As used in this article, the following terms shall have the meanings indicated:
MUNICIPALITY
The Home Rule Municipality of Peters Township.
SAFE CONDITION
A sidewalk that is free of tripping hazards, obstructions or other conditions that may prevent reasonable pedestrian travel.
SIDEWALK
Any concrete or asphalt walking path located within a street right-of-way, be it Township, private or state maintained.
After the initial installation of any sidewalk, all repairs and replacement shall be the responsibility of the abutting property owner. If an association has been established and maintains the sidewalks, the association is responsible for maintenance of sidewalks along open spaces and/or land owned by the association.
The Township Manager or his designee shall determine if a sidewalk is in a safe condition. If determined the sidewalk is not in a safe condition, the property owner shall be given written notice of said condition and directed to make repairs consistent with the Township's specifications for a sidewalk as stated in Chapter 385, Subdivision and Land Development, Appendix A, Drawing CD-6.[2] The property owner or responsible party will be given 30 days to make repairs as specified in the notice of repair.

At the discretion of the Municipality and upon the failure of any owner of abutting property or responsible party, the Council of Peters Township may direct the Township Manager to have said sidewalk repaired by Township forces or through a contract. The cost of said repair shall be collected from the owner or responsible party plus a penalty of 10% in the manner provided by law.
It shall be unlawful for any person to tear up, destroy, remove, deface or excavate or otherwise damage any sidewalk or curb in the public highways of the municipality, except in accordance with a permit duly issued by the Manager or his designee upon written application.
It shall be unlawful for any person to deposit any dirt, glass, rubbish, garbage, or refuse matter upon any sidewalks in the public highways of the municipality. The sidewalks shall be kept open and unobstructed at all times for use of the public, and the owner of the abutting property or responsible party shall keep the sidewalk areas free from weeds, hedges, signs, and other similar obstruction at all times unless authorized by a permit from the municipality.
When snow of one inch or more accumulates on a sidewalk, all abutting property owners or responsible parties shall have said snow removed within 24 hours following the accumulation of one inch of snow or more. Said sidewalks shall be made free of snow and ice so that the public may safely use the sidewalk. If in the opinion of the Manager or his designee and after a period of 24 hours of the accumulation of snow, the Manager may direct said sidewalk to be cleared of snow and the property or responsible party will be responsible for the cost of said work plus a penalty of 10% in a manner provided by law. This section is not to imply that the Manager or the Township is obligated to clear the sidewalk of snow or other materials.
