When referring to this Chapter, the following rules of interpretation
shall be applied, except when the context clearly requires otherwise.
A.Â
The
particular shall control the general.
B.Â
In
the case of any difference of meaning or implication between the text
of this Chapter and any chart, graph, illustration or table, the text
shall control.
C.Â
The
word "shall" is always mandatory and not discretionary.
The word "may" is permissive.
D.Â
Words
used in the present tense shall include the future and words used
in the singular include the plural and the plural is singular, unless
the context clearly indicates the contrary.
E.Â
The
use of the male pronoun includes the use of the female pronoun.
F.Â
The
word "person" includes individuals, firms, corporation,
associations and any other similar entities.
G.Â
The
words "parcel", "site" or "tract" are synonymous and are general terms for the description
of land.
H.Â
The
word "City" means the area of jurisdiction of the
City of Oak Grove, Missouri.
I.Â
All
public officials, bodies and agencies that references are made are
those of the City of Oak Grove, Missouri.

Words in the text or tables of this Chapter shall be interpreted
in accordance with provisions set forth in this Section. Where words
have not been defined, the standard dictionary definition shall prevail.
A separate, complete dwelling unit that is substantially
contained within a commercial structure in the "C-2" District.
A structure that:
Is subordinate to and serves a principal structure;
Is subordinate in area, extent or purpose to the principal structure
served;
Contributes to the comfort, convenience or necessity of the
occupants, business or industry in the principal structure; and
Is located on the same lot as the principal structure served.
A use of land or of a building or portion thereof that:
Is subordinate to and serves a principal use;
Is subordinate in area, extent or purpose to the principal use
served;
Contributes to the comfort, convenience or necessity of the
occupants, business or industry of the principal use; and
Is located on the same lots as the principal structure served.
A measure of land area containing forty-three thousand five
hundred sixty (43,560) square feet.[2]
An establishment used or intended to be used for commercial
entertainment or having ten percent (10%) or more of its stock for
sale or viewing of matters depicting, describing or relating to sexual
conduct for the enjoyment of the patrons.[3]
The initial processing of crop-based agricultural products
that is reasonably required to take place in close proximity to the
site where such products are produced. Typical uses include grain
mills.
A use primarily engaged in the sale or rental of farm tools
and implements, feed and grain, tack, animal care products and farm
supplies. This definition excludes the sale of large implements, such
as tractors and combines, but includes food sales and farm machinery
repair services that are accessory to the principal use.
The use of a tract of land of not less than ten (10) acres
for the growing of crops, pasturage or nursery, including the structures
necessary for carrying out farming operations and the dwellings of
these owning or operating the premises, member of the family thereof
or persons employed thereon and the family thereof.
The use of land for the production of livestock, dairy products,
poultry or poultry products.
The use of land for the production of row crops, field crops,
tree crops or timber.
Any public or privately owned or operated ground facility
designed to accommodate landing and takeoff operations of aircraft,
including all taxiways, aircraft storage and tie-down areas, hangars
and other necessary buildings and open spaces.
A public or private street primarily designed to serve as
secondary access to the side or rear of those properties whose principal
frontage is on some other street.
Any change in a load-bearing member of a structure.
A use providing animal care, boarding or veterinary services
with outdoor animal runs. (See "ANIMAL CARE, LIMITED" and "KENNEL").
A use providing animal care, boarding or veterinary services
for household pets, with no outdoor animal runs. (See "ANIMAL
CARE, GENERAL" and "KENNEL").
A use providing for rehabilitation of wild animals that are
Missouri native small mammals pursuant to a wildlife rehabilitation
permit issued by the Missouri Department of Conservation, with no
outdoor animal runs.

