B.
Any person who shall operate a vehicle or tractor at a speed in excess
of that established therefor, upon any highway or portion thereof
specified in this section shall, upon conviction thereof, be sentenced
to pay a fine of $35 and for exceeding a maximum speed limit by more
than five miles per hour, shall pay an additional fine of $2 for each
mile per hour in excess of five miles per hour in excess of the maximum
speed limit, and costs of prosecution, or, in default of payment of
such fine and costs, to undergo imprisonment for not more than one
day for each $10 of the unpaid balance of the fine and costs.

A.
The following intersections are hereby established as yield-right-of-way
intersections and official yield signs shall be erected (or are hereby
ratified if heretofore erected) in such a position as to face traffic
approaching the second-named highway from the first-named highway.
All vehicles and tractors approaching any such intersection upon the
first-named highway shall yield the right-of-way to any vehicle in
the intersection or approaching on the second-named highway so closely
as to constitute an immediate hazard during the time that the operator
of such vehicle or tractor is moving across or within such intersection:

B.
Any person who shall violate any provision of this section shall,
upon conviction thereof, be sentenced to pay a fine of $150 plus $150
for each 500 pounds, or part thereof, in excess of 3,000 pounds over
the maximum allowable weight, plus costs of prosecution, or, in default
of payment of such fine and costs, to undergo imprisonment for one
day for each $10 of the unpaid balance of the fine and costs.

It shall be unlawful for any person to operate any vehicle or
tractor upon any highway in the Township that is under construction,
resurfacing or repair, in disregard of any official sign, barricade
or notice that the same is closed to vehicular traffic.
A.
The Chief of Police is hereby authorized to designate as play highways,
whenever he shall deem such action advisable and for whatever period
of time directed by him, any portion of any highway in the Township
whereon sledding and coasting shall be permitted. Such highway shall
be set apart for the purpose under the direction of the police and
be conspicuously posted to protect vehicles.
B.
No person shall operate any motor vehicle or tractor upon any play highway at any time when such highway shall be so designated, except in case of emergency, with special permission of the police officer in charge, who shall first clear such play highway of all persons using such highway for the purpose for which it was set aside. Any person who shall violate any provision of this section shall, upon conviction thereof, be sentenced as set forth in § 410-6 of this chapter.[1]

A.
Intent and purpose. The Council of Peters Township finds and declares
that the provisions of this section are enacted in order to:
(1)
Provide for the registration of all dirt bikes and off-road recreational
vehicles designed primarily for off-street use and/or all other dirt
bikes and off-road recreational vehicles actually used by an operator
in areas of Peters Township which are located in areas off of defined
streets, roads, and highways within the Township;
(2)
Facilitate the identification and location of dirt bikes and off-road
recreational vehicles engaged in off-street use or reported stolen
or missing;
(3)
Establish regulations governing the operation of dirt bikes within
the Township.
B.
Registration requirements. The registration requirements of this
section shall apply to all dirt bikes and off-road recreational vehicles[1] owned by residents of the Township including such vehicles
commonly known as "trail bikes, dirt bikes, minibikes, and various
all-terrain vehicles" operated within the jurisdictional boundaries
of Peters Township, except those dirt bikes and off-road recreational
vehicles which are designed and used exclusively upon the defined
streets, roads, and highways within Peters Township, and are licensed
by the Commonwealth of Pennsylvania, and exempting also those dirt
bikes and off-road recreational vehicles owned and held solely for
sale by residents engaged in the business of buying or selling new
or used dirt bikes and off-road recreational vehicles.

C.
Application to nonresidents. All provisions of this section, including
registration requirements, shall apply to all nonresidents of Peters
Township who shall operate dirt bikes or off-road recreational vehicles
as herein defined within the jurisdictional boundaries of Peters Township.
D.
AGRICULTURAL PURPOSES
DIRT BIKE
OFF-ROAD RECREATIONAL VEHICLES
Definitions. As used in this section:
The use of vehicles on farms, as defined in the Zoning Ordinance.[2]
Motor-driven cycle having two wheels in a tandem arrangement,
including such types commonly known as "trail bikes, dirt bikes, and
minibikes, etc.," which are designed primarily for off-street use
which are not otherwise licensed under the Pennsylvania Motor Vehicle
Code.[3]
All motor-driven off-road vehicles or all-terrain vehicles,
including snowmobiles, regardless of number of wheels, which are not
otherwise licensed under the Pennsylvania Motor Vehicle Code.[4]
E.
Registration of dirt bikes and off-road recreational vehicles. It shall be a violation of this section for any resident to operate a dirt bike or an off-road recreational vehicle within the jurisdictional boundaries of Peters Township unless such dirt bike or off-road recreational vehicle is registered pursuant to § 410-16B and unless such dirt bike or off-road recreational vehicle properly displays valid registration plates and validation stickers pursuant to this section.
F.
Procedure for registration.
(1)
Prior to operation of a dirt bike or off-road recreational vehicle
within the jurisdictional boundaries of Peters Township any such vehicle
shall be registered as provided herein.
(2)
To register a dirt bike or off-road recreational vehicle the owner
shall complete an application form provided by the Peters Township
Police Department and return said form to the Peters Township Police
Department with a registration fee of $10. The registration form shall
contain the following information:
(a)
The name, address and signature of the owner;
(b)
The vehicle identification number if any, of the dirt bike or
off-road recreational vehicle;
(c)
A brief description of the dirt bike or off-road recreational
vehicle, including the manufacturer or model name, color, horsepower
or measurement of motor displacement capacity of the dirt bike or
off-road recreational vehicle;
(d)
The name, address and age of all anticipated authorized operators
of said dirt bike or off-road recreational vehicle.
(3)
Upon submission of a completed application form, and payment of the
registration fee, the owner of the dirt bike or off-road recreational
vehicle shall receive from the Police Department a registration card
and two registration plates. The registration plates shall be affixed
to the dirt bike or off-road recreational vehicle in a conspicuous
place in the front and rear of such dirt bike or off-road recreational
vehicle. The registration plates shall contain the following:

