When used in this article, the following terms shall have the following meanings:
BUILDING ACTIVITY
Includes all work associated with the erection, construction or structural alteration of any building, structure, dwelling or portion thereof located within Peters Township.
GRADING ACTIVITY
The act of changing the existing contour of the land in any way, including stripping or excavation of any material; the filling of any existing ground with natural or man-made material; and/or the relocation on any lot, tract or parcel of earth or other material.
MINIMAL NOISE
Sounds that are normally audible in a residential neighborhood during the time of occurrence. Examples of sounds that exceed minimal noise include sounds from heavy vehicular equipment, hammering and power tools used outdoors.
NEW CONSTRUCTION
The construction of a building on a lot where no building previously existed.
All building activity associated with new construction shall be permitted Monday through Saturday between the hours of 7:00 a.m. and 7:00 p.m., prevailing time. Activity on Sundays and in excess of the above-stated times will be limited to activities causing minimal noise. It shall be unlawful for any person, firm, corporation or association to conduct grading activity on a Sunday or legal holiday without the approval of the Peters Township Council or its designated representative. Grading activity is permitted only between the hours of 7:00 a.m. and 7:00 p.m. Monday through Saturday, unless these time limits are extended, excused or otherwise modified by the Peters Township Council or its designated representative.
The Peters Township Police Department and the Peters Township Code Enforcement Officer shall be charged with the duty of enforcing this article.
Any person, firm, corporation or association who or which violates or permits a violation of this article shall, upon being found liable therefor in a civil enforcement proceeding commenced by the Township before a Magisterial District Judge, pay a fine of not more than $600, plus all court costs, including reasonable attorney's fees, incurred by the Township in the enforcement of this article. If the defendant neither pays nor timely appeals the judgment, the Township may enforce the judgment pursuant to the applicable Rules of Civil Procedure. Each day a violation exists shall constitute a separate offense. Further, the appropriate officers or agents of the Township are hereby authorized to seek equitable relief, including injunction, to enforce compliance herewith.
