and/or collection of recyclable materials as defined in these regulations if those establishments have otherwise provided for the recycling of those materials referenced in Subsection A above. To be eligible for an exemption under this section, the commercial or institutional establishment must be engaged in a program which can demonstrate through its source separation and recycling report that 25% of its total solid waste generated during the reporting period was recycled.

1. 
Unlawful activities.
A. 
It shall be unlawful for any person who does not possess an unrevoked license from the Board of Supervisors of Lower Southampton Township to engage in removal, handling, collection or conveyance of any refuse through or upon the streets of the Township and disposal of the same in any manner or place.
B. 
Licenses shall be issued through the Township Manager's office, provided that:
(1) 
Said licenses shall be limited to persons having proper equipment and personnel to collect and dispose of refuse in accordance with the provisions of these regulations.
(2) 
The method of disposal used is in accordance with the requirements of federal, Pennsylvania and local statutes and ordinances, as well as regulations promulgated thereunder. All solid waste shall be disposed at a facility or facilities designated in the Bucks County Municipal Waste Management Plan.
2. 
Application and fee. Every person desiring to engage in the collection and/or disposal of refuse shall make written application to the Township Manager, setting forth the name of such person, the residence address thereof or the address of the place of business, a description of the place of disposal, and the method of disposal to be practiced. Upon approval of such application, the Township Manager shall issue a permit to the applicant. The permit fee shall be in an amount as established from time to time by resolution of the Board of Supervisors and payable in advance to the Southwestern Bucks County Solid Waste Committee, c/o Lower Southampton Township, 1500 Desire Avenue, Feasterville, Pennsylvania 19053. The permit shall be valid in Lower Southampton Township and Upper Southampton Township. The collector must also provide the Township with a list of all vehicles used in waste and/or recyclable material collection. The list must include the following information:
A. 
Make and body type of vehicle.
B. 
Serial number of vehicle.
C. 
License plate number identifying the vehicle.
D. 
Gross vehicle weight.
All vehicles shall be equipped and identified in accordance with the Solid Waste Ordinance (Part 1 of this chapter) and be in safe operating condition. Any changes in the collector's fleet must be reported promptly to the Township. Subsequent to initial licensing, any licensed collector or waste hauler possessing an existing license shall submit a license renewal application and fee at least 45 days prior to the expiration date of the existing license, if renewal of the license is desired. New license applicants must submit a license application and fee at least 45 days before beginning collecting and transporting municipal waste and/or source-separated recyclables in the Township. The Township shall have 45 calendar days to review any application and take approval or denial action. If the Township fails to take action within 45 days, the application will be deemed to be approved.
3. 
Additional qualifications for license.
A. 
Insurance. A licensed collector, during the term of his license, shall carry:
(1) 
General liability insurance with policy limits of not less than $500,000 each occurrence and $1,000,000 aggregate bodily injury and property damage.
(2) 
Automobile liability insurance with policy limits of not less than $500,000 per person and $1,000,000 per accident bodily injury and $500,000 property damage or, in lieu thereof, a $1,000,000 bodily injury and property damage combined limit.
(3) 
Each collector must submit to the Township a certificate of said insurance with the Township as an additionally insured party.
B. 
A licensed collector shall be required to provide to each industrial, institutional and commercial establishments as defined by ordinance serviced by that collector a source separation and recycling report for the term prescribed, provided by the Southwestern Bucks County Solid Waste Committee.
C. 
Each licensed collector shall provide or make available to all commercial and institutional establishments serviced by that collector the following information:
(1) 
Type and total amount of recyclable material collected and recycled within the calendar year to be reported.
(2) 
Type and total amount of compostable material collected within the reporting period (if any).
(3) 
Type and total amount of all solid waste material (including recyclable and compostable materials) that is collected within the reporting period.
D. 
Licensed collector shall haul refuse over the streets of the Township only in nonleakable vehicles provided with a tight cover and so operated as to prevent offensive odor from escaping therefrom and refuse from being blown, dropped or spilled.
E. 
Failure of any applicant to comply with any of the above requirements in this section or in these rules and regulations to the satisfaction of the Board of Supervisors shall result in the denial of the application and the withholding or revocation of a license. The Board of Supervisors has absolute discretion in this matter.
4. 
Spillage on streets prohibited. No license refuse collection shall permit any outfallings from the conveyance of refuse to lie upon any of the streets or other places of the Township.
5. 
Compliance with health regulations by collectors. All licensed collectors must comply with all proper rules and regulations and ordinances of the Board of Health, local, county and state, in the collection, removal and disposal of garbage.
6. 
Recycling program.
A. 
Recycling affidavit. Any and all applicants for license to collect waste or recyclables that presently engage or will engage in the collection of recyclable materials, as defined herein, for all commercial and institutional establishments shall be required to submit to the Township Manager an affidavit stating that the arrangements have been made for all recyclable material collected to be recycled by licensed or otherwise bona fide recycling firm.
B. 
Service separation and recycling report.
(1) 
Name and address of collection firm.
(2) 
Type and total amount of recyclable materials collected within the reporting period.
(3) 
Type and total amount of compostable material collected within the reporting period.
(4) 
Type and total amount of all solid waste, compostable, and recyclable material collected within the reporting period.
All of the above items shall be placed on an information sheet otherwise known as the source separation and recycling report that will be available from the Township.
C. 
In addition, the collector shall provide, to each of its customers, a record of the total amounts of recyclable material, compostable material (if any) and total solid waste collected on a semiannual basis (January through June and July through December). Reports shall be submitted by July 31 (covering January through June) and by January 31 of the following year (covering July through December).
7. 
Bond and/or security.
A. 
The Township Manager and/or Board of Supervisors may require all licensed private collectors to provide a bond for faithfully observing all laws, ordinances and regulations of Lower Southampton Township relating to the private refuse collection license and for providing, in a timely and workmanlike manner, performance and service to those establishments listed in their application as required in § 20-204B.[1] The bond, if required, shall be in the amount of $25,000 and in a form satisfactory to the Township Solicitor.

B. 
In lieu of a bond, an escrow deposit in the amount of $25,000 may be submitted to the Township as security for faithful performance in accordance with all application laws, ordinances and/or regulations. Escrow monies shall be placed in a non-interest-bearing account and will be released on or immediately after December 31 of each license year.
C. 
If after a public hearing before the Board of Supervisors it has been determined that the licensed collector has failed to provide refuse collection service as required by these regulations and/or has failed to comply with the establishment of a recycling program, the Township shall have the power to utilize the bond and/or escrow security to remedy the default, and said funds shall be used solely to provide refuse collection service and/or collection of recyclable materials for the aggrieved or affected clients.
8. 
Revocation of license. The Board of Supervisors shall have the right at any time, and without refund of any part of the license fee, to suspend or revoke the license of any authorized or private collector for any of the following causes:
A. 
False or misleading statements in the application for a license.
B. 
Lapse or cancellation of insurance coverage.
C. 
Collecting or transporting refuse in a careless or negligent manner resulting in dirt, odor or any unsanitary condition.
D. 
Transportation and disposal of any solid waste to any site that is not a designated facility in the Bucks County Municipal Waste Management Plan or that is not properly permitted by the Pennsylvania DEP.
E. 
A violation of any part of these regulations or Part 1 of this chapter or any applicable state or county laws.