Any action or motion, other than flashing lights, automatic
changeable copy or indexing, in an attempt to develop a pictorial
scene through the movements of lights or parts of a sign.[4]
A developer submitting an applications for development.
The application form and all accompanying documents required
by ordinance for approval of a subdivision plat or site plan.
The American Public Works Association.[5]
Construction plans revised to show a facility or structure
as actually constructed and as it appears on the tract of land involved.
American Society for Testing Materials.
A use engaged in the manufacture, mixing, batching or recycling
of asphalt, asphaltic cement, cement or concrete products.
Multi-family dwelling units used or designed to be used by
older persons, persons with disabilities or other persons needing
or desiring assistance with day-to-day living matters, but not including
group homes, group residential, hospitals or convalescent care facilities.
Typical uses include retirement communities in which housekeeping
services, common dining facilities and recreational and social activities
are offered to residents.
An open, partially enclosed or fully enclosed facility used
or intended to be used primarily for spectator sports, entertainment
events, expositions and other public gatherings. Typical uses include
convention and exhibit halls, sports arenas and amphitheaters.
An architectural projection that provides weather protection,
identity or decoration and is wholly supported by the building to
which it is attached. An awning is comprised of a light-weight, rigid
skeleton structure over which a covering is attached.
American Water Works Association.
Establishments engaged in deposit banking. Typical uses include
commercial banks, savings institutions and credit unions and automated
teller machines.
An establishment where fifty percent (50%) or more of gross
income is derived from the sale of alcoholic beverages by the drink
for consumption on the property and where the serving of food and
non-alcoholic beverage for consumption on the property and the sale
of package liquors may be accessory uses.[6]
A story partly or wholly below grade. For purposes of height
measurement, a basement shall be counted as a story when the finished
surface of the floor above the basement is:
A use engaged in the basic processing and manufacturing of
materials or products predominately from extracted or raw materials.
Typical uses include distilleries; pulp processing and paper products
manufacturing; glass manufacturing; brick manufacturing; steel works;
tanneries; acid manufacturing; cement, lime, gypsum or plaster of
Paris manufacturing; fertilizer or chemical manufacturing; and petroleum
refineries.
A dwelling or portion thereof that contains guest rooms that
short-term lodging, with or without meals, is provided for compensation.
A mound of earth, typically located in a bufferyard to shield
or block noise, lights or other nuisances.
An area of land within a subdivision that is entirely bounded
by streets, highways or rights-of-way, except alleys or between streets,
highways, streams, parks, etc., or any other barriers or combination
thereof, to the continuity of development.
The Board of Aldermen of the City of Oak Grove.
An establishment or part thereof that lodging and meals are
provided by the owner or operator for at least three (3) but not more
than eleven (11) persons for compensation whether the compensation
is paid directly or indirectly.
Land area typically containing trees, shrubs or other plants,
berms, fences or walls and used to visibly separate one use from another
or to block noise, lights or other nuisances.
The area of a lot remaining after the minimum yard and open
space requirements of the Zoning Ordinance have been met.
Any structure having a roof supported by columns or walls
and intended for the shelter, housing or enclosure of any individual,
animal, process, equipment, goods or materials of any kind or nature.
The Building Code of the City of Oak Grove, Missouri, together
with the Electrical Code, Plumbing Code, Fire Code and any related
code(s) adopted by the Oak Grove Board of Aldermen and any regulations
adopted in conformance therewith.
The horizontal area measured within the exterior walls of
the ground floor of all principal and accessory buildings on a lot
divided by the gross area of the lot.
That portion of a building that is parallel or nearly parallel
to the abutting roadway or parking lot.
The physical characteristics that create the aesthetic and
structural appearance of the resource including, but not limited to,
a consideration of the texture and style of the components and their
combinations, such as bricks, stone, shingle, wood, concrete or stucco.
A line parallel to a street or right-of-way line, shore or
a lake, edge of a stream, other property line established on a parcel
of land or lot for the purpose of prohibiting construction of a building
or structure in the area between such building line and right-of-way,
lakeshore, streambank or other property line.
A building that the primary use of the lot, that the building
is located on, is conducted.
Standards that control the height, intensity and location
of structures.
The storage of chemicals, petroleum products and other materials
in above-ground containers for subsequent resale (wholesale) to distributors
or retail dealers or outlets.
Any zoning district designated for office, government and
institutional, commercial and industrial use.
A use primarily engaged in the manufacturing or assembly
of custom wood products for residential or business uses. This use
does not include the large-scale, mass manufacture of wood products
such as furniture.
The amount of light that will illuminate a surface one (1)
foot distant from a light source to an intensity of one (1) foot-candle.
Maximum (peak) candlepower is the largest amount of candlepower emitted
by any lamp, light source or luminaire.
An architectural projection that provides weather protection,
identity or decoration and is wholly supported by the building to
which it is attached and at the outer end by not less than one (1)
stanchion. A canopy is comprised of a rigid structure over which a
covering is attached.
A use primarily engaged in cleaning or detailing motor vehicles,
whether self-service, automatic or by hand.
An amusement enterprise consisting of rides, acts, shows,
games, amusement devices or other similar devices or any combination
of such devices.
Property used for interring of the dead, including mausoleums.
The commercial area of Oak Grove centered on South Broadway
from 7th Street to 25th Street.
The bed and banks of a natural stream which convey the constant
or intermittent flow of the stream.
The straightening and deepening of channels and/or the surfacing
thereof to permit water to move rapidly and/or directly.[7]
The City of Oak Grove, Missouri.
The officially appointed engineer of the City of Oak Grove,
Missouri, or his/her duly appointed designee. The term may be abbreviated
in this Chapter as the "Board".
The official appointed Planning and Zoning Commission of
the City of Oak Grove. The term may be abbreviated in this Chapter
as the "Commission".
A use providing meeting, recreational or social facilities
for a private association, primarily for use by members and guests.
Typical uses include private social clubs, lodges and fraternal organizations.
An institution of higher education offering undergraduate
or graduate degrees.
Any vehicle designed, maintained or used primarily for the
transportation of property or persons for hire.
The Oak Grove Planning and Zoning Commission.
AM/FM radio, television and microwave transmission towers
and accessory equipment and buildings.[8]
The receiving of goods, services or money in exchange for
or as a result of a service performed.
A commercial or public solid waste processing facility where
yard or garden waste is transformed into soil or fertilizer by biological
decomposition.
The Master Plan and its associated elements of the City of
Oak Grove adopted by the Planning and Zoning Commission and Board
of Aldermen containing analysis, recommendations and policies for
the community's population, economy, housing, transportation, community
facilities and land use.
A use permitted in a particular zoning district only upon
showing that such use in a specific location will comply with all
the conditions and standards for the location or operation of such
use as specified in the Chapter and authorized by the Board of Aldermen.
A building, group of buildings or property that units are
owned individually with the common elements owned by all the owners
on a proportionate, undivided basis.
A use engaged in the retail or wholesale of materials used
in the construction of buildings or other structures and the outdoor
storage of construction equipment or materials on lots other than
construction sites. Typical uses include lumberyards, home improvement
centers, lawn and garden supply stores, electrical, plumbing, air
conditioning and heating supply stores, swimming pool sales, construction
contractors' storage yards and construction equipment rental establishments.
A use providing bed care and in-patient services for persons
needing regular medical attention, but excluding facilities for the
care and treatment of mental illness, alcoholism, narcotics addiction,
emergency medical services or communicable disease. Typical uses include
nursing homes.
The letters, figures, characters, representations, pictures
or wording on a sign, including any identification, description, symbol,
trademark, object, design or logo illustration, illuminated or non-illuminated,
that directs attention to a product, service, place, activity, person,
institution, business or solicitation, including any permanently installed
or situated merchandise; or any emblem or painting designed to advertise,
communicate, identify or convey information.
A facility providing housing and care for individuals confined
for violations of law.
A street having one (1) end opened to traffic and being terminated
by a vehicle turnaround.
A facility providing cultural and educational services to
the public. Typical uses include museums, art museums, observatories,
planetariums, botanical gardens, arboretums, zoos and aquariums.
A vertical or sloping edge of a roadway.
The point that all light rays emitted by a lamp, light source
or luminaire are completely eliminated (cutoff) at a specified angle
above the ground.
The angle formed by a line drawn from the direction of light
rays at the light source and a line perpendicular to the ground from
the light source, above where no light is emitted.
A luminaire with elements such as shields, reflectors or
refractor panels that direct and cut off the light at a cutoff angle
that is less than ninety degrees (90°).
A use that provides care, protection and supervision for
individuals on a regular basis away from their primary residence for
less than twenty-four (24) hours per day.
A day care conducted in a structure other than a private
residence.
A day care establishment conducted in a private residence
that provides care for seven (7) to ten (10) individuals at any one
time, excluding those persons related to and residing in the home
of the day care provider.
A day care establishment conducted in a private residence
that provides care for four (4) to six (6) individuals at any one
time, excluding those persons related to and residing in the home
of the day care provider.
An act transmitting property or interest thereto.
Any act or process that destroys in part or in whole any
building or structure.
The permitted number of dwelling units per gross acre of
land to be developed.
The relative size or magnitude of a major flood or reasonable
expectancy which reflects both flood experience and flood potential
and is the basis of the delineation of the floodway, the flood hazard
area and the water surface elevations.
Standards that set forth specific improvement requirements.
Architectural aspects that, due to particular treatment,
draw attention to certain parts or features of a structure.[9]
The Director of the Community Development Department of the
City of Oak Grove, Missouri, or his/her designated representative.
A part, zone or geographic area within the area of Oak Grove
where certain zoning regulations apply and are uniform.
A street having an island or other barrier separating moving
lanes.
The removal of surface water or ground water from land by
drains, grading or other means.
Any component of the drainage system.
The system through which water flows from the land, including
all watercourses, waterbodies and wetlands.
A paved or unpaved area used for ingress or egress of vehicles
and allowing access from a street to a building or other structure
or facility.
A structure on a single lot containing two (2) dwelling units,
each that is totally separated from the other.
A building or portion therefor designed and used exclusively
by individuals for no less than thirty (30) day residential occupancy
with complete cooking and sanitary facilities, excluding hotels, motels,
boarding, rooming and lodging houses and institutional care facilities.
A dwelling on a single lot containing three (3) or more dwelling
units where each is totally separated from the others.

