A. 
It is hereby unlawful for any person who has not attained the age of seventeen (17) years to be or remain in or upon any of the streets or public places in the City at night as follows:
1. 
A person, who is fifteen (15) or sixteen (16) years of age, during the period ending at 6:00 A.M. and beginning at 10:59 P.M. on Friday and Saturday nights and ending at 6:00 A.M. and beginning at 10:00 P.M. on all other nights.
2. 
A person under the age of fifteen (15) during the period ending at 6:00 A.M. and beginning at 10:00 P.M. during all nights of the week.
B. 
This Section does not apply to any person under the age of seventeen (17) years where such person is accompanied by a parent, guardian or another person having the legal custody of such person or if in the performance of an errand or duty directed by such parent or guardian or other person having the care and custody of such person or whose employment makes it necessary to be upon said streets or at public places during the nighttime after said specified hours or a person attending or returning home from a function at any school or a person attending or returning home from an officially sponsored activity or a person on the sidewalk, street or alley directly adjacent to the building in which he/she resides, provided that such exceptions shall not apply when the person under age shall be playing or unnecessarily loitering in or upon any said streets or public places whether alone or accompanied by a parent, guardian or other person whomsoever.
C. 
It shall be unlawful for the responsible person of a juvenile to permit such juvenile to violate any provision of this Section. Three (3) violations of this Section by any one (1) juvenile shall be prima facie evidence that the responsible person of such juvenile has violated this Section.
D. 
Any violation of this Section shall be punished by a maximum fine of five hundred dollars ($500.00) or ninety (90) days in jail, or both.
