As used in this article, the following terms shall have the meanings indicated:
PERSON
Any person, persons, firm, partnership or corporation.

No person shall dock a boat at the public dock stalls at West Creek in this Township without first having obtained a permit for such privilege in the manner hereinafter provided. Dock permits shall not be assignable or transferable, and any change in the identity of the permittee or ownership of the permitted boat shall require a new application for a permit as provided by this article.
No person shall use, take or occupy one or more boat stalls or spaces until a permit for that purpose has been obtained.
No person shall use the dock or any part thereof as a boat stall or space, except that portion of said dock now or hereinafter set apart for boat stalls or spaces.

A. 
Applications. Any person desiring to obtain the privilege of docking at a Township boat stall or space may do so by applying and making application for a dock stall or space permit from the Township Dockmaster. In addition to any other information which may be required by the Township Dockmaster, the application shall set forth the applicant's full name, residence address, business address, social security number and driver's license number.

B. 
Conditions of permit. Every person obtaining a dock stall or space permit must provide the Township Dockmaster with a residence and business telephone number in case of emergencies. The Township is not responsible for any damage or injury resulting from fire, theft or vandalism at the Township dock or the permittee's boat or stall. If a boat sinks or takes water, the Township Dockmaster will notify the permittee at the telephone number provided by a collect call. The permittee shall raise or pump the boat within 24 hours of receiving notice. The Township Dockmaster shall not be required to board any boat to pump out water or make any repairs to a nonfunctioning pump. In the event the permittee takes no action to raise or pump a sunken boat or partially sunken boat, whether the permittee has notice of the condition of the boat or not, the Township Dockmaster may have the boat removed at the expense of the permittee and/or owner of the boat. The Township Dockmaster may make and enforce other reasonable and necessary regulations concerning the activities at the Township's docks.

The Township Committee shall have the right to appoint a person of its choice to be known as Township Dockmaster, whose duties will be to act upon the issuance and application for dock stall permits and to whom all applications should be made. The said issuance of permits by the Township Dockmaster shall, however, be subject to final approval of the Township Committee.

The annual fee for the issuance of each permit shall be as set forth in Chapter 135, Fees.

All fees received by the Township Dockmaster shall be turned over to the Township Chief Financial Officer and shall be and become the property of the Township of Eagleswood. There will be no refund of any permit fees once paid to the Township.

A. 
All permits issued shall be for a period of one year, commencing on January 1 and terminating on December 31 of each year.
B. 
Any application to renew a permit for an additional year must be made at any time during the month of December prior to its expiration on January 1.
C. 
New permits or permits for those persons holding expired permits shall be available beginning January 1 on a first-come-first-served basis.

All fees shall be paid in full at time of the issuance of the permit.
Any person violating or failing to comply with any of the provisions of this article shall, upon conviction thereof, be punishable by a fine of not more than $500 or by imprisonment for a term not to exceed 90 days, or by both such fine and imprisonment, in the discretion of the Municipal Judge. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