A dwelling unit attached to one (1) or more dwelling units
by common vertical walls and each dwelling unit is located on a separate
lot. This definition may include the term zero lot line, twin house
or patio house.
A dwelling unit entirely surrounded by open space on the
same lot.
A dwelling unit of at least three (3) such units where each
unit has its own front and rear access to the outside, no unit is
located over another unit, and each unit is separated from any other
unit by one (1) or more common walls.

One (1) or more rooms located within a dwelling that creates
an independent housekeeping establishment for occupancy by one (1)
family with separate toilets and facilities for cooking and sleeping.
A right-of-way granted, but not dedicated, for limited use
of private land for a public or quasi-public purpose and within which
the owner of the property shall not erect any permanent structures.
When the landowner cannot economically utilize the property
and it is impractical to sell or lease it or no market exists for
it at a reasonable price.[10]
A professional engineer registered in the State of Missouri.
The construction or public works plans showing types of materials
and construction details for physical structures and facilities, including
dwelling units to be installed in conjunction with development of
subdivision.
This term shall mean attach, alter, build, construct, reconstruct,
enlarge or move.
Money delivered to a third person to be delivered by him/her
to the grantee only upon fulfillment of a condition.[11]
The following living arrangements shall constitute a family
for the purposes of this Chapter:
One (1) or more persons related by blood, marriage, adoption
or custodial relationship living as a single housekeeping unit;
Three (3) or less persons living as a single housekeeping unit;
or
Two (2) unrelated persons, plus their biological, adopted or
foster children or other minors for whom they have legally established
custodial responsibility, living as a single housekeeping unit.
Domestic servants, employed on the premises, may be housed on
the premises without being counted as part of the family. The term "family" shall not be construed to mean a fraternity, sorority,
club or institutional group.

An enclosure or barrier such as wooden posts, wire, iron,
etc., used as a boundary, means of protection, privacy screening or
confinement, but not including hedges, shrubs, trees or other natural
growth.
The official action taken on a preliminary approved major
subdivision or site plan after all conditions, engineering drawings
and other requirements have been completed or fulfilled.
The final maps of all or portion of a subdivision which is
presented for final approval.
A continuously intermittent light or sequential light, but
not including animation or lighting changes that change the copy of
a sign.
A use combining office and warehousing; office and light
assembly; or office, warehousing and light assembly activities within
the same building. Flextech buildings typically have office storefronts
on one (1) side of the structure and loading docks or roll-up doors
on the other side. Loading and service areas are screened from view
of public right-of-way, public recreation facilities and lower intensity
zoning districts. Flextech uses may involve retail sales of merchandise
as an accessory use.[12]
For non-residential buildings or buildings containing residential
and non-residential uses, "floor area" means the
sum of the gross horizontal area of all floors of the building measured
from the exterior faces of the exterior walls. For residential buildings, "floor area" shall mean the gross horizontal area of all
floors in a dwelling measured from the external faces of the exterior
walls. Garages, basements and open porches shall be excluded when
measuring residential floor area.
The gross floor area of all buildings on a lot divided by
the lot area. For the purpose of this Chapter, parking decks are not
included in calculating the floor area ratio.
A use engaged in the manufacture of food and food products,
including non-retail bakeries, canning facilities and creameries.
A unit of illumination produced on a surface, all points
of which are one (1) foot from a uniform point source of one (1) candle.
A building or area in which freight brought by truck, rail
or air is processed for continued shipment by truck, rail or air.
That part of a lot or premise immediately adjacent to a street
or streets without regard to access to or elevation of the street
or streets.[13]
A building used for the preparation of the deceased for burial
and the display of the deceased and ceremonies connected therewith
before burial or cremation, but shall not include facilities for cremation.
The use of a site for bulk storage and distribution and sales
of flammable liquid, gas or solid fuel, excluding below-ground storage
that is clearly ancillary to an allowed principal use on the site.
The effect produced by brightness sufficient to cause annoyance,
discomfort or loss in visual performance and visibility.
A facility providing private or public golf recreation services
and support facilities. This definition shall exclude miniature golf
courses and golf driving ranges except those that are clearly accessory
uses. (See "RECREATION AND ENTERTAINMENT, OUTDOOR").
Buildings or facilities owned or operated by a government
entity and providing services for the public, excluding utilities
and park and recreation services. Typical uses include administrative
offices of government agencies and utility billing offices.
The slope of a street or other public way specified in percentage
terms.
A building whose roof and sides are made largely of glass
or other transparent or translucent material and in which the temperature
and humidity can be regulated for the cultivation of delicate or out-of-season
plants for subsequent sale or for personal enjoyment.
A facility providing twenty-four (24) hour care in a protected
living environment for more than eight (8) persons with physical or
mental disabilities and any number of caregivers.
A facility providing twenty-four (24) hour care in a protected
living environment for no more than eight (8) persons with physical
or mental disabilities and up to two (2) house parents or caregivers.
The use of a site for occupancy by groups of more than five
(5) persons, not defined as a family, on a weekly or longer basis.
Typical uses include fraternity or sorority houses, dormitories, residence
halls and boarding or lodging houses. The term "group residential" does not include "group homes".
A shallow channel usually set along a curb or the pavement
edge of a road for purposes of catching and carrying runoff water.
Activities that present the potential for serious hazards
to human life and health. Typical uses include arsenals, atomic reactors,
explosives and fireworks manufacture, hazardous waste disposal, medical
waste disposal and radioactive waste handling.
Any substances or materials that, by reason of their toxic,
caustic, corrosive, abrasive or otherwise injurious properties, may
be detrimental or harmful to the health of any person handling or
otherwise coming into contact with such material or substance.
A facility where members or non-members use equipment or
space for the purpose of physical exercise.
The vertical distance of a structure measured from the average
established grade at the street lot line or from the average natural
ground level, if higher; or if no street grade has been established,
to the highest point of the roof's surface if a flat surface; to the
deck line of mansard roofs; and to the mean height level between the
eaves and ridge for hip or gable roofs. In measuring the height of
a building, the following structures shall be excluded: chimneys,
cooling towers, telecommunication towers, ornamental cupolas, domes
or spires, elevator bulk heads, penthouses, tanks, water towers, and
parapet walls not exceeding four (4) feet in height.
An area, either on the ground or on a building, used as a
landing pad for helicopters to pick up or discharge passengers or
cargo.
An activity carried out for compensation in a residential
dwelling unit.
An institution providing primary health services and medical
or surgical care to persons, primarily inpatients, suffering from
illness, disease, injury, deformity and other abnormal physical or
mental conditions and including, as an integral part of the institution,
related facilities such as laboratories, outpatient facilities or
training facilities.
A facility used, maintained or advertised as a place where
sleeping accommodations, in rooms without individual kitchens, are
supplied for short-term rent to transient guests. Typical uses include
hotels and motels.
A sign which does not name or advertise a product, service
or business but only expresses a viewpoint, non-commercial message,
opinion or idea. This includes commemorative plaques, historic markers,
holiday decorations, political signs, political or fraternal flags
or emblems or protective signs which are commonly associated with
safeguarding the permitted uses of a premise, including, but not limited
to, vicious dog, no trespassing, neighborhood watch and authorized
parking only.
Illuminating Engineering Society.
Any part of a lot that is covered by buildings, structures,
parking areas, driveways and any other surfaces which reduce or prevent
absorption of stormwater.
A body of water, such as a pond, confined by a dam, dike,
floodgate or other barrier.
Street work, utilities, sidewalks, drainage structures and
other physical modifications which are to be installed or constructed
by the subdivider for the benefit of the lot owners and for the proper
development of the community as a condition precedent to the approval
and acceptance of the final plat.
An establishment licensed to operate a facility housing dogs,
cats or other household pets and where grooming, breeding, boarding,
training or selling of animals is conducted as a business.
A disposal facility employing an engineered method of disposing
of solid waste, including demolition and construction debris.
Landscape materials include lawns, trees, plants and other
natural and decorative features. In addition, it can include non-living
materials such as mulch, brick, concrete, stone, cobbles, wood blocks,
gravel and sand.
Pipes conducting sewage from individual buildings to larger
pipes called trunk or interceptor sewers that usually are located
in street rights-of-way.
A use that is primarily engaged in the large-scale washing
or cleaning of laundry, rugs and similar materials. This definition
does not include laundromat or dry cleaning pickup stations.
An off-street space or berth on the same lot with a building
or contiguous to a group of buildings for the temporary parking of
a commercial vehicle while loading or unloading merchandise or materials.
A parcel of property that complies with the minimum lot area
and setback standards of this Unified Development Code which is developed
or intended to be developed as a unit under single ownership or control.
A lot may consist of one (1) or more lots of record, one (1) or more
portions of a lot or lots of record or any combination thereof.
The total horizontal area within the lines of a lot.
A lot situated at the intersection of two (2) or more streets.
The horizontal distance between the front and rear lot lines
measured along the median between the two (2) side lot lines.
A lot on either end of a row of lots and intended for a town
house attached on one (1) side to another town house and with a yard
on the opposite side.
That portion of a lot extending along a street line.
The front of a lot shall be considered to be that side of
the lot which fronts on a street. In the case of a corner lot, the
narrowest side fronting on the street shall be considered to be the
front of the lot. In case the corner lot has equal frontage on two
(2) or more streets, the lot shall be considered to front on that
street which the greatest number of lots front.
A lot other than a corner lot.
A boundary line of a lot.
The lot line separating a lot from the street. On a corner
lot, the shortest lot line abutting a street is the front lot line;
on a through lot, both lot lines abutting the streets are the front
lot lines; on a flag shaped lot, the front lot line is also that lot
line most parallel to the front lot line abutting the street.
Any lot line not a front or side lot line. The rear lot line
for a triangular shaped lot shall be a line ten (10) feet long drawn
between the lot's side lot lines and parallel to the front lot line.
The lot lines that intersect with a lot's front line.
A lot which exists as shown or described on a plat or deed
in the records of the appropriate County Recorder of Deeds and recorded
prior to March 15, 1982.
A lot having frontage on two (2) parallel streets or which
fronts upon two (2) streets which do not intersect at the boundaries
of the lot.
The horizontal distance between the side lot lines measured
at right angles to the lot depth along a line parallel to the front
lot line at the minimum required building setback line.[14]
A complete lighting unit consisting of a light source and
all necessary mechanical, electrical and decorative parts.
In any system of continuous piping, the principal artery
of the system to which branches may be connected.
Any security that may be required and accepted by a governmental
agency to ensure those necessary improvements will function as required
for a specific period of time.
Any subdivision not classified as a minor subdivision.
A site with required improvements and utilities for the long-term
placement of manufactured homes for dwelling purposes. Services and
facilities for residents of the development may also be included on
the site.
A transportable, factory-built structure that is manufactured
in accordance with the Federal Manufactured Housing Construction and
Safety Standards Act of 1974 (42 U.S.C. Section 5401) and that is
designed to be used as a single dwelling unit.
An establishment engaged in the manufacture, predominately
from previously prepared materials, of finished products or parts,
including processing, fabrication, assembly, treatment and packaging
of such products and incidental storage, sales and distribution of
such products, but excluding basic industry.[15]
A service street that runs parallel to a higher-order street
which, for purposes of safety, provides access to abutting properties
and separation from through traffic. May be designed as a residential
access street or subcollector as anticipated daily traffic dictates.[16]
Cannabis indica, Cannabis sativa, and Cannabis ruderalis,
hybrids of such species, and any other strains commonly understood
within the scientific community to constitute marijuana, as well as
resin extracted from the plant and marijuana-infused products. "Marijuana"
or "Marihuana" do not include industrial hemp containing a crop-wide
average tetrahydrocannabinol concentration that does not exceed three-tenths
of one percent on a dry weight basis, or commodities or products manufactured
from industrial hemp.