It shall be a violation of this section for any person to provide
or furnish false or misleading information concerning the dirt bike
or off-road recreational vehicle or the ownership of a dirt bike or
off-road recreational vehicle for the purpose of securing or attempting
to secure its registration.
G.
Use of registration card and plates.
(1)
A registration plate and its accompanying card shall automatically
become void upon the transfer of ownership of the dirt bike or off-road
recreational vehicle from the owner listed on the registration card
to another person. Within 15 days after such transfer of ownership,
the owner listed on the registration card shall notify the Police
Department of the transfer and shall surrender his registration card
and plates at the Peters Township Police Department.
(2)
The owner of a dirt bike or off-road recreational vehicle registered
pursuant to this section shall notify the Police Department of any
change of name or address within 15 days after the change.
(3)
Upon the dismantling of a dirt bike or off-road recreational vehicle
registered pursuant to this section, the owner shall remove the registration
plates and surrender the registration card and plates to the Police
Department and notify the Police Department that the dirt bike or
off-road recreational vehicle shall no longer be operated by him within
the jurisdictional boundaries of Peters Township.
(4)
It shall be a violation of this section for any person to operate
within the jurisdictional boundaries of Peters Township a dirt bike
or off-road recreational vehicle displaying an expired registration
plate or plate rendered void upon a transfer of ownership of the dirt
bike or off-road recreational vehicle.
(5)
It shall be a violation of this section for any person to attach
a registration plate to any dirt bike or off-road recreational vehicle
other than the one for which the plate was issued.
(6)
It shall be a violation of this section for any person to remove
a registration plate from a dirt bike or off-road recreational vehicle
except upon its expiration, or upon transfer of ownership of the dirt
bike or off-road recreational vehicle or in the event that the dirt
bike or off-road recreational vehicle is dismantled and no longer
operated within the jurisdictional boundaries of this Township.
H.
Registration expiration date. Registration of dirt bikes or off-road
recreational vehicles shall be for periods of three years from date
of issue and shall not be transferable.
I.
Record of registration. The Peters Township Police Department shall
maintain a complete record of all dirt bike or off-road recreational
vehicle registrations issued pursuant to this section, including the
following:
(1)
A copy of all registration application forms filed by owners of dirt
bikes or off-road recreational vehicles;
(2)
The names and addresses of all holders of current registration cards
and plates;
(3)
The registration numbers and vehicle identification number of all
dirt bikes or off-road recreational vehicles registered pursuant to
this section;
(4)
A record of all fees paid pursuant to this section;
(5)
A record of the registrations of all dirt bikes or off-road recreational
vehicles which have been suspended pursuant to this section and the
reasons for the suspension.
J.
Operation of dirt bikes or off-road recreational vehicles.
(1)
No dirt bike or off-road recreational vehicle as herein defined shall
be operated beyond the defined streets, roads, highways and driveways
within Peters Township without the prior express approval of the owners
and/or occupiers of said private property.
(2)
No dirt bike or off-road recreational vehicle subject to this section
shall be operated on any public property within Peters Township except
in such areas within which said dirt bikes or off-road recreational
vehicles may be operated, but in no event shall such designated areas
be deemed to include sidewalks, walkways, bike paths, or paved rights-of-way
which are otherwise primarily used for pedestrian or other vehicle
traffic. It shall be the operator's responsibility of the dirt bike
or off-road recreational vehicle to determine, from the Township,
the locations of any such designated areas.
(3)
Nothing contained in this section shall authorize the operation of
dirt bikes or off-road recreational vehicles on the public or private
streets, roadways, or highways within Peters Township in such instances
where said dirt bikes or off-road recreational vehicles could not
otherwise be lawfully operated under the provisions of the Pennsylvania
Motor Vehicle Code as amended from time to time.
(4)
No dirt bike or off-road recreational vehicle shall be operated in
any manner which is unreasonably dangerous to the safety and well-being
of any person or real or personal property in its immediate vicinity.
(5)
No person shall operate a dirt bike or off-road recreational vehicle
within the jurisdictional boundaries that has not been properly registered
or for which the registration has expired or for which the registration
or operational rights have been suspended under this section.
(6)
To further implement and foster the intent of this section, it shall
be unlawful for any person to operate, cause to operate or to participate
in the operation of any dirt bike or off-road recreational vehicle
on any single property less than two acres and within a distance of
100 feet of any property line.
(7)
No vehicle shall be operated in such a manner as to create an unreasonable
amount of dust or dirt. An "unreasonable amount" of dust or dirt shall
mean suspended particle matter visible to the unaided or naked eye
from a distance of 50 or more feet.
(8)
Nothing contained herein shall be construed to prohibit the use of
a vehicle(s) when such is incidental to home lawn or garden work or
maintenance, or for agricultural purposes.

(9)
It shall be unlawful for any property owner to permit off-road vehicles
to be operated on their property contrary to the provisions of this
section.
K.
Public information. At the time of registration of any dirt bike
or off-road recreational vehicle as provided herein, the Police Department
shall provide to the owner of the dirt bike or off-road recreational
vehicle a copy of this section. Copies of this section shall also
be available upon request from the Police Department by any interested
person.
L.
Penalties. Any person convicted of a violation of this section shall
be punished by a fine of not less than $50 and not more than $300
and/or suspension of registration of the violator's dirt bike or off-road
recreational vehicle for a period up to 30 days, or any combination
thereof.

the shoulder of the following streets for the purpose of making a
right turn onto the intersection street:
