All land developments, as defined in this chapter, shall only
be developed following the approval of preliminary and final plats
as outlined by this chapter. Certain land developments are also classed
as "conditional uses" in the Peters Township Zoning Ordinance.[1] Where a conditional use is involved, approval of that
use shall be acquired as stipulated in the Zoning Ordinance prior
to the preparation and filing of a preliminary plat under this chapter.
A.Â
Specific intent. It is the purpose of this section to provide for
the orderly development of mobile home sites with specific emphasis
upon the provision of all necessary utilities, including an approved
public water supply system, a municipal sanitary sewer system, and
necessary electrical connections. In addition, it is the intent of
this section to permit a more varied, efficient and attractive development
pattern of mobile homes and to increase the flexibility and the location
and arrangement of such mobile homes. Furthermore, it is necessary
to provide for a viable interior circulation system with adequate
ingress and egress from public rights-of-way.
B.Â
Gross site.
(1)Â
Any owner of a minimum of 10 contiguous acres of land, zoned as R-1,
Agricultural-Residential, may request that the regulations of this
section be applied to such property following the granting of the
conditional use by the Council, in accordance with the conditions
of the Peters Township Zoning Ordinance.[1]
(2)Â
All lands comprising the mobile home park shall be held in single
and separate ownership.

E.Â
Operation.
(1)Â
Only the leasing of lots or berths for the placement of mobile homes
shall be permitted.
(3)Â
The minimum number of berths completed and ready for occupancy before
the first occupancy shall be 50.
(4)Â
No berth shall be rented for residential use of a mobile home in
any such park except for a period of 30 days or more, and no mobile
home shall be admitted to any park unless it can be demonstrated that
it meets the requirements of applicable local codes and ordinances.
All applicable permits required by the Township Zoning Ordinance[4] are required.
(5)Â
Should any mobile home park cease operation, all mobile homes shall
be removed from the premises and all future activities on the subject
property shall conform to the development and density standards as
established in the R-1, Residential-Agricultural District.

The proposed site situated within the R-2 District shall be no less
than five and no more than 50 contiguous acres in size, under single
ownership or control and shall be developed as a single entity for
the number of dwellings and other such uses as may be permitted under
this chapter following the granting of the conditional use by the
Council, in accordance with the conditions of the Peters Township
Zoning Ordinance.[1]
(2)Â
The proposed site shall be served by a public water system and community
or municipal sewer facilities.

Specific intent. It is the intent of this section to expand the scope
of the traditional nursing care facility to include living units,
with or without kitchens, for persons aged 60 or over and their spouses;
or persons requiring unskilled or part-time nursing care and their
spouses, and to permit as an accessory to such a land development
a limited floor area for doctors' offices.
B.Â
Gross site. The proposed site situated within the R-2 District shall
be no less than five acres and no more than 20 contiguous acres in
size, under single ownership or control and shall be developed as
a single entity for the number of units and other such uses as may
be permitted under this chapter following the granting of the conditional
use by the Council, in accordance with the conditions of the Peters
Township Zoning Ordinance.[1] The proposed site shall be served by a public water system
and municipal sewer facilities and shall not be located closer than
1/2 mile radius of another similar facility.
C.Â
Use regulations. Land, buildings and premises in a multipurpose facility
for the elderly shall be used by right for the following purposes
and no other:
(1)Â
Living units limited in occupancy to persons age 60 or over and their
spouses; or persons requiring unskilled or part-time nursing care
and their spouses;
(2)Â
Nursing care facilities;
(3)Â
Dispensaries for the use of the occupants only;
(4)Â
Common
dining facilities;
(5)Â
Group
recreation facilities;
(6)Â
Open
space areas;
(7)Â
Garages;
(8)Â
Doctors'
offices, as long as the gross floor area of such does not exceed 10%
of the gross floor area of all other facilities.
D.Â
Controls. As specified in the District Regulations of the Peters
Township Zoning Ordinance[2] in addition to those in this chapter.
(1)Â
Only the leasing of living units and offices shall be permitted.
(2)Â
The land development shall be operated and maintained as single unit.
(3)Â
All facilities and improvements shall be privately maintained except
where the Township might require an easement or right-of-way and accompanying
public improvements to maintain the public health and safety.
(4)Â
The owner/developer shall covenant in the subdivision and land development
agreement that the occupancy of the living units will be limited to
persons aged 60 years or older and their spouses, or persons requiring
unskilled or part-time nursing care and their spouses. The agreement
shall also stipulate that if the use of any portion of the land development
ceases to be for the purpose in the original application, then the
owner/developer must meet the full Zoning Ordinance requirements for
the new use.
(5)Â
The construction of doctors' offices cannot precede the construction
of nursing care and living unit facilities.
E.Â
Operation. The maintenance and operation of the development shall
be guaranteed by the owner/developer in accordance with the requirements
of § 1110 of the Peters Township Zoning Ordinance.