Products that are infused with marijuana or an extract thereof
and are intended for use or consumption other than by smoking, including,
but not limited to, edible products, ointments, tinctures and concentrates.

A use providing therapeutic, preventive or corrective personal
treatment services on an out-patient basis by physicians, dentists
and other practitioners of the medical or healing arts and the provision
of medical testing and analysis services. Typical uses include clinics
and offices for doctors of medicine, dentists, chiropractors, osteopaths,
optometrists, blood banks and medical laboratories.
A facility used or intended to be used by a branch of the
U.S. Armed Forces, including military reserves.
The extraction of metallic and non-metallic minerals, excluding
oil or natural gas. Typical uses include sand and gravel pit operations,
quarries and mines.
A subdivision of land of not more than five (5) lots, provided
that such subdivision does not involve a planned development, any
new street or the extension of a utility or other municipal facility.
A transportable, factory-built structure that was manufactured
prior to the enactment of the Federal Manufactured Housing Construction
and Safety Standards Act of 1974 (42 U.S.C. Section 5401) and that
is designed to be used as a single dwelling unit.
A site with required improvements and utilities for the long-term
placement of mobile homes for dwelling purposes. Services and facilities
for residents of the development may also be included on the site.
A factory-built transportable structure which bears the seal
of the State of Missouri Public Service Commission or is built to
the UBC Basic Code as adopted by the City of Oak Grove and which does
not have its own running gear and is designed to be used as a dwelling
unit with a permanent foundation.
A low curb with a flat slope designed to be crossed easily
without discomfort.
The use of a site for three (3) or more dwelling units within
a single building. Typical uses include triplexes, four-plexes, apartments
and residential condominiums.
For the purposes of determining insurance rates, structures
for which the "start of construction" commenced on or after the effective
date of an initial FIRM or after December 31, 1974, whichever is later,
and includes any subsequent improvements to such structures.[18]
Any structure that does not meet the limitations on structure
size and location on a lot for the district in which such structure
is located and for the use to which such structure is being put at
the time the structure was established.
A use of land that does not comply with the use regulations
for its zoning district but which complied with applicable regulations
at the time the use was established.
A use providing executive, management, administrative or
professional services, but not medical or dental services or the sale
of merchandise, except as incidental to a permitted use. Typical uses
include real estate, insurance, property management, investment, employment,
travel, advertising, law, architecture, design, engineering, accounting
and similar offices.
Any sign other than an on-premise sign.
Located outside the lot lines of the lot in question but
within the property (of which the lot is a part) that is the subject
of a development application or on a contiguous portion of a street
or right-of-way.
The subsurface extraction or refining of oil or natural gas.
Located on the lot in question.
Any occupied space on a lot that is unobstructed to the sky
except for the ordinary projection of cornices and eaves. Open space
shall not include areas covered by structures, decks, porches, parking
areas, driveways, internal streets and other forms of impervious surfaces.
Water bodies that are not subject to public ownership shall also be
included as open space.
Where the purpose of the work is stabilization or is normal,
customary and routine affecting the exterior of the structure or the
outside of the site.
The placement of products in their finished state for public
viewing as a means of advertising. Such products may include automobiles,
portable buildings, outdoor furniture and other similar items. Landscape
materials such as mulch, rock and plant material may be displayed
as part of a finished landscape but may not be displayed in bulk.
The placement of raw materials prior to manufacture or sale.
Items may include lumber, fencing or bulk landscape materials.
The property owner of record according to the County Recorder
of Deeds.
A permanently surfaced, dust-free area (concrete, asphaltic
concrete or other comparable surface) enclosed or unenclosed for the
short-term storage of automobiles.
An area used or intended to be used for the off-street parking
of operable motor vehicles on a temporary basis, other than as accessory
parking to a principal use.
A park, playground or community facility, owned by or under
the control of a public agency or property owners' association, that
provides opportunities for active or passive recreational activities.[19]
Brick, stone, asphalt or other impervious dustless material
placed on the surface of the land.
Total number of trip ends generated by a site during the
hour when the adjacent street carries the maximum number of trips
or during the hour when the site generates the maximum number of trip
ends.
A separate right-of way dedicated to or reserved for public
use by pedestrians which crosses blocks or other tracts of land to
facilitate pedestrian access to adjacent streets and properties.
Any security that may be accepted by a municipality as a
guarantee that the improvements required as part of an application
for development are satisfactorily completed.
Any individual, corporation, association, firm, partnership,
institution or legal entity, singular or plural.
Any material the allows the absorption of stormwater.
An area of a minimum contiguous size, as specified by ordinance,
to be planned, developed, operated and maintained as a single entity
containing one (1) or more structures to accommodate commercial, office
or residential uses or all in any combination thereof and appurtenant
common area and other uses incidental to the predominant uses.
A map or maps of a subdivision or site plan.
A roofed, open area usually attached to or part of and with
indirect access to or from a building. A porch becomes a room when
the space enclosed is heated or air conditioned or, if glazed, when
the percentage of the window area to wall area of the porch, not attached
to the building, is less than seventy-five percent (75%).
A porch where at least seventy-five percent (75%) of the
sides of the porch not attached to the building are empty voids and
whose voids are neither glazed nor screened.
A facility used for the collection, sorting and distribution
of U.S. mail among several zip code areas and having limited retail
services for the public, such as the sale of stamps, postcards and
postal insurance.
An initial meeting between developers and municipal representatives
which affords developers the opportunity to present their proposals
informally.
The City and the applicant have agreed upon the conferral
of certain rights prior to final approval after specific elements
of a development plan.
A map indicating the proposed layout of a development and
related information that is submitted for preliminary approval.
A building in which a principal use is conducted.
The primary use and chief purpose of a lot or structure.[20]
The production of books, magazines, newspapers and other
printed matter and record pressing and publishing, engraving and photoengraving,
but excluding businesses involved solely in retail photocopying, reproduction,
photo developing or blueprinting services. (See "RETAIL SALES
AND SERVICE").
The relative physical size within and between buildings and
building components.
Maintained for or used by the people of the City of Oak Grove
on a non-commercial basis.
An action by the City of Oak Grove or any of its departments
or agencies involving major modification or replacement of streets,
sidewalks, curbs, street lights, street or sidewalk furniture, landscaping
or other portions of the public infrastructure.
A use offering recreation, entertainment or games of skill
to the public for a fee or charge and that is wholly enclosed in a
building. Typical uses include bowling alleys, indoor theaters, bingo
parlors, pool halls, billiard parlors and video game arcades.
A use offering recreation, entertainment or games of skill
to the public for a fee or charge wherein any portion of the activity
takes place in the open. Typical uses include archery ranges, batting
cages, golf driving ranges, drive-in theaters and miniature golf courses.

