A Historic Preservation Board may be established by resolution of the Town Board pursuant to Town Law § 64, Subdivision 17-a, and General Municipal Law § 96-A. The number of Historic Preservation Board members and Chair shall be at the discretion of the Town Board.
The Penfield Historic Preservation Board shall consist of seven members to be appointed, to the extent available in the community, by the Town Board as follows:
A. 
At least one shall be an architect experienced in working with historic buildings.
B. 
At least one shall be an historian.
C. 
At least one shall be a resident in an historic preservation overlay district, or an owner of an historic property.
D. 
At least one shall have demonstrated significant interest in the field of historic preservation by involvement in a local preservation group, employment or volunteer activity in the field of historic preservation.
E. 
All members shall have a known interest in historic preservation and architectural development within the Town of Penfield.
Board members shall serve for terms of five years. Members shall serve terms with staggered expiration dates. The Chair of the Board shall be appointed by the Town Board for a twelve-month period, effective January 1 of each year.
The powers of the Board shall include:
A. 
Making recommendations to the Town Board for the employment of staff and professional consultants as necessary to carry out the duties of the Board.
B. 
Promulgating rules and regulations as necessary for the conduct of its business.
C. 
Designating structures, property(ies) or resources as landmarks with the consent of the property owner.
D. 
Making recommendations to the Town Board for the designation of structures as landmarks in cases where the owner(s) objects to designation and the designation of boundaries of historic preservation overlay districts.
E. 
Determining applications for certificates of appropriateness and hardship relief.
F. 
Providing a source of advice to the Town Board, property owners and to other governmental agencies concerning historic preservation issues.
A quorum for the transaction of business shall consist of four members. Less than a majority of the fully authorized membership may not transact any business. Board members are expected to attend all scheduled meetings unless excused by the Chair.
