Town of Penfield, NY Article III Animal Control Officer

§ 11-13 Title.

This article shall be known as the "Town of Penfield Animal Control Officer Law."

§ 11-14 Purpose.

The purposes of this article are to protect the health, safety and welfare of persons; to protect and preserve public and private property, peace and good order; and to promote the taking of effective and appropriate action when wildlife or animals become a nuisance, destroy property or menace an individual or domestic animal.

§ 11-15 Authority.

This article is adopted under authority of the New York Constitution, Article IX, the Municipal Home Rule Law, and the Town Law.

§ 11-16 Position created; qualifications; appointment.

The position of Animal Control Officer is hereby created. Such person shall be educated in the care, seizure, custody, confinement, trapping, destruction and disposal of animals. Such person shall be appointed by and serve at the pleasure of the Town Board.

§ 11-17 Powers, duties and requirements.

The Animal Control Officer shall:

A. Take the training required by the State Department of Environmental Conservation (DEC) so as to qualify and receive the nuisance wildlife control license issued by the DEC.

B. Be protected against rabies by pre-exposure vaccination.

C. Act as a Town Dog Control Officer as provided in the Penfield Dog Ordinance.[1]

D. Have responsibilities and render assistance relating to domestic cats.

E. Render assistance to residents of the Town whose persons and/or property are threatened by wild animals.

F. Report cases of cruelty or suspected cruelty to animals to the Humane Society of Rochester and Monroe County.

G. Deliver injured wildlife to a New York State licensed rehabilitator.

H. Deliver sick wildlife, other than those with rabies or suspected of being rabid, to a duly licensed veterinarian.

I. Take and release wildlife to the wild.

J. Destroy or arrange for the destruction of animals, and in the case of animals with rabies or suspected of being rabid, arrange for the delivery of the destroyed animal's brain to the Monroe County Department of Health.

K. Cooperate with New York State and Monroe County wildlife officers, police and peace officers in dealing with wildlife problems.

§ 11-18 Appearance tickets.

The Animal Control Officer is authorized to issue appearance tickets for violations of local laws and ordinances which such officer is responsible for enforcing.