A vehicular-type unit designed for temporary living quarters
for recreational, camping, or travel use, which either has its own
motive power or is mounted on or drawn by another vehicle.

The term "recreational vehicle" shall include, but not be limited
to, the following:
TRAVEL TRAILERA vehicular, portable structure built on a chassis and drawn by a motorized vehicle and which is designed to be used as a temporary dwelling for travel, recreational and vacation uses;
CAMPERA structure designed to be mounted on a truck chassis for use as a temporary dwelling for travel, recreational and vacation uses;
MOTOR HOMEA portable, temporary dwelling to be used for travel, recreational and vacation uses and which is constructed as an integral part of a self-propelled vehicle;
CAMPING TRAILERA folding structure mounted on wheels and designed for travel, recreational and vacation uses;
PARK TRAILERA trailer-type unit that is primarily designed to provide temporary living quarters for recreational, camping or seasonal use, that meets the following criteria:
Tents. An enclosed structure or shelter fabricated entirely
or in major part of cloth, canvas, plastic or similar material which
is erected for periods not exceeding thirty (30) days for recreational
or vacation purposes. For the purpose of this Code, a tent shall be
considered as a dependent camping vehicle.
Land used or intended to be used for occupancy by recreational
vehicles for transient living purposes, including the use of camping
spaces for tents.
A use engaged in the retail sale of recreational vehicles
from the premises along with incidental service or maintenance activities
within completely enclosed buildings and an outdoor area used or intended
to be used for storage of recreational vehicles displayed for sale.

A designated and defined parcel of land within a recreational
vehicle park intended for temporary location of a recreational vehicle
as a dwelling unit.

