It shall be unlawful for any person to enter or remain on or
about the premises of any establishment permitted by law to dispense
alcoholic beverages for the purpose of consuming alcoholic beverages
at a time more than one hour after the latest time when sales of liquor
or malt beverages are legally permitted for such establishment.
It shall be unlawful for an owner, proprietor, steward, manager,
bartender, employee or any other person to sell, furnish or serve
liquor or malt beverages to business patrons, guests or invitees at
any time past the latest time when such beverages are legally permitted
to be sold under the regulations of the Pennsylvania Liquor Control
Board.
There shall be a presumption in all instances where liquor or
malt beverages are found in the possession or control of any customer,
patron, or any other person other than the proprietor, licensee, bartender
or other agent or employee of the premises of any establishment permitted
to sell liquor or malt beverages at a time more than one hour after
the time permitted for their legal sale, that such beverages have
been sold by the proprietor or licensee after the time permitted for
the legal sale of such beverages.
The Peters Township Police Department shall be charged with
the duty of enforcing this article.
Any person who violates or permits a violation of this chapter
shall, upon conviction in a summary proceeding brought before a Magisterial
District Judge under the Pennsylvania Rules of Criminal Procedure,
be guilty of a summary offense and shall be punishable by a fine of
not more than $1,000, plus costs of prosecution. In default of payment
thereof, the defendant may be sentenced to imprisonment for a term
not exceeding 90 days. Each day or portion thereof that such violation
continues or is permitted to continue shall constitute a separate
offense, and each section of this chapter that is violated shall also
constitute a separate offense.
