As used in this chapter, the following terms shall have the meanings indicated:
CAMPGROUND
Any parcel or tract of land owned by a person, the state, or a local government which is designed, maintained, intended or used for the purpose of providing sites for nonpermanent overnight use by four or more camping units, or by one to three camping units if the parcel or tract of land is represented as a campground.
CAMPING UNIT
Any portable device, no more than 400 square feet in area, used as a temporary dwelling, including but not limited to a camping trailer, motor home, bus, van, pickup truck, or tent.
OPERATOR
The owner of a campground or the person responsible to the owner for the operation of the campground.
PERSON
For purposes of issuing a campground license, an individual, partnership, corporation, association, firm, or company, whether tenant, owner, lessee, or licensee, or the agent, heir or assignee of any of these, but shall not include the City of Arcadia, Wisconsin.
A. 
When required. No person shall within the City of Arcadia operate a campground without first obtaining a campground license.
B. 
Separate license required. A campground license shall be required for each location or premises operated as a campground.
C. 
State and local permits. To be considered an eligible applicant and before opening a campground for business, the operator shall obtain all state and local permits, licenses, and authorizations required, including but not limited to the permit required by § ATCP 79.05, Wis. Adm. Code, as amended from time to time.
D. 
Issuance; fees. A campground license may be issued to an eligible applicant by the City Clerk-Treasurer under the authority of the Common Council after payment of a fee in the amount established by the Common Council by resolution, which, when so issued, shall permit the holder to operate a campground in accordance with this chapter. A campground license may be issued after April 1 in any license year. The license shall expire on the following March 31. The full license fee shall be charged for the whole or fraction of any year.[1]

E. 
License application. Application for a campground license shall be made in writing on forms prescribed by the Common Council and shall be filed with the City Clerk-Treasurer along with satisfactory proof that the operator has complied with and been issued a permit pursuant to Ch. ATCP 79, Wis. Adm. Code, as amended from time to time.
A campground operating pursuant to a campground license shall comply with all the requirements for campgrounds contained in Ch. ATCP 79, Wis. Adm. Code, as amended from time to time, and such requirements are hereby adopted and by reference made a part of this chapter as if fully set forth herein. Any act required to be performed or prohibited by Ch. ATCP 79, Wis. Adm. Code, as amended from time to time, is required or prohibited by this chapter.
A. 
Penalties for failure to obtain required license.
(1) 
Any person who operates a campground in violation of § 171-2A shall be required to forfeit not less than $50 nor more than $100.
(2) 
Any person who operates a campground after that person's campground license has been revoked by the Common Council shall be required to forfeit $50.
(3) 
Every day a person operates a campground without a valid license shall be counted as a separate offense.
B. 
Penalties for failure to comply with campground requirements.
(1) 
Any operator who violates any of the requirements contained in § 171-3 of this chapter:
(a) 
Shall be reported to the permitting agency which issued the permit to the operator pursuant to Ch. ATCP 79, Wis. Adm. Code, as amended from time to time; and
(b) 
May have the operator's campground license revoked by the Common Council.
(2) 
Any person whose campground license is revoked, pursuant to Subsection B(1) of this section, shall not be eligible for a campground license for a period of two years from the date of revocation, and no campground in which the person has an ownership interest shall be eligible for a campground license for a period of two years from the date of revocation.