A site used by a bona fide religious group primarily or exclusively
for religious worship and related religious services, including a
place of worship, retreat site or religious camp.
Any relocation of a structure, object or artifact on its
site or to another site.
Any interior or exterior change to a structure not including
a change in a load-bearing member of a structure.
A use primarily engaged in the provision of repair services
to individuals and households, but excluding vehicle repair services.
Typical uses include appliance repair shops.
A use engaged in conducting basic and applied research, including
production of prototype products when limited to the minimum scale
necessary for full investigation of the merits of a product, excluding
production of products used primarily or customarily for sale or for
use in non-prototype production operations.
A use primarily engaged in the sale of food and non-alcoholic
beverages in a ready-to-consume state. The design or principal method
of operation is that of a fast-food or drive-in restaurant offering
quick food service; where orders are generally not taken at the customer's
table; where food is generally served in disposable wrapping or containers;
and where food and beverages may be served directly to the customer
in a motor vehicle.
A use where the principal business is the sale of food and
beverages in a ready-to-consume state.
A use engaged in the sale or rental of goods and services,
excluding uses more specifically defined.
A pond, pool or basin used for the permanent storage of water
runoff.
A strip of land occupied or intended to be occupied by a
street, crosswalk, railroad, road, electric transmission line, gas
pipeline, water main, sanitary or storm sewer main, shade trees or
for another special use.[21]
The actual road surface area from curbline to curbline, which
may include travel lanes and parking lanes. Where there are no curbs,
the roadway is that portion between the edges of the paved or hard
surface width.
A facility for conduct of public safety and emergency services,
including fire and Police protection services and emergency medical
and ambulance services.
Any immediate or further transfer of ownership, including
contract of sale or transfer of an interest in a subdivision or part
thereof, whether by meters and bounds, deed, contact, plat, map or
other written instrument.
A lot, land or structure or part thereof used primarily for
the collecting, dismantling, storage and salvaging of machinery or
vehicles that are not in operating condition or for the sale of parts
thereof. Typical uses include automobile salvage yards and junk yards.
The harmonious proportion of parts of a building or structure
to one another and to the human figure.
The use of a site for instructional purposes on an elementary
or secondary level.
An underground system with a septic tank used for the decomposition
of domestic waste.
A use primarily engaged in the retail sale of gasoline or
other motor fuels to automobiles and passenger vehicles, along with
accessory activities such as the sale of lubricants, accessories or
supplies, the lubrication of motor vehicles and the minor adjustment
or repair of passenger motor vehicles. Uses involved primarily in
the sale of diesel fuel, gasoline or other fuels to tractor trucks
and uses that feature parking, storage or servicing of tractor trucks
or semi-trailers shall be classified as "Truck Stop Service Stations".
A use primarily engaged in the sale of diesel fuel, gasoline
or other fuels to tractor trucks, along with accessory activities
such as the sale of lubricants, accessories or supplies or the servicing
of tractor trucks or semi-trailers. A truck stop service station may
include, as an accessory use, the parking and storage of tractor trucks
or semi-trailers.
The required minimum horizontal distance between the lot
line and the nearest front, side or rear line of the building, as
the case may be.
Any pipe conduit used to collect and carry sewage or stormwater
runoff from the generating source to treatment plant or receiving
streams.
An outdoor facility used or intended to be used for the discharge
of firearms at targets.
PAYDAY LOAN BUSINESSThe business of making loans for a period of thirty (30) days or less in duration, intended to coincide with the period from one payday of the borrower to the next, and in principle amounts of five hundred dollars ($500.00) or less.
TITLE LOAN BUSINESSA business that primarily lends money with the pledge of personal property as collateral, evidenced by a certificate of title issued by the State of Missouri, and regulated under Sections 367.500 through 367.533, RSMo., as from time-to-time amended.
A paved path provided for pedestrian use and usually located
at the side of a road within the right-of-way.
A triangular-shaped portion of land established at street
intersections in which nothing is erected, placed, planted or allowed
to grow in such a manner as to limit or obstruct the sight distance
of motorists entering or leaving the intersection.
Any medium, including its structure and component parts,
that is used or intended to be used to attract attention for identification,
announcement or advertising purposes. This definition applies to all
signs with letters, emblems or logos of more than three (3) inches
in height. Signs on vending machines will be counted in the allowable
sign area. If located against the building facade, they will not be
counted as a freestanding sign.
The area of the face of the sign within a perimeter that
forms the outside shape, but excluding the necessary supports or uprights
that the sign may be placed unless these supports or uprights are
designed as part of the sign. If the sign consists of more than one
(1) section or module, all areas will be totaled. The area of an irregularly
shaped sign shall be computed using the actual sign face surface.
In the case of an irregularly shaped sign or a sign with letters and/or
symbols directly affixed to or painted on the wall of a building or
a window, the area of the sign shall be the entire area within a single
continuous rectilinear perimeter of not more than eight (8) straight
lines enclosing the extreme limits of writing, representation, emblem
or any figure or similar character, together with any logo material
or color forming an integral part or backdrop of the display or used
to differentiate such sign from the backdrop or structure.
Any sign substantially and permanent attached to, applied
on, structurally connected to, painted on, engraved on, etched on
or supported by any part of a building.
A sign with copy on two (2) parallel faces that are facing
in opposite directions not separated by more than twelve (12) inches.
The area of a back-to-back sign is calculated on one (1) face only.
A sign having the character, letters, illustrations or ornamentation
applied to cloth, or lightweight fabric material for advertising a
product, business, service, show, property, or carnival.
Any sign with a sign area in excess of three hundred fifty
(350) square feet that advertises or directs attention to a business,
commodity, service or entertainment conducted, sold or offered at
a location other than the premise that the sign is located.
A sign such as a manual, electronic or electric controlled
time and temperature sign, message center or reader board, whether
electronic, electric or manual, where copy changes. Any sign may be,
or include as part of it, a changeable message sign.
Any sign other than an attached sign and including any inoperable
vehicle or any trailer located for the primary purpose of advertising.
Any sign that serves solely to designate the location of
or direction to any premise or area.
Any sign that the back is attached flat against any part
of a building or structure and that does not extend outward more than
six (6) inches or any sign painted upon any building or structure
or upon a window thereof.
A sign lighted by electricity or any other source of power.
A sign with an artificial light source incorporated internally or
externally for the purpose of illuminating the sign.
A freestanding sign mounted on an enclosed, structural base
which base length is equal to or greater than the length of the sign
face, which base depth is not narrower than the structure containing
the sign face or twelve (12) inches, whichever is greater, and which
total overall height does not exceed eight (8) feet.
Any sign that was in existence and displayed on the effective
date of this Sign Code but that does not conform to the requirements
and limitations hereof or any sign that was lawfully in existence
and displayed on the effective date of any amendment to this Sign
Code but that does not conform to such amendment.
Any sign designating the name of the owner or occupant of
the premises upon which the sign is placed, or identifying such premises,
or advertising goods manufactured or produced, or services rendered
on or listing the sale or lease of the premises upon which the entire
sign is located.
Any sign which is not a temporary sign.
A sign supported by a sign structure in the ground and that
is wholly independent of any building, other than the sign structure,
for support.
Any sign not permanently attached to the ground or other
permanent structure or a sign designed to be transported by means
of wheels.
Any sign attached to any part of a building or structure
and that extends outward more than six (6) inches. Canopies and awnings
shall not be considered projecting signs if they do not contain signage
information. However, when they do provide signage information, canopies
and awnings shall constitute projecting signs.
A sign that carries a message regarding a special event or
function that is of general interest to the community and does not
include for-profit business promotional activities that are strictly
commercial in nature. Such signs may include banners or seasonal decorations
and may be placed within the right-of-way.
Any words, numbers, figures, devices, designs or trademarks
by which anything is made known, such as are used to designate an
individual, a firm, profession, business or a commodity and which
are visible from any public street. Any device that supports, has
supported or is designed to support a sign, including any decorative
cover, exclusive of any copy.
A sign which either:
Any sign permanently attached to a motor vehicle.
Any sign advertising sales of specials attached to any window
visible from a public right-of-way. Window signs must be located inside
the window and shall be limited to only temporary advertisement of
sales or specials. When a sign is permanently painted on or otherwise
attached or applied to the window area so as to be visible to the
general public, then such sign shall be included in the total allowable
sign area for the building. Window signs shall not be placed on door
windows or other windows needed to be clear for pedestrian safety.
An accurately scaled development plan that illustrates the
existing conditions on a land parcel, as well as depicting details
of a proposed development.
A rough plan of a proposed subdivision or other development.
A device or materials used to conceal one (1) element of
a development from other elements or from adjacent or contiguous development.
Screening may include one (1) or a combination of the following materials
of sufficient mass to be opaque or that shall become opaque after
twelve (12) months and which shall be maintained in an opaque condition:
solid fences, walls, berms, plantings or other features. A chain link
fence with plastic or wooden inserts shall not be considered solid
screening.
Incinerators, processing facilities, materials recovery facilities,
solid waste transfer stations or any facility where municipal solid
wastes are salvaged, sorted, processed or treated.[22]
A non-farm-based facility used or intended to be used for
selling or holding livestock.
That portion of a building included between the surface of
any floor and the surface of the next floor above it or, if there
is no floor above it, then the space between such floor and the ceiling
next above it.
The lowest story in a building that qualifies as a story
as defined herein, except that a floor level in a building having
only one (1) floor level shall be classified as a story, provided
such floor level is not more than four (4) feet below grade, as defined
herein, for more than fifty percent (50%) of the total perimeter or
not more than eight (8) feet below grade, as defined herein, at any
point.
A public or private way used or intended to be used for passage
or travel by motor vehicles. Streets are further classified by the
functions they perform as follows:
A street which collects and distributes traffic to and from
local and arterial street systems and is primarily intended to provide
for low-to-moderate volume, low speed and short length trips while
also providing access to abutting property.
The highest altitude of the street vertically under any portion
of the sign or its supports.
A street primarily providing direct access to abutting properties
and designed to accommodate low-volume, low-speed traffic (typically
less than five hundred (500) vehicles per day).
A street primarily intended to provide for high-volume, moderate-speed
traffic (normally carrying ten thousand (10,000) to fifteen thousand
(15,000) vehicles per day) and moderate to extended trip length traffic
movement between major activity centers. Access to abutting property
is subordinate to major traffic movement and is subject to the necessary
control of entrances and exits.
A street that interconnects, augments and feeds the primary
arterial system and is intended for moderate-volume, moderate-speed
traffic (with a volume range of five thousand (5,000) to ten thousand
(10,000) vehicles per day) and short to moderate trip lengths. Access
to abutting property is partially controlled.
The horizontal distance between the outside edges of a street's
pavement, including any curbing and guttering, measured at right angles
to the street's centerline.
Anything constructed or erected, the use of which requires
permanent or temporary location on or in the ground, including, but
not without limiting the generality of the foregoing: houses, buildings,
barns, backstops for tennis courts, bridges, fences, pergolas, parking
lots, gazebos, radio and television antennae, signs, solar collectors,
microwave antennae including supporting towers, roads, ruins or remnants
(including foundations), swimming pools, walkways, septic systems
or any similar item.
A use primarily engaged in the provision of recording or
broadcasting services accomplished through the use of electronic mechanisms.
A person, firm, corporation, partnership or association which
causes land to be divided into a subdivision for itself or for others.
The division of tract of land into two (2) or more lots or
parcels for the purpose of transfer of ownership or building development
or, if a new street is involved, any division of a parcel of land.
However, the division of land shall not be considered to be a subdivision
when the smallest parcel created is more than forty (40) acres in
area. The term "subdivision" includes resubdivision
and the term "resubdivision", as used herein, shall
include any further subdivision of a lot or parcel of land previously
subdivided for sale, use or other purpose which vary from the latest,
approved plat of the same.[23]
A professional land surveyor registered in the State of Missouri.
An activity which may commonly be described as carnival rides
or amusement park rides as accessory uses to an existing and legally
conforming business use or uses and for the purposes of promoting
business sales and/or raising funds for community service organizations
or for the purpose of promoting any special event, any community educational
campaign, any membership drive or any other similar promotion and
which activity is established for a fixed period of time with the
intent to discontinue such activity upon the expiration of the time
period.
A level, landscaped area directly adjacent to a principal
building at or within three (3) feet of the finished grade and not
covered by a permanent roof or enclosed by temporary or permanent
walls.
A structure with a fixed location which is designed primarily
with the objective of obtaining an elevation above other objects to
support an antenna or other device for receiving or transmitting radio,
television, microwave or other telecommunications or signals. This
definition does not apply to utility poles.
A facility used or intended to be used as an area for loading,
unloading and interchange of transit passengers. Typical uses include
bus terminals, rail stations and passenger-related mass transit facilities.
State licensed group-care homes for juvenile delinquents,
halfway houses providing residence, rehabilitation and counseling
to persons on release from a more restrictive custodial confinement
and residential rehabilitation treatment centers which also may provide
out-patient rehabilitation for alcohol and other drug abuse.
A facility licensed as such by the Missouri Department of
Health and Senior Services in connection with the transportation and
storage of medical marijuana.

