A. Adoption Of Building Code. A certain document, three (3) copies of which are on file in the office of the Building Commissioner of the City of Valley Park being marked and designated as the International Building Code, 2009 Edition, including Appendix Chapters E, F, G, H and I, as published by the International Code Council, be and is hereby adopted as the Building Code of the City of Valley Park in the State of Missouri for regulating and governing the construction, alteration, movement, enlargement, replacement, repair, equipment, location, removal and demolition of buildings and structures, except one- and two-family buildings regulated by the International Residential Code, 2009 Edition, as adopted by this jurisdiction; providing for the issuance of permits and collection of fees therefore; and each and all of the regulations, provisions, penalties, conditions and terms of said Building Code on file in the office of the Building Commissioner of the City of Valley Park are hereby referred to, adopted and made a part hereof, as if fully set out in this Section, with the additions, insertions, deletions and changes, if any, prescribed in Subsection
(B) below.
B. Exception, Additions, Deletions, Insertions And Changes. Amendments to the Building Code are as set out herein:
Section 101.1 Insert: "City of Valley Park".
Section 108.2.1 Insert: "Fee schedule" as follows:
1. The City reserves the authority to charge and collect reimbursement
for third party building plan, site plan, landscape plan or other
review including, but not limited to, engineering and other professional
costs. The City shall implement an escrow and/or deposit procedure
whereby an amount is deposited with the City equal to the estimated
third party costs, with upward or downward adjustments being made
after actual costs are known.
2. The following fees shall apply to issuance of all building permits:
$3.00 per $1,000.00 of estimated construction costs for residential/commercial
$15.00 minimum fee residential/commercial
$-2.00 per $1,000.00 of estimated construction costs for plan
review and code analysis
3. The following fees shall apply to building inspections: $25.00 each
inspection.
The number of inspections for each structure under consideration
shall be determined by the code official. Any additional inspections
made at the request of any individual or contractor or authorized
agent shall be subject to additional fees.
4. The following fees shall apply to occupancy permits: $75.00 to be
paid at the time of scheduling the inspection appointment.
Upon each change in occupancy by sale, lease or rent of a structure,
an occupancy permit shall be obtained.
5. In the event a structure is occupied prior to completing an occupancy
inspection, a charge of double the normal inspection fee shall be
paid.

Delete Section 112.1 in its entirety and replace
with the following:

112.1 The Board of Adjustment shall have jurisdiction
under this Chapter to hear and decide appeals where it is alleged
by an aggrieved person that there is error in any order, requirement,
decision or determination relating to the interpretation and application
of the Building Code made by the Code Enforcement Officer or any other
person charged with the enforcement of this Chapter.

C. Nothing in this Section or in the Building Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing under any act or ordinance hereby repealed as cited in Subsection
(B) above; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Section.

A certain document, one (1) copy of which is on file in the office of the Building Commissioner of the City of Valley Park being marked and designated as the International Residential Code, 2009 Edition, except for Chapter 29, Water Supply and Distribution; Chapter 25, Plumbing Administration; Chapter 27, Plumbing Fixtures; and Chapter 26, General Plumbing Requirements, which are not adopted by the City, as published by the International Code Council, be and is hereby adopted as the Residential Code of the City of Valley Park in the State of Missouri for regulating and governing the construction, alteration, movement, enlargement, replacement, repair, equipment, location, removal and demolition of detached one- and two-family dwellings and multiple single-family dwellings (town houses) not more than three (3) stories in height with separate means of egress as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Residential Code on file in the office of the Building Commissioner of the City of Valley Park are hereby referred to, adopted and made a part hereof, as if fully set out in this Section, with the additions, insertions, deletions and changes, if any, prescribed in Subsection
(B) below.

Add new Section R313.3 "Carbon Monoxide Detectors".

R313.3 Carbon Monoxide Detectors. Carbon monoxide
detectors shall be installed in the immediate area outside of all
sleeping rooms. When more than one (1) carbon monoxide detector is
required to be installed within an individual dwelling unit, the devices
shall be interconnected in such a manner that the actuation of one
(1) detector will activate all of the detectors in the individual
unit. The detector shall be clearly audible in all bedrooms over background
noise levels with all intervening doors closed.

Code of the mechanical jurisdiction having authority.

Any person violating any of the provisions of this Chapter or
any of the codes adopted in this Chapter shall be deemed guilty of
a misdemeanor and upon conviction thereof shall be fined in an amount
not exceeding one thousand dollars ($1,000.00) or be imprisoned in
the City or County Jail for a period of not exceeding ninety (90)
days, or both such fine and imprisonment. Each day such violation
is committed or permitted to continue shall constitute a separate
offense and shall be punishable as such hereunder.