The total number of all trips entering plus all trips leaving
a designated site over a given period of time.
The provision of instruction.
Land in its natural state before development.
The duly approved, enacted and amended ordinance which controls
and regulates zoning in the City of Oak Grove.
Lands that are subject to flooding or otherwise deemed uninhabitable/unusable
in their natural state by the Planning Commission and City Council
shall not be platted for residential use or for any other use that
might create a danger to health, safety or property, or which might
increase the flooding hazard within or outside the subdivision. Such
lands shall be set aside for recreational use or shall be retained
in their natural state as open space; provided however, that such
lands may be platted and developed if the features making the lands
uninhabitable/unusable can reasonably be removed without destruction
of adjacent or nearby property or desirable natural features of the
land and if necessary approval is obtained from the Planning and Zoning
Commission and the City Council. In all platting adjacent to such
area, adequate provisions for access to said areas, as determined

An area that is intended to provide light and air and is
designed for either environmental, scenic or recreational purposes.
Usable open space may include, but is not limited to, lawns, decorative
plantings, walkways, active and passive recreational area, playgrounds,
fountains, swimming pools, wooded areas and watercourses. Usable open
space shall not include, but is not limited to, manmade reservoirs
or dams, retention or detention ponds, driveways, parking lots or
other surfaces intended for vehicular travel. Usable open space shall
also not include any other manmade elements that will take away or
cause to take away from the original lot area.

or operation on a site or in a building or facility.

Generating plants; electrical switching facilities and primary
substations; water and wastewater treatment plants; water tanks; and
similar facilities of agencies that are under public franchise or

A use primarily engaged in painting of or body work to motor
vehicles or heavy equipment. Typical uses include paint and body shops.
A use providing automobile repair or maintenance services
within completely enclosed buildings, but not including general vehicle
repair services.
The effect produced by any physical process characterized
by a periodic and usually rapid, oscillatory motion sufficient to
cause annoyance or discomfort, however, excluding blasting operations
for quarries and temporary construction activities.
A use providing education or training in business, commercial
trades, language, arts or other similar activity or occupational pursuit
and not otherwise defined as a college or university or school.
An enclosed storage facility containing independent, fully
enclosed bays that are leased to individuals exclusively for long-term
storage of household goods or personal property.
A use primarily engaged in the storage or sales of materials,
equipment or products to wholesalers or retailers. Typical uses include
cold storage, warehousing and long-term storage facilities, but excluding
residential storage warehouses and sales of goods to the general public.
A running stream of water; a natural stream fed from permanent
or natural sources, including rivers, creeks and streams. It must
flow in a definite channel, having a bed or banks. It must be something
more than surface drainage over the land.
A workshop where machines, machine parts or other metal products
are fabricated. Typical uses include machine shops, welding shops
and sheet metal shops.
The days of the week, excluding Saturdays, Sundays and recognized
holidays, during which normal business is conducted by the City of
Oak Grove. If only days are stated, then Saturdays, Sundays and holidays
shall be included.
An open space located on the same lot as and that lies between
the principal or accessory building or buildings and the nearest lot
line. Such yard is unoccupied and unobstructed from the ground upward
except as otherwise noted provided herein.
An open space extending the full width of the lot between
the nearest principal building and the front lot line and measured
perpendicular to the front lot line. The minimum front yard required
in each district of this Chapter shall be unoccupied and unobstructed
from the ground upward except as otherwise provided herein.
An open space extending the full width of the lot between
the nearest principal building and the rear lot line and measured
perpendicular to the rear building line. The minimum rear yard required
in each district of this Chapter shall be unoccupied and unobstructed

perpendicular from the side lot line. The minimum side yard required
in each district of this Chapter shall be unoccupied and unobstructed
from the ground upward except as otherwise noted.
The location of a building on a lot in such a manner that
one (1) or more of the building sides is directly on the lot line.
